Action: Recommendation of approval (3 -0) SUMMARY The proposed Cub Foods development has been revised as a result of public comment and additional market examination. In summary: _1 . The store will be 68,018 sq. ft. with a potential for a 11,000 sq. ft. expansion area. 2. The amount of brick will be increased with the objective of 50% overall. The southern Cub elevation will still be rock -faced block, screened from view by landscaping. 3. ' The berm along 151 st Street West will be augmented with an eight foot high masonry wall located on the outer edge of the loading dock paved area, resulting in a combination of berm, landscaping and the wall blended with the berm. 4. Signage will be a total of 270 sq. ft. instead of 300 and the 151st Street sign will be turned off at 11:30 pm. 5. Outdoor pedestrian furnishings for eating and resting will be oriented towards the likely eating establishments, particularly infront of the small retail building located at the north west comer of the site. PLANNING COMMISSION PUBLIC BEARING Extensive comments were received by the Planning Commission, of which many were opposed to the project. Staff explained the PUD process and previous comp plan and zoning decisions which led up to the application. Several people questioned the basis for the PUD amendment and process. Staff explained that the amendment process is the appropriate review procedure no matter if the deviation from the original PUD is slight or extensive. The Planning Commission discussed the development at length and added several recommendations to that of staff: 1. Elimination of the driveway to 151St Street, so that truck traffic access occurs at Crestone and Claret Avenues. 2. Any building expansion requires Site Plan review public hearing. 3. Signage will be limited to 275 sq. ft. and the southerly sign illumination shall be turned off after 11:30 pm. 4. 50% brick shall be required. zxvisions to the plan win ne avanabie at the meeting it they are not received in time for the packet assembly. RECOMMENDED ACTION: Motion to adopt a resolution approving the PUD Amendment for KTI Limited Partnership; and, Motion to adopt a resolution approving the final plat for Outlot B, McNamara Addition. I CITY COUNCIL ACTION: CITY OF ROSEMOUNT DAKOTA COUNTY, MINNESOTA RESOLUTION 2000 - A RESOLUTION APPROVING THE FINAL PLAT FOR KTJ LIMITED PARTNERSHIP (Cub Foods) WHEREAS, the Community Development Department of the City of Rosemount received an application for final plat approval submitted by KTJ Limited Partnership, as required by ordinance for the purpose of a commercial development on land legally described as: Outlot B, McNamara Addition, according to the recorded plat thereof, Dakota County, Minnesota. WHEREAS, the Planning Commission of the City of Rosemount reviewed the final plat application for Outlot B, McNamara Addition at their regular meeting on August 8, 2000; and, WHEREAS, the Planning Commission adopted a motion to recommend approval of the final plat to the City Council as required by the Subdivision Ordinance; and, WHEREAS, the City Council of the City of Rosemount reviewed the final plat application as required by the Subdivision Ordinance on August 15, 2000. NOW, THEREFORE, BE IT RESOLVED, the City Council of the City of Rosemount hereby approves the final plat for Outlot B, McNamara Addition subject to: , 1. Payment of Park Dedication and GIS fees in accordance wit0he current fee schedule. 2. Execution of a subdivision agreement to secure public and private improvements. 3. Jentink, City Clerk Motion by: Seconded by: Voted in favor: Voted against: Member absent: CITY OF ROSEMOUNT DAKOTA COUNTY, MINNESOTA RESOLUTION 2000- A RESOLUTION APPROVING THE AMENDMENT TO THE PLANNED UNIT DEVELOPMENT AGREEMENT WITH CHIPPENDALE 42 PARTNERSHIP ON OUTLOT B, McNAMARA ADDITION TO SECURE IMPROVEMENTS BY KTJ LIMITED PARTNERSHIP (Cub Foods) WHEREAS, the Planning Department of the City of Rosemount received an application for approval of an amendment to the Planned Unit Development Agreement with Chippendale 42 Partnership; and WHEREAS, the Planning Commission of the City of Rosemount conducted a public hearing on August 8, 2000, as required by the zoning ordinance and PUD Agreement for the purpose of receiving testimony regarding the requested amendment; and WHEREAS, on August 8, 2000, the Planning Commission adopted a motion to recommend approval of the amendment to the Planned Unit Development Agreement with Chippendale 42 Partnership with conditions; and, WHEREAS, on August 15, 2000, the City Council of the City of Rosemount reviewed the recommendation forwarded by the Planning Commission; NOW, THEREFORE, BE IT RESOLVED, the City Council of the City of Rosemount hereby approves the amendment to the Planned Unit Development Agreement with Chippendale 42 Partnership on Outlot B, McNamara Addition to secure improvements by KTJ Limited Partnership, subject to: 1. Execution of an amendment to the PUD Agreement. 2. Revision of Grading, Parking and Utility plans as necessary in accordance with recommendations by the Consulting Engineer. 