Action: (Board of Appeals & Adjustments- variance granted for lot width @ Bacardi Ave.) Recommendations of Approval of Rezoning and Plat SUMMARY This 13.77 acre parcel is currently zoned Agricultural. It is in an area designated for Rural Residential land use in the Comprehensive Plan. The related plat depends on the rezoning which changes the density limitations from 1 dwelling unit per 40 acres to 1 unit per five acres. The lot dimension standards are somewhat more lenient on the Rural Residential District as well. The subdivision into two lots will be in the form of a plat, which allows lots as small. as 2.5 acres. Unplatted land allows parcels of five acres or more. The two lots will have access to Bacardi Avenue because of the lack of public street availability on the north side and the buffer area of the wetland that would be impacted by a public street. PLANNING COMMISSION PUBLIC HEARING The Planning Commission acting as the Board of Appeals & Adjustments granted the variance to lot width for the strip of land to Bacardi Avenue. Regarding the plat, staff had received several phone calls and correspondence, which ranged from support by the neighbors to concern over loss of privacy. John and Terry McMenomy commented about their property to the east and the difficulty of providing access to it. As a result, staff recommended an additional condition of the plat, a 30 ft. wide (half) street easement that would be dedicated along the southern edge of the Altendorfer / Schlukebier property. In reaction, the Schlukebiers are objecting to the easement. They feel that there might be other alternatives that may be superior to the recommendation. The Planning Commission felt that the (half) street easement suggestion was good planning and included it in their recommendation. RECOMMENDED ACTION: Motion to adopt an ordinance rezoning the 13.77 acres to Rural Residential in conformance with the Comprehensive Plan. -and - Motion to adopt a resolution approving the Administrative Plat for Sclukebier Addition. CITY COUNCIL AC TION: City of Rosemount Ordinance No. B- AN ORDINANCE AMENDING ORDINANCE B CITY OF ROSEMOUNT ZONING ORDINANCE Altendorfer Property THE CITY COUNCIL OF THE CITY OF ROSEMOUNT, MINNESOTA, ORDAINS AS FOLLOWS: Section 1. CITY OF ROSEMOUNT DAKOTA COUNTY, MINNESOTA RESOLUTION 2001- A RESOLUTION APPROVING THE ADMINISTRATIVE PLAT FOR SCHLUKEBIER ADDITION WHEREAS, the Community Development Department of the City of Rosemount received an application from Chris and Lynda Schlukebier for approval of the Administrative Plat for property located at 12050 Bacardi Avenue in Rosemount, Minnesota; and WHEREAS, on June 26, 2001, the Planning Commission of the City of Rosemount reviewed the Administrative Plat for Schlukebier Addition and adopted a motion to recommend approval to the City Council; and WHEREAS, on July 17, 2001, the City Council of the City of Rosemount reviewed the Administrative Plat for Schlukebier Addition. Public Hearing: Schlukebier Lot Width V ariance & Rezoning and Administrative Plat Chairperson Caspar confirmed that the recording secretary has placed the Affidavit of Mailing and Posting of a Public Hearing Notice and Affidavit of Publication concerning the public hearing on the applications by Chris and Lynda Schlukebier for a lot width variance, rezoning, and administrative plat. Mr. Pearson summarized the proposal by Schlukebiers to purchase approximately 14 acres from Joe Altendorfer and subdivide the property into a 3 acre parcel for the existing house and 10.77 acres for a home to be built by Schlukebiers. The 10.77 acre lot will have 50' of frontage rather than the required 200' frontage, requiring a variance to lot Planning Commission Regular Meeting Minutes June 26, 2001 Page 4 width requirements. The proposed driveway must be shifted out of the wetland. Additionally, the property must be rezoned from Agriculture to Rural Residential in compliance with the Comprehensive Plan. Mr. Pearson explained an issue with a landlocked parcel of property located east of Schlukebiers' property and owned by the McMenomy family. It is uncertain whether an easement exists providing access for this property to the public road to the north. If an easement does exist, wetland mitigation would have to occur. Consideration was given to an easement along the southern boundary of Schlukebiers' property for access to the McMenomy property. However, it would be necessary for the property owners to the south to also grant an easement, and it appears they are unwilling to do so. Chairperson Caspar opened the public hearing. Terry McMenomy Woodbury, Minnesota, addressed issues with access to their property. He explained that, if an easement does exist to the north, a road could not be located through a wetland to gain access to Bacardi. John McMenomy 1283 135`" St. W., provided additional background on the access issue. Discussions continued on the access issue to the McMenomy property. MOTION by Arveson to close the public hearing. Seconded by Carr. Ayes: Napper, Caspar, Carr, Weisensel, and Arveson. Nays: 0. Motion carried. MOTION by Caspar to grant the variance to lot width requirements based upon the attached (draft) findings required of Section 14.2 of the zoning ordinance subject to relocating the proposed driveway out of the 75 ft. buffer area. Quinnell Recording Secretary City of Rosemount ATTN: Planning Commission 2875 145th Street W Rosemount, MN 55068 June 19, 2001 Dear Planning Commission, am writing you with my comments pertaining to the up- coming hearing regarding the rezoning of, land by Chris and Lynda Schlukebier on Bacardi Avenue in North Rosemount. This hearing is scheduled for June 26, 2001. 