Guide Plan Desig: Urban Residential Current Zoning: R -1 Low Density Residential Nature of Request: To shift a common boundary line between Lot 1, Block 1 and the outlot intended for a trail entrance into Carroll's Woods Park. SUMMARY On August 21, 2001, the City Council approved the final plat for Wicklow Addition, a ten lot single family area in the southwest corner of Evermoor, near the water tower on Shannon Parkway. In preparing the grading plans for the plat area, Westwood Professional Services have requested that a lot line on the edge of Outlot A be shifted. The result will be an enhanced park entrance trail. This change affects only one lot, and does not create any variances. The modified lot 1, block 1 will actually have more street frontage. The attached sketch illustrates the change. This request to relocate a common boundary line between two properties is an exception to the subdivision ordinance. The approved final plat has not yet been recorded, so this action can be characterized as the type of change that sometimes occurs at a meeting involving a minor adjustment. The mylar film drawings have not yet been prepared, or signed, so this action is essentially a correction of the final plat which had been approved. This action is not as complex as the recent Innisfree corrective plat, which had already been recorded at Dakota County. No public hearing or Planning Commission review is required. RECOMMENDED ACTION: Motion to adopt a resolution approving the final plat for Wicklow Addition. CITY COUNCIL ACTION: 0 1 n CITY OF ROSEMOUNT DAKOTA COUNTY, MINNESOTA RESOLUTION 2001 - A RESOLUTION APPROVING THE FINAL PLAT FOR EVERMOOR WICKLOW ADDITION WHEREAS, the Community Development Department of the City of Rosemount received an application for final plat approval submitted by Contractor Property Developers Co. for Evermoor Wicklow Addition, as required by ordinance for the purpose of a residential development on land legally described as: That pat of the Southeast Quarter of Section 19, Township 115, Range 19, Dakota County, Minnesota, described as follows: Commencing at the northeast corner of Lot 1, Block 3, COUNTRY HILLS THIRD ADDITION, according to the recorded plat thereof, Dakota County, Minnesota, said point being on the west line of the East 2000.00 feet of said Southeast Quarter; thence North 00 degrees 45 minutes 37 seconds West, along said west line, a distance of 80.00 feet to the actual point of beginning of the land to be described; thence North 89 degrees 55 minutes 22 seconds East, along a line parallel with the south line of said Southeast Quarter, a distance of 300.00 feet; thence South 00 degrees 45 minutes 37 seconds East, a distance of 40.00 feet; thence north 89 degrees 55 minutes 22 seconds East, a distance of 20.20 feet; thence easterly along a tangential curve, concave to the north having a radius of 660.00 feet, a central angle of 12 degrees 04 minutes 37 seconds and an arc distance of 139.12 feet; thence South 00 degrees 22 minutes 16 seconds West, not tangent to last described curve, a distance of 140.60 feet; thence South 53 degrees 59 minutes 42 seconds East, a distance of 324.27 feet; thence South 00 degrees 04 minutes 38 seconds East, a distance of 193.08 feet to the south line of said Southeast Quarter; thence South 89 degrees 55 minutes 22 seconds West, along said south line, a distance of 713.18 feet to the said west line of the East 2000.00 feet of the Southeast Quarter; thence North 00 degrees 45 minutes 37 seconds West along said west line, a distance of 550.09 feet to the point of beginning and there terminating. WHEREAS, the Planning Commission of the City of Rosemount reviewed the final plat application for Evermoor Wicklow Addition at their regular meeting on August 14, 2001; and, WHEREAS, the Planning Commission adopted a motion to recommend approval of the final plat to the City Council as required by the Subdivision Ordinance, subject to conditions; and, WHEREAS, the City Council of the City of Rosemount reviewed the final plat application as required by the Subdivision Ordinance on August 21, 2001; and r Resolution 2001- WHEREAS, Contractor Property Developers Company has requested a common boundary line relocation for the southerly line of Lot 1, Block 1, as allowed by the Rosemount Subdivision Ordinance. NOW, THEREFORE, BE IT RESOLVED, the City Council of the City of Rosemount hereby approves the final plat for Evermoor Wicklow Addition, including the common boundary line relocation for Lot 1, Block 1, subject to: 1. Modification of Lot 5, Block 2 to eliminate the lot width variance. 2. Execution of a subdivision agreement to secure public infrastructure including streets and utilities; 3. Incorporation of recommendations of the Interim City Engineer relative to drainage, easements, grading, public streets and utilities; 4. Payment of all platting, G.I.S., Park Dedication, applicable City Review fees and trunk/area fees as specified in the current fee schedule resolution.