3. Additional landscaping for screening along 151 Street West to buffer the loading docks. 4. Installation of sidewalks along Crestone Avenue and provide pedestrian links to all of the buildings. 5. Provision of "Acorn" lights along Crestone Avenue and reducing the height of the light standards to 30 feet and that lighting intensity and color shall be consistent with existing General Commercial development. 6. Compliance with all applicable building and fire codes. 7. Modification to traffic flow from Crestone Avenue and Claret Avenue by closing the driveway access to 151` Street, subject to approval by the Consulting Engineer and Fire Marshal. Resolution 2000 - 8. Requiring that any future expansions will require a public hearing. 9. Signage shall consist of two signs totaling 270 sq.ft., with the lighted sign at the corner of Crestone Avenue and 151" Street to be turned off at 11:30 p.m. 10. This past week, I conducted a survey in an effort to determine if cities in the metropolitan area restrict hours of delivery or operation for commercial businesses, specifically for CUB Foods. The results are listed below. BLAINE • Blaine does not limit or restrict delivery hours in their ordinance. • CUB Foods; No restrictions were placed on condition of approval to restrict delivery or operation. • Blaine does have requirements which restrict hours of refuse pick -up. BLOOMINGTON • Bloomington does regulate where delivery docks are located on commercial buildings but not hours of delivery or operation, in general • Bloomington's planner is researching the CUB files to see if any restrictions were added as a condition of approval. They will be in contact on Monday, August 14, 2000. CRYSTAL • In general, Crystal does not regulate hours of delivery or operation. Itwould have to be done as a condition of site plan approval or a conditional use permit. • Crystal does regulate hours of refuse pick up (not before 6 am). They stated that they usually have voluntary compliance from businesses. They even had a commercial business agree not to have deliveries come before 6am, however there are no actual requirements for this. • Regarding CUB Foods: The planner stated that there is intensive screening, i.e. berm, fence, & plantings on south side to screen single family residence. The planner also said that restriction of delivery may have been discussed but the site was so well buffered it did not present itself as an issue. EDINA Edina does not address deliveries in their ordinance and have not added restrictions of deliveries as conditions of approval for any businesses. • Edina ordinance does restrict hours of refuse collection. Refuse cannot be collected within 250 feet of a residential area between 1 Opm and 7am. PLYMOUTH • One of Plymouth's latest PUD's (Rainbow Foods) limited the use of loading docks through its noise ordinance. No use from IOpm to lam. • The noise ordinance restricts levels of noise and hours of the day when it is prohibited per zoning districts. SAVAGE • Savage does not have CUB Foods. • They also do not limit hours of delivery or operation for commercial businesses. SHAKOPEE • Shakopee's Ordinance does not specify restrictions of delivery or operation in general. It may restrict hours for restaurants or liquor stores, business that have a liquor license. • Concerning CUB Foods. Shakopee did not require as a condition of approval, restrictions for delivery or operation. This has been an issue and has been discussed with planning commission because neighboring residence have complained about the hours of delivery. The planner stated that usually, CUB representatives have worked with the delivery individuals to.insure deliveries do not take place too early in the morning. WOODBURY • Woodbury does not regulate hours of operation. • They do regulate delivery loading and unloading through their ordinance. The Off- street loading and unloading Section of the ordinance states that if noise is audible to surrounding residential areas it must be terminated, between 7pm and lam. Memorandum INTRODUCTION A traffic impact study was completed for the McNamara Addition (Chippendale -42 Partners) PUD located south of CSAH 42 between Shannon Parkway and Chippendale Avenue in May of 1996. At that time, the traffic impact study was based on a development concept including retail, office and residential uses within the PUD. The traffic impact study completed in May of 1996 included assumptions with respect to traffic generations and conducted an analysis of the impacts traffic had on the adjacent roadway systems. The results of this study included both short- term (2001) and long -term (2016) recommended improvements to the roadway system to accommodate the expected traffic growth. As requested, in light of recent development proposals, (i.e. Oppedam proposal for Block 2 and the retail development proposed for Block 1) we have reviewed the assumptions and analysis outlined in the 1996 traffic study to determine its validity and to draw any additional conclusions and/or recommendations with respect to these proposed developments. The following sections of this memorandum outline the study review conclusions and recommendations. TRAFFIC STUDYREVIEW Traffic Generation Comparison Table 1 in 1996 traffic study outlined a variety of land use assumptions for the PUD area. These land use assumptions were based on the concept plan provided by Chippendale -42 Partners. The traffic generation was based on the Institute of Transportation Engineers (ITE) Traffic Generation Manual.