SUMMARY
This single family residential proposal is an "infill" development that utilizes a combination of three existing parcels and
creates 5 new lots. The existing parcels consist of two houses and a vacant lot, all of which are larger than the current
minimum standard. The outer boundary of the subdivision is formed by Dodd Boulevard and the 150 Street West cul -de-
sac. Because this project is comparatively small, preliminary and final plat can occur concurrently. Preliminary plat
requires a public hearing, Final Plat does not.
No new streets are being constructed and the plat has been revised to eliminate lot dimension variances. Engineering
considerations including hooking up to existing utilities and storm -water draining and ponding may result in minor
revisions. A storm water ponding area will need an easement on the south side of lot 1. Park dedication will be in the form
of cash (Twin Puddles park is east of Lot 1).
The tree preservation inventory indicates 47 existing trees of which 30 will be removed. Staff calculates the tree
replacement requirement to be 21 trees. If more existing trees can be saved — particularly in the back yards, then the
replacement requirement could be reduced.
PLANNING COMMISSION PUBLIC HEARING AND ACTION
Several neighbors commented at the public hearing. They seemed to be in favor of the development and indicated that the
construction company never generated problems. However, one was concerned about the effects of development and all of
the kids used to playing on the cul -de -sac. Another neighbor commented that the long existing private driveway had
become a public street because people were used to it. One Planning Commissioner had questions regarding the driveway.
Staff indicated that the driveway would be removed and replaced by houses and two side yards, which would not "invite"
traffic. Jeff Nivila, the Builder indicated that care would be taken in the construction process to ensure safety. An
additional recommended condition requiring "conformance with the home occupation ordinance" was included in the
motion to approve the preliminary plat.
RECOMMENDED ACTION:
Motion to adopt a resolution approving the preliminary plat for Westhaven.

RESOLUTION 2001-
A RESOLUTION APPROVING THE
PRELIMINARY PLAT FOR WESTHAVEN
WHEREAS, the Community Development Department of the City of Rosemount received an
application from Basic Builders, Inc. for approval of the Preliminary Plat for Westhaven; and
WHEREAS, on August 28, 2001, the Planning Commission of the City of Rosemount reviewed
the Preliminary Plat for Westhaven and recommended approval, subject to conditions; and
WHEREAS, on September 4, 2001, the City Council of the City of Rosemount reviewed the
Preliminary Plat for Westhaven.
NOW, THEREFORE, BE IT RESOLVED, the City Council of the City of Rosemount hereby
approves the Preliminary Plat for Westhaven, subject to:
1. Incorporation of recommendations of the Interim City Engineer relative to drainage
easements, grading and utilities.
2. Park dedication in accordance with recommendations of the Parks and Recreation
Commission.
3. Preparation and implementation of a landscaping plan that includes five boulevard trees
and 21 replacement trees in accordance with the tree preservation requirements.
4. Conformance with the home occupation standards.

A RESOLUTION APPROVING THE
FINAL PLAT FOR WESTHAVEN
WHEREAS, the Community Development Department of the City of Rosemount received an
application for final plat approval submitted by Basic Builders, Inc. for Westhaven, as required
by ordinance for the purpose of a residential development on land legally described_ as:
PARCEL ONE. All that part of the Southwest Quarter of Section 30, Township 115,
Range 19, Dakota County, Minnesota lying south of Dodd Road; Excepting therefrom the
following described tracts:
Commencing at a point on the south line of said Section 30 distant 1043.00 feet east of the
southwest corner thereof; thence north, at right angles, 242.00 feet; thence east, parallel to
the south line of said Section 30,125.00 feet; thence north 220.00 feet to the centerline of
said Dodd Road; thence southwesterly, along said centerline, to the intersection with the
south line of said Section 30; thence east, along said south line, to the point of beginning.
Commencing at the intersection of the centerline of Dodd Road and the east line of the
Southwest Quarter of said Section 30, Township 115, Range 19; thence south, along said
east line of the Southwest Quarter, a distance of 16 rods; thence west 10 rods, thence north
to the centerline of Dodd Road; thence northeasterly, along said centerline of Dodd Road,
to the point of beginning.

said point being 1043.0 feet east of the Southwest corner and 242.0 feet north of the south
line thereof (measured at right angles); thence East, parallel to said south line, a distance
of 125.0 feet; thence North, at right angles, a distance of 220.0 feet to the centerline of
Dodd Road; thence southwesterly, along said centerline of Dodd Road, to a point directly
north of the point of beginning; thence South 168.00 feet to the point of beginning.
Together with the following described parcel of land: Beginning at a point in the
Southwest Quarter of Section 30, Township 115, Range 19, said point being 1043.0 feet

WHEREAS, the Planning Commission of the City of Rosemount reviewed the final plat
application for Westhaven at their regular meeting on August 28, 2001; and,
WHEREAS, the Planning Commission adopted a motion to recommend approval of the final
plat to the City Council as required by the Subdivision Ordinance, subject to conditions; and,
WHEREAS, the City Council of the City of Rosemount reviewed the final plat application as
required by the Subdivision Ordinance on September 4, 2001.
NOW, THEREFORE, BE IT RESOLVED, the City Council of the City of Rosemount hereby
approves the final plat for Westhaven, subject to:
1. Execution of a subdivision agreement to secure public infrastructure and landscaping.
2. Payment of all applicable platting fees specified in the current fee schedule including park
dedication, G.I.S., hook -up and trunk fees.
3. Dedication of expanded easements for stormwater ponding on Lot 1 in accordance with the
Interim City Engineer recommendations.
ADOPTED this 4th day of September, 2001, by the City Council of the City of Rosemount.
