This item is a request for Council to approve the plans and specifications and order the
advertisement for bids for Evermoor 6 & 7t Addition Street & Utility Improvements, City
Project #336. We have a set of plans and specifications on file in my office for your
examination. Previously the Council ordered the preparation of plans and specification on June
18, 2001.
Because this project is privately financed, the developer has waived his rights to the Chapter
429 assessment process and specifically to the bidding requirements with the attached letter.
Therefore, the bids will be received with only a two -week advertisement instead of the
customary three weeks. This was also done for the Evermoor 4th and Marcotte Forcemain
project.
The bid opening date has been set for August 3, 2001 at 10:00 a.m. at the Community Center.
RECOMMENDED ACTION: MOTION TO ADOPT A RESOLUTION APPROVING PLANS AND
SPECIFICATIONS AND AUTHORIZING ADVERTISEMENT FOR BIDS FOR EVERMOOR 6 TH AND
7TH STREET AND UTILITY IMPROVEMENTS, CITY PROJECT #336.

A RESOLUTION RECEIVING THE PLANS AND SPECIFICATIONS
AND AUTHORIZING ADVERTISEMENT OF BIDS FOR
EVERMOOR 6 TH AND 7 STREET AND UTILITY IMPROVEMENTS
CITY PROJECT #336
WHEREAS, the City Council of the City of Rosemount have ordered the preparation of plans and
specifications for Evermoor O and 7 Street and Utility Improvements, City * Project #336 and such plans
and specifications have been presented to this Council for approval:
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Rosemount, Minnesota:
Such plans and specifications are hereby approved and ordered placed on file in the office of the City
Clerk. '
2. The City Clerk shall prepare and cause to be inserted in the official City newspaper and the
Construction Bulletin an advertisement for bids upon the making of such improvements under such
approved plans and specifications for City Project #336.
3. The advertisement shall be published in each of said publications at least once not less than two (2)
weeks before the date set for opening bids because of a waiver of Chapter 429, shall specify the work
to be done, shall state the bids will be publicly opened on August 3, 2001 at 10:00 o'clock a.m. at
the Rosemount Community Center in said City and that no bids will be considered unless sealed and
filed with the City Clerk and accompanied by a cash deposit, cashier's check, bid bond or certified
check payable to the City Clerk for five (5 %) percent of the amount of such bid.

Re: Waiver of Chapter 429 Statue Bidding Process — Evermoor 6 & 7 Additions
Dear Mr. Weiss:
We as property owners of 100% of the petitioning /benefiting properties of Evermoor 6th
& 7 Additions understand under the 429 process we may request the city waive the
Public Hearing process, formal bidding requirements and assessment appeal process.
We also understand that by reducing the advertisement for bid period we may incur
increased project costs.
CPDC would like to formally request the city authorize the project with a two week
advertisement in an effort to expedite the project. We accept the risk and or cost
implications that this may impose upon the project.