- Currently, two development proposals are being considered by the City for this the area. The first is the addition of a liquor store, a fast food restaurant and future retail space in Block 1 Minneapolis St. Cloud Infrastructure Engineers Planners F.I "HM "5- 181 M03M-rA wpd EQUAL OPPORTUMTY EMPLOYER Mr. Rick Pearson, City Planner City of Rosemount August 3, 2000 Page 2 adjacent to the existing Walgreen's and daycare center. The second proposal is for a Cub foods and an additional 20,000 square feet of associated retail space located on Block 2 of the PUD. In addition, a Goodyear Service Station has been approved and is currently under construction in Block 4. Based on the current proposal, including all ofthe revised building sizes, a comparison was made to the 1996 study with respect to the amount of daily traffic being generated by the overall PUD. The attached table shows a trip comparison between the 1996 study and 2000 proposal. The primary change in land use occurred in Blocks 1 and 2. Block 1 increased in total generation and Block 2 decreased in total generation. The traffic generation based on the 2000 proposal increases the total site - generated traffic by approximately 1,400 trips from the PUD. This represents about a 5.8% increase in trips from the area. A general rule of thumb in estimating traffic generation is that the actual traffic generated from a proposed site can be plus or minus 10% of the estimated traffic. Therefore, this additional 5.8% is well within the tolerance of additional traffic. Tra c Impact Analysis The traffic impact study provided an analysis for two build years. The first year of 2001 assumed that the PUD would be 100% developed. The short-teen recommendations were based on this assumption. The 2016 year included additional traffic growth from adjacent areas which would impact the roadway system. The long -term (2016) improvement recommendations were based on this year. The additional 1,400 trips per day translates into approximately 120 trips during the PM peak hour. Distributing 120 trips over the site roadway system would have an insignificant impact on the roadways and intersection operations. Therefore, no additional analysis was conducted based on this minor change in the PUD land uses. May. 1996 Recommendations The May, 1996 traffic study included several recommendations for short-term (2001) and long -term (2016) improvements. Each of these improvements is discussed below: Short -Term (2001): 1. Provide for roadway improvements as outlined in the developer's proposal. These improvements as outlined in the 1996 proposal, have all been made. 2. Construct a median on Chippendale Avenue which eliminates a left turn from the service roadlbank entrance to the northbound Chippendale Avenue and the left turn from northbound Chippendale Avenue to the service roa&bank entrance: This improvement has not yet been completed, however, an agreement has been made with the affected uses in the F. This improvement is currently listed in the City's Capital Improvement Program for the year 2001 or 2002. 3. Develop right -turn lanes on CSAH 42 at Chippendale Avenue for both eastbound and westbound traffic: The eastbound right -turn lane has been completed. However, the westbound left -turn lane has not yet been constructed. This issue should be addressed with Dakota County. 4. Revise the signal timing at CSAH 42 and Chippendale to provide for protected left -turn phasing for Chippendale Avenue: This improvement would be made in conjunction with Dakota County when the median is installed on Chippendale Avenue (Recommendation No. 2). Long -Term (2016 1. Provide a dual left -turn lane for northbound Chippendale Avenue to westbound CSAH 42: As traffic dictates along Chippendale Avenue, this improvement should be considered. The improvement will require a roadway widening and major traffic signal revisions. This improvement would ndwe coordination with Dakota County. 2. Develop protected left turn phasing for CSAH 42 at Shannon Parkway: This improvement should be considered as traffic on Shannon Parkway increases. This would be a project that would require coordination with Dakota County. 