The variances are for lot area and setbacks for a future utility building. The property is currently undeveloped, and is dominated by two wetlands and is much smaller than the minimum 2.5 acres. Subsequently, three of the neighboring property owners have filed an appeal of the variances. The primary concern of the neighbors is the relative size of the house and the impact on the wetlands. One neighbor has experienced basement flooding and fears that the problem will be aggravated. The appeal letter is attached. The zoning ordinance specifies that the City Council conduct a public hearing within thirty days of receiving the appeal. It is possible to schedule the hearing for January 16, 2001. However, the Council may also consider February 20,2001 to provide Staff and the appellants additional time for analysis of the issues and still be consistent with the intent of the ordinance requirement. RECOMMENDED ACTION: Motion to schedule a public hearing for February20,2001 starting at 7:30 pm. or as soon as possible thereafter to hear an appeal of a decision of the Board of Appeals & Adjustments CITY COUNCIL ACTION: December 26, 2000 City Council City of Rosemount Rosemount, Minnesota 55068 Re: Lot Area Variance and Setback Variance: 12355 Blanca Avenue, Rosemount, Minnesota, Michael Kulhanek Dear City Council: The purpose of this letter is to inform you that we would like to appeal the variances granted by the Board of Appeals and Adjustment on December 19, 2000, regarding the above property. We are appealing these variances because, first, we do not believe that the house proposed is compatible to the land on which it is being built. Secondly, the size of the home and number of buildings proposed to be built on the property are not compatible and are out of character to the neighborhood as evidenced by the presently existing homes and the Declaration of Protective Covenants for Oakwood Estates. Thirdly, the utility building as proposed encroaches on the neighboring property. Lastly, we are very concerned with the filling -in of the wetland as propos b ecause of the possible injurious impact it may have on neighboring homes. Please let us know when this matter is scheduled for hearing before the City Council.
