SUMMARY
Steve Ach of Centex has requested the City Council consider tabling action regarding the findings of fact in
support of denial of the Bloomfield PUD amendment. Otherwise the findings would have been placed on the
consent agenda for action. Staff understands that Centex needs to proceed with platting single family lots as
soon as possible and hopes to avoid further lengthy reviews. The logical way to accomplish this objective is to
final plat as many single family lots as necessary that were already part of the previously approved final plat.
This action could potentially result in more than 90 standard size lots. The grading plan needs to be redesigned
because of the need for additional walk -out lots. This revision can occur concurrently or even after final plat
approval.
RECOMMENDED ACTION:
Motion to adopt the resolution of denial of the Centex PUD Amendment based upon findings of fact.

A RESOLUTION FOR DENIAL OF
AN A-MENDMENT TO THE
BLOOMFIELD PLANNED UNIT DEVELOPMENT
REQUESTED BY CENTEX HOMES
BASED UPON FINDINGS OF FACT
WHEREAS, the Community Development Department received an application for an
amendment to the Bloomfield Planned Unit Development on December 12, 2000; and,
WHEREAS, the Planning Commission conducted a public hearing as required by the zoning
ordinance on January 23, 2001.
NOW, THEREFORE, BE IT RESOLVED, the City Council of the City of Rosemount hereby
denies the Planned Unit Development Amendment requested by Centex Homes based upon
findings of fact:
FINDINGS OF FACT
1. The Planned Unit Development amendment increases the proportion of multiple family
housing overall from 42.8% to 46 %. an increase of 3.2% from the originally approved
Planned Unit Development. The Comprehensive Plan targets an overall proportion of
single family to Multiple family at 65% and 35% respectively, and therefore, the
amendment should modify the proportion to be closer to than further from the
Comprehensive Plan housing mix goals.
2. The Planned Unit Development Amendment as a result of the density proportion change
increases the amount of housing units in proximity to the Union Pacific Railroad right -of-
way (ROW) which currently accommodates 10 to 12 trains daily which is considered to
be excessive volumes of train traffic. Therefore, the amendment would increase the
adverse affects of the railroad including noise, vibration, safety, aesthetics and reduced
property values.
3. The proposal reduces lot widths a minim of 12.5 %, the plan does not provide suffient
useable and valuable open space to justify such a significant departure from lot standards.
4. The Developer has not demonstrated that required storm -water ponding areas will
provide amenity value sufficient to compensate for the reduction of lot width from
minimum standards overall.
5. The fifty foot wide envelopes available for building which results from the lot width

reduction to 70 feet will potentially translate to large numbers of a housing style that is
not acceptable to the City.

On March 20, 2001, the City Council will be considering a resolution to deny the concept plan that
Centex Homes presented to the City Council on March 5, 2001. Centex Homes would
respectively request the council reconsider the resolution to allow a revised concept plan be
submitted for consideration at the April 3, 2001 City Council meeting. Centex Homes would like to
submit a plan that takes into consideration some of the current issues that have come up since
the CIVIC Heartland concept was approved. If the council finds the revised concept plan to be
unacceptable, then the appropriate action can be taken. Centex believes these adjustments to
the approved concept should be discussed with the city council to allow for a timely decision.