3. Monitor traffic volumes on CSAH 42, Chippendale Avenue, Shannon Parkway, and 151' Street: This recommendation should be and is being implemented in this area. The review of this traffic study and its assumption is an example of this recommendation. This should continue to occur as additional development to the area south of 151` Street in this area occurs. CONCLUSIONS /RECOMMENDATIONS Conclusions Based on the review of the May 1996 traffic impact study, the following conclusions can be made: • The traffic generation assumptions found in the traffic study are still valid with the current proposals. Even though, the land use types have changed from the original proposal, the total traffic generation from the PUD has an insignificant increase. In fact, the original proposal assumed that the site would be 100% developed by the year 2001, which has not occurred. • The recommendations as outlined in the 1996 traffic study are still valid and should continue to be implemented. Some of these improvements have already been implemented and provisions for implementing the others are in place. Recommendations Based on the review of the traffic study and the conclusions as stated above, it is recommended that no additional improvements be required as a result of the change in land use associated with the proposed development and PUD. nm F.IWPW MIW5- 181"V3W -rAwpr Chippendale 42 Partners PUD Traffic Generation an Public Hearing: KTJ Limited Partnership (Cub Foods ) PUD Amendment and Final Plat (Continued from 7- 25 -00) This matter was before the Planning Commission on July 25, 2000 for a public hearing. The public hearing was continued for further discussion. Mr. Pearson highlighted changes to the site plan. The Cub building has been reduced from 80,000 sq.ft. to 68,018 sq.ft. An 8 foot masonry wall is included along the southern edge. There. is an increased proportion of brick on the smaller retail buildings. The signs have been reduced from 300 sq.ft. to two signs totaling 270 sq.ft. The sign at 151 St. will be turned off at 11:30 p.m. Outdoor pedestrian furnishings for eating and resting are added, along with increased plantings. The developer agreed to installation of sidewalks and additional acorn lights. Mr. Pearson displayed pictures of existing Cub stores. Approximately 50 % of the Cub stores are located adjacent to or across from residential neighborhoods. Mr. Pearson illustrated commercial areas in the city and reviewed land use east of Highway 3, explaining why that area is not available for this type of commercial development. The Cub proposal meets city standards and is consistent with the planned development for the area. After working with the developer for the Shenanigans development to the west, the developer for Cub shifted the driveway on Creston further north to align with Shenanigans driveway. Discussions continued concerning the amount of brick, hours of operation, and architectural standards. Mr.. Pearson explained there is 47 % brick overall. Hours of operation are limited by the PUD only for those businesses fronting Shannon Parkway. Commissioner Napper responded that the amount of brick is not the issue and that the audience is not interested in such discussions. He feels the reduction in size to 68,000 sq.ft. is not enough and that it will still knock out local businesses. Chairperson Droste opened the floor to the applicant. Paul Tucci of Oppidan was present and reviewed the changes made to the site plan. He indicated a willingness to work with the city on the two exceptions to the PUD, namely, signage and brick enhancements. Chuck Rickart Engineer with WSB & Associates, prepared the initial traffic study in 1996 and reviewed the results with present day plans. In 1996, traffic generation was 24,000 trips per day. Based upon the present development plans, Mr. Rickart estimates traffic generation at 25,600 trips per day. This is considered an insignificant change. The recommendations in the 1996 study assumed 100% development by 2001. Recommended improvements are well in excess of what Cub needs. There are significant access roads to disburse traffic. Mr. Rickart reviewed the traffic patterns for the Cub and Shenanigans parcels. Chairperson Droste opened the floor to the public. Monika Oeltjen doesn't feel that Cub fits in and residents do not want it in their back yards. She brought pictures of Cub stores in Apple Valley and Shakopee, along with the wall behind Wal Mart. She does not like the "Low Price Leader" sign displayed in the front of Cub. She thought there would be soft retail at this location. Tom McCarty, 14037 Dartmouth Path, noted that if Rosemount limited businesses to just one, there would be just one pharmacy, one auto parts store, etc. Price shopping is difficult when you have to travel out of the area. Ray Connelly, Connelly Realty, 12904 Nicollet Avenue, Burnsville, addressed concerns with devaluation of property as a result of Cub. He met with the Scott County Assessor to discuss the effect on land values as a result of the Cub store in Shakopee and Rainbow store in Savage. Scott County showed an increase of 6 -8% in housing value. A study performed by Dakota County on townhouses surrounding the Cub store in Eagan showed a rise in valuation of 8% per year, compared to Eagan's overall rate of 9.2 %. John Mills. 