SUMMARY
The Schmidts own two lots along Bengal Avenue, one of which is occupied by their residence (12965 Bengel
Ave.). The Kohouts recently purchased their home (12995 Bengal Ave.) from Bruce Pylkas. Both property
owners jointly own a 67 foot wide strip of land #hat is adjacent to all three lots. The request would split the 67
foot wide parcel into three which would then be combined with each corresponding lot, hence the consolidation.
The subdivision ordinance allows this process as an option for property owners to consolidate fragments of land,
some of which might be unbuildable separately. In this case, three currently non - conforming lots in the Rural
Residential District will be improved with an additional 67 feet of lot depth added. The incentive to the City is
that the 67 ft. wide strip which is essentially unbuildable will be absorbed by adjacent existing lots. No new lots
are being created by this process.
RECOMMENDED ACTION:
Motion to adopt a resolution approving the consolidation of land requested by Paul & Mary Schmidt and
Jason & Angela Kohout.

A RESOLUTION APPROVING
THE LOT COMBINATIONS BETWEEN
JASON & ANGELA KOHOUT AND PAUL & MARY SCHMIDT
WHEREAS, the Community Development Department of the City of Rosemount received an
application from Bruce Pylkas, Jason & Angela Kohout, and Paul & Mary Schmidt for approval
of lot combinations concerning properties located at 12995 Bengal Avenue West and 12965
Bengal Avenue West in Rosemount, Minnesota, legally described as follows, to-wit:
Existing Schmidt Vacant lot
That part of the Southeast Quarter of the Southwest Quarter of Section 16, Township
115, Range 19, Dakota County,. Minnesota described as follows: Beginning at a point on
the west line of said Southeast Quarter. of the Southwest Quarter distant 158.63 feet north of
the southwest corner thereof, the west line of said Southeast Quarter of the Southwest
Quarter has an assumed bearing of North 00 degrees 00 minutes 49 seconds East; thence on
a bearing of East, parallel with the south line of said Southeast Quarter of the Southwest
Quarter, 226.20 feet; thence deflect left 85 degrees 45 minutes 30 seconds, which creates a
bearing of North 04 degrees 14 minutes 30 seconds East, a distance of 100.00 feet; thence

Quarter has an assumed bearing of North 00 degrees 00 minutes 49 seconds East; thence on
a bearing of East, parallel with the south line of said Southeast Quarter of the Southwest
Quarter, 67.00 feet; thence North 00 degrees 00 minutes 49 seconds East, parallel with said
west line 323.41 feet; thence North 52 degrees 11 minutes 23 seconds West 84.78 feet to
the west line of said Southeast Quarter of the Southwest Quarter; thence South 00 degrees
00 minutes 49 seconds West along said west line 375.38 feet to the point of beginning.
Containing 23,409 square feet.
WHEREAS, on November 20, 2001, the City Council reviewed the lot combinations for Jason
& Angela Kohout and Paul & Mary Schmidt.
NOW, THEREFORE, BE IT RESOLVED, the City Council of the City of Rosemount hereby
approves the lot combinations for Jason & Angela Kohout and Paul & Mary Schmidt, resulting
in the following legal description:
PARCEL A (new vacant lot)
That part of the Southeast Quarter of the Southwest Quarter of Section 16, Township 115, Range 19,
Dakota County, Minnesota described as follows: Beginning at a point on the west line of said
Southeast Quarter of the Southwest Quarter distant 158.63 feet north of the southwest corner thereof,
the west line of said Southeast Quarter of the Southwest Quarter has an assumed bearing ofNorth 00
degrees 00 minutes 49 seconds East; thence on a bearing of East, parallel with the south line of said
Southeast Quarter of the Southwest Quarter, 226.00 feet; thence deflect left 85 degrees 45 minutes