1 would have loved to be at the meeting, but I play a trumpet in a community band, and the band is performing that night at the Lake Harriet Bandshell in Minneapolis. And they need all the trumpets they can get!!! However, I wanted to take this written opportunity to give my input to the commission regarding the subject property. Our property is just North of Schlukebier's newly - purchased land. As the commission well knows, the area around, and including, this property is unique and beautiful to Dakota County. The subject property has a substantial, "high quality" cattail wetland, as well as a heavily wooded, dense forest of mainly large deciduous trees. Aside from Joe Altendorfer's "scrap operation ", the land has been un- touched for a long, long time. Because of the natural setting, I wish to wholeheartedly endorse the proposed rezoning of the property into two lots by Chris and Lynda. feel that, as long as the wetland and old- growth trees are protected [by the new Rosemount building regulations), the division of the land into two large lots would protect the majority of the land from serious construction degradation that would occur if the property were divided up into many smaller lots. Further, the large lot configuration assures that the wetland would be preserved and un- touched. I believe that this rezoning proposal is consistent with the overall direction that Rosemount's "Comprehensive Plan" has for this special region of the city. I trust that the Schlukebier's will site the proposed home, septic field and driveway to minimize the amount of damage to the surrounding landscape, trees and wetland areas, and that their driveway will not access our private drive, which runs along the North border of the subject property. I look forward to meeting Chris and Lynda, and welcome them as neighbors into our "little piece of Heaven" in Northern Rosemount/SW Inver Grove Heights. Welcome Chris and Lynda! Guide Plan Desig: Rural Residential Current Zoning: Agriculture Requested Rezoning: Rural Residential SUMMARY The Schlukebiers are purchasing Mr. Altendorfer's property consisting of almost 14 acres. They hope to build a new house on 10.77 acres, after subdividing the property by platting. A three acre lot will be platted for the existing house. Both lots will have access from Bacardi Avenue as the only available public street with a total frontage of 274.18 feet. The three -acre lot will have 224.11 feet of frontage and the 10.77 acre lot will have 50 feet of frontage resulting in the need for a variance to lot width requirements. Lots in the rural district require 200 feet of lot width for platted lots (300 ft. for unplatted). The only alternative would be to acquire an easement from adjacent property owners in Inver Grove Heights to use an existing private driveway, which connects to Bacardi Avenue and Gun Club Road in Eagan. There is a high quality wetland between the proposed building site and the private driveway. Staff is of the opinion that the fifty foot wide strip of land for access as a "flag lot" is preferable to the driveway encircling the east side of the wetland and connecting to the private driveway. The northerly land in Inver Grove Heights is rural and urban density development (with street improvements) is not anticipated. RECOMMENDED ACTION: Motion to grant the variance to lot width requirements based upon the attached (draft) findings required of Section 14.2 of the zoning ordinance subject to relocating the proposed driveway out of the 75 ft. buffer area. BOARD OF APPEALS & ADJUSTMENTS ACTION: FINDINGS The Board of Appeals and Adjustments and the City Council, upon appeal, must find as follows in the granting of a variance from this ordinance: 1. Granting a variance will not adversely affect the public health, welfare and safety and will not be detrimental or injurious to property or improvements in the neighborhood. The variance is requested for access, resulting in a fifty- foot wide strip of land for a driveway. There will be no setback reductions, in fact, the density of the resulting development will be lower than the maximum. 2. Strict interpretation or enforcement would result in a practical difficulty or unnecessary hardship inconsistent with the intent of this Ordinance and the Comprehensive Guide Plan. The existing 13.77 acre parcel appears to have at least one additional building site consistent with rural residential standards and density thresholds, with the only exception being access. The current or established use of the property appears to be residential, rather than agricultural. 3. There are exceptional or extraordinary circumstances or conditions applicable to the property, use or facilities that do not apply generally to other properties in the same district. The wetland dominates the site and is in the preserve category, which has the largest buffer requirements. The alternative strategy of routing a driveway around the wetland to the private driveway would result in a 700 ft. driveway in some potentially low areas. The proposed driveway as recommended by staff to be modified, would surround about 400 ft. of the wetland. 4. Strict or literal interpretation would deprive the applicant of the use and enjoyment of his property in a manner similar to other owners in the same district. As a rural residential use, the density of the property will be comparatively low, as a result of the wetland. Proposed Lot 2 will be at half the rural density. 5. Granting of the variance will not allow a use which is otherwise not a permitted use in the zoning district in question. Residential use is permitted in the Rural Residential District.