15130 Crestview Circle, raised issues with property values, indicating a 15- 20 %o property loss could be expected as a result of Cub. It was his understanding that the site was to be developed as a strip mall with specialty shops and restaurants. He has concerns with 151 Street bearing a great deal of the traffic. He wants to see the plan changed to keep the traffic flow off 151 St. He also expressed concerns with ponding and asked who would be responsible if their homes flood. Mr. Pearson addressed concerns with infrastructure and ponding.- Mr. Rickart added that 151 St. was constructed as a reliever to traffic on CSAH 42. Bernie Strohsu£ is concerned with traffic and inquired about the number of trucks estimated per day and the route they will follow. Mr. Tucci responded to Mr. Strohsuf's questions, indicating that approximately 20 trucks could be expected each day. He summarized the anticipated routes. Mr. Strohsuf wants to see access to 151 St. closed. Bill Day, 14955 Crestview Ave., has concerns with traffic congestion on. 42 and traffic injuries. He is opposed to the big box retail. Karen Danay 14655 Cimarron Ave., expressed support for the Cub store and explained it will provide job opportunities. She finds the local businesses are limited and prices are much higher. She would rather not have to go to other towns for shopping. Steve Kobel, 12757 Danbury Path, also offered support for the Cub store. He felt that if the store meets the PUD requirements it should be allowed to move forward. He further indicated that competition is good and a free enterprise system will help keep prices down. Cub will provide a good tax base and will fit well into the growing community. Steve Casey, 15455 Danville Ave., referred to the PUD and architectural design standards. He does not believe the Cub proposal meets the requirements of sensitivity to the surrounding neighborhood and achievement of a neighborhood center, look and feel. He is opposed to the 24 hours of operation and larger signs. He also asked that the hours for deliveries be limited as he found in Shakopee and Bloomington. He wants a retail development closer to the concept plan. Kellev McGivern, 15173 Claret Ave., does not feel the PUD requirements have been met. He believes a new traffic study must be done. He is concerned with noise and light pollution. Mr. McGivern provided photographs of surrounding retail developments. MOTION by Droste to close the public hearing. Seconded by Weisensel. Ayes: Weisensel, Napper, and Droste. Nays: 0. Motion carried. Commissioner Napper addressed concerns with truck traffic flow and suggested eliminating the corner greenspace on 151 St. to allow traffic off Crestone Ave. and take traffic off 151 st St. He feels that additional downsizing would have less impact on existing businesses. Chairperson Droste inquired about greenspace and clarified that outside storage of garbage is not allowed. He prefers two 270' signs rather than three signs. He suggested that any recommendations concerning traffic flow be subject to appropriate engineering approvals. He also recommended that the 50% brick requirement be met. Commissioner Weisensel liked the buffering in the back. He also prefers two signs and the time restriction for sign lighting in the southwest corner. He clarified for residents that by closing the driveway access to 151 St. and eliminating the comer greenspace on 151 to allow access off Crestone Ave., buffering in that area would be significantly reduced. Discussions continued concerning future expansion and the threshold for a public hearing. Commissioners requested that any amount of expansion require a public hearing. MOTION by Droste to recommend that the City Council approve the PUD Amendment for KTJ Limited Partnership on Outlot B, McNamara Addition subject to: 1) Execution of an amendment to the PUD Agreement; 2) Revision of Grading, Parking and Utility plans as necessary in accordance with recommendations by the Consulting Engineer; 3) Additional landscaping for screening along 151 st Street West to buffer the loading docks; 4) Installation of sidewalks along Crestone Avenue and provide pedestrian links to all of the buildings; 5) Provision of "Acorn" lights along Crestone Avenue and reducing the height of the light standards to 30 feet and that lighting intensity and color shall be consistent with existing General Commercial development; 6) Compliance with all applicable building and fire codes; 7) Modification to traffic flow from Crestone Avenue and Claret Avenue by closing the driveway access to 151 Street, subject to approval by the Consulting Engineer and Fire Marshal; 8) Requiring that any fixture expansions will require a public hearing; 9) Signage shall consist of two signs totaling 270 sq.ft., with the lighted sign at the comer of Crestone Avenue and 151 Street to be turned off at 11:30 p.m.; 10) Compliance with the 50 %brick requirement. Public Hearing: KTJ Limited Partnership (Cub Foods) PUD Amendment and Final Plat Chairperson Droste opened the public hearing on the PUD Amendment and Final Plat for Cub Foods. The recording secretary has placed the Affidavit of Publication and Affidavit of Mailing and Posting of a Public Hearing Notice on file with the City. Mr. Pearson presented an overview of the Cub Foods project. This development is located between Creston and Claret Avenues, south of CSAH 42 and north of 151 St. The development proposal consists of an 80,000 sq.ft Cub Foods store, 13,000 sq.ft. attached retail bays, and a separate 7,000 sq.ft. retail building. An amendment to the PUD is necessary because of the proposal to have less than the required 50% brick and for a modification of the sign expectations. Three 100 sq.ft signs are Permitted, but the developer is proposing two 150 sq.ft. signs. Mr. Pearson reviewed access to the site, parking, and traffic circulation. Parking requirements have been met, however, staff has requested the parking stalls located in front of the retail area attached to the Cub facility be eliminated. Building elevations were reviewed, together with the landscaping and lighting plans. A 6 -7 foot berm plus landscaping is provided for screening along 151 St. The store is 60 feet from the property line, 175 feet to the south edge of the 151 St. right -of -way, and 200 feet to the nearest building. Staff recommends additional sidewalks along Creston Avenue. The developer has agreed to lower the light poles to 30 feet. Commissioners reviewed the sign designs. A monument -style sign is proposed in the southwest corner of the site on 151 St. Chairperson Droste opened the floor to the applicant. Paul Tucci of Oppidan was present. Mr. Tucci indicated the developer has revised its plans to incorporate staff recommendations. Additional sidewalks and connections have been included. Mr. Tucci summarized plans for landscaping, berming, elevations, and signage. Canvas awnings are planned on the retail bays. Chairperson Droste opened the public hearing. Planning Commission Regular Meeting Minutes July 25, 2000 Page 3 Richard Barnes, 3586 149 St. W., stated his preference for a restaurant on the site. He is concerned about this location for the Cub store and feels it should be located further east. Residents were led to believe there would be smaller businesses at this site. He raised issues related to increased traffic, storage of waste products, and 24 -hour lighted signs. Kelly McGivem 15173 Claret Avenue, pointed out there is a Cub store located only 4 miles away. He feels the city is moving too fast on this application. Mr. McGivem referenced a Petition signed by residents, which shows a majority of residents are . opposed to the Cub store. He prefers to see a unique business at this site which would compliment existing businesses. He feels a store like Cub belongs in an Industrial setting. He pointed out that previous traffic studies pertained to a 40,000 sq.ft. building. Those studies must be redone because of the 80,000 sq.ft. size of Cub. He raised concerns about traffic, lighting, water runoff, home values, the 24 hours of operation, and noise from air conditioners, compressors, and trucks. Brian Howard, 3748 Upper 149 St. W., requested screening for residents on the north side of Co. Rd. 42. He inquired about lighting and the estimated traffic flow off Claret Avenue. Craig Schalliol, 3669154 St. W., built in Rosemount for the small city atmosphere. He supports the local businesses and believes the big 7/24 stores should be in a larger city. He feels that a large store like Cub would result in increased traffic, noise pollution, and crime. He suggested that night deliveries not be allowed and that the park be relocated. Steve Casey, 15455 Danville Ave., presented a Petition generated by the Rosemount Residents for Responsible Development. He asked whether the speed limited on CSAH 42 will be reduced. Chairperson Droste entered into record a letter, dated July 25, 2000, from Mr. & Mrs. Greg Zippel, and a letter from Paul Wright. Michael Palmer, 2682 Upper 138 St. W., is the owner of Pizza Man. Mr. Palmer is concerned about additional competition, including the Cub deli and possibly another pizza retailer in the strip mall, which may put him out of business. A substantial increase in traffic would delay delivery service. He is also concerned about large open spaces if businesses are forced to close. He believes the Cub store is too close to residential. Monika Oeltien, 1 5772 Cicerone Court, indicated the traffic generation report is not based on an 80,000 sq.ft. business. She questioned whether it is accurate. Ms. Oeltjen inquired about delivery truck traffic. Mr. Tucci summarized the anticipated Cub truck deliveries. In addition to the Cub deliveries, numerous outside vendors would deliver items. Ms. Oelt en asked where the support is for the three residential areas surrounding this site. She requested that a new traffic study be performed. Planning Commission Regular Meeting Minutes July 25, 2000 Page 4 Mr. Pearson explained the traffic study took into account over 200,000 sq.ft. of commercial space. The county reviewed access to CSAH 42 and approved the plans. Recommendations of the traffic study have been implemented. The consulting engineer is reviewing the traffic plan and will give recommendations to the City Council In response to concerns about garbage storage, Mr. Tucci indicated a compactor is located at the rear side and is loaded from the inside of the building. Mr. Pearson added that city ordinance does not allow the storage of garbage outside, and the city will ensure that garbage collection containers are enclosed. Discussions continued concerning parking lot elevations along CSAH 42 Thomas Gelich_ 15176 December Trail, felt the building is too large in proportion to the lot. Mr. Pearson responded that the building meets the greenspace, parking, and setback requirements. Mr. Pearson showed where the ponding is located and indicated the consulting engineer is looking at stormwater drainage and utility design. Margaret Capra, 4091 152 Ct. W., noted that the Apple Valley Cub has become run down over the years. She feels the Cub store will be an eyesore on CSAH 42. She indicated this small -town charming community is inviting huge, corporate America to dump on its neighborhoods. Jim EngelhM 15461 Darling Path, believes the city shouldn't rush into -this until all issues have been addressed. His concerns relate to the residential neighborhood, park, drainage, traffic, and location. Lola Mills, 15130 Crestview Circle, feels the Cub store will be an eyesore. She has concerns regarding traffic, noise, crime, pollution, truck deliveries, reduction in property values, and its effect on existing businesses. Brian Howard, explained that the concerns he raised earlier about car lights affecting the north side residents pertained to cars exiting on Claret Avenue. Bernie Strohsu£ raised concerns about truck traffic, garbage, and idling diesel trucks. He suggested 6:00 a.m. — 9:00 p.m. delivery times. He inquired about the route trucks will follow and indicated that Cub should pay for semaphores to be installed at certain intersections. Jeff Fadden- _ 12231 Biscayne Ave., inquired if a marketing study was performed and if the population is sufficient to support a Cub store at this location. B. Breach of the terms of this Agreement by the Developer, or any successor or interest, shall be grounds for denial of building permits. C. If any portion, section, subsection, sentence, clause, paragraph or phrase of this Agreement is for any reason held invalid, such decision shall not affect the validity of the remaining portion of this Agreement- D. If building permits are issued prior to the completion and acceptance of public improvements, the Developer assumes all liability and costs resulting.in delays in completion of public improvements and damage to public improvements caused by the City, Developer, its contractors, subcontractors, materialmen, employees, agents, or third parties. E. The action or inaction of the City shall not constitute a waiver or amendment to the provisions of this Agreement. The City's failure to promptly take legal action to enforce this Agreement shall not be a waiver or release. F. This Agreement shall run with the land and bind the Developer and aall future owners of land within the Plat, and shall be recorded by the Developer against the title to the property. After the Developer has completed the work required of it under this Agreement, at the Developer's request, the City will execute and deliver to the Developer an appropriate partial release from this Agreement. G. Each right, power, or remedy herein conferred upon the City or the Developer, respectively, as the case may be, is cumulative and in addition to every other right, power, or remedy, express or implied, now or hereafter arising, available to the City or the Developer, at law or in equity, or under any other Agreement, and each and every right, power, and remedy herein set forth or otherwise so existing may be exercised from time to time as often and in such order as may be deemed expedient by the City or the Developer and shall not be a waiver of the right to exercise at any time thereafter any other right, power, or remedy. H. The Developer may not assign this Agreement without the written permission of the City Council except that the Developer may assign this agreement and the obligations under it to any subsequent owner or successor of any part of the plat. I. Required notices to the Developer shall be in writing, and shall be either hand - delivered to the Developer, its employees or agents, or mailed to the Developer by registered mail at the following address: Chippendale 42 Partnership, 15055 Chippendale Avenue South, Box Chippendale/42 Parmenhip Page 10 of 12 easements. The rights -of -way to be dedicated shall include Shannon Parkway, CSAH 42, 151st Street, Claret Avenue, Creston Avenue, Cimmaron Avenue and Chippendale Avenue. The easements to be dedicated include the O'L,eary's Hills pond (in the southwest corner of the site). The final plat should also include any other easements necessary for public improvements required to serve the WalgreensI site. B. Proposed Streets. 151st Street will be built at the Developer's expense from Shannon Parkway to the east to a point just east of the Walgreens and daycare center site's driveway with the public improvements necessary for the Walgreens site. It is anticipated that the first townhome area to develop will be the southwest comer of the site. When that is constructed, 151st Street will be constructed from its terminus easterly to just east of Claret Avenue (the south leg) and Claret Avenue will be constructed to the south to connect to the existing roadway. When the easterly townhome area develops, 151st Street will be required to be constructed to Chippendale Avenue. Any trails or sidewalks are to be constructed with the streets. Any commercial development will require the construction of adjacent streets and connections to CSAH 42 and 151st Street. If 151st Street is not yet constructed, it will be constructed simultaneously. Turn lanes on CSAH 42 will be constructed concurrently with the construction of Creston, Claret and Cimmaron Avenues, including all trails and/or sidewalks and appurtenant work necessary for the elimination of the ditch on the south side of CSAH 42, and also including the turn lanes and elimination of the center median on CSAH 42. The names of all public streets will be reviewed and assigned by the City. All public and private streets will be constructed at the Developer's expense. C. Agreement and Amendments. 1. Major changes to the Concept Plan and/or the above- stated criteria will be reviewed by the Planning Commission with approval by the City Council as PUD amendments, including such items as the public street locations, building location changes beyond 60 *feet, building size changes of twenty percent (20 %) or more, a reduction of total green space, ponding and park configurations, and housing density. 2. The Developer is responsible for disclosure and must provide a copy of this Agreement to all purchasers of lots or buildings within the Mixed Use Planned Unit Development: V. Administrative Provisions A. The Developer represents to the City that to the best of its knowledge, the Plat complies with all City, county, metropolitan, state and federal laws and regulations, zoning ordinances, and environmental regulations. If the City determines that the Plat does not Chippendale/42 Partnership Page 9 of 12 1 Claret Avenue south of 151st Street, 60 -feet wide right -of -way, 32 -feet wide street. 2. 151st Street, 80 -feet wide right -of -way, 40 -feet wide street. 3. Private street width to be determined at time of site plan review. F. Setbacks, Lot Dimensions, Height, Lot Coverage and Density. 1. Minimum setbacks: a.. 30 feet from 151st Street, Shannon Parkway and Chippendale Avenue for all structures. b. 30 feet from Claret Avenue for all structures. C. Setbacks for structures from private streets shall be determined at time of site plan review. 2. Height shall be limited to 35 feet for all structures. 3. Maximum gross density. = 6.0 dwelling units per acre, based on the total land area of Outlot E and Outlot F, McNamara Addition, minus any future commercial lot area within Outlot F. G. Permitted Uses. Uses permitted in the residential areas shall be those identified in zoning district R-2, Single Family Attached, Section 6.7 of Ordinance B. H. Public Park. The proposed public park, as identified in the Concept Plan, shall be platted and graded on or before the platting and grading has been completed for townhome residential development either west or east of Claret Avenue, whichever occurs first. IV. Conditions for Overall Planners Unit Develop t� A. Final Platting. The first final plat shall include the complete PUD area showing all public streets, utility easements, and the remaining properties shown as oudots. The area to be final platted with the PUD will include the Walgreens lot, the 'daycare lot (immediately south of the Walgreens lot) and the Rosemount National Bank lot plus all right -of -way and utility ChippeoWe/42 Partnership Page 3 of 12 42 to 151st Street. Private internal streets shall follow a lighting plan for the PUD as approved by the City. All lighting will be installed at the Developer's expense. III. Residential Planned Use Development: All residential development shall meet the following performance standards. Where a specific standard is not addressed herein, the land use regulation applicable to the R -2 zone of the City Code shall apply. A. Vehicle Access. 1. One future north -south public Street (Claret Avenue) and one future east -west public Street (151st Street) shall be and constructed at the Developer's expense to serve this residential development. All other residential streets may be private. 2. All additional future private street accesses to the two (2) public streets shall be designed and approved as part of further site plan reviews in accordance with the Concept Plan, including alignments with public streets where feasible. 3. Claret Avenue shall maintain a minimum 250 feet spacing from centerline to centerline along 151st Street. B. Pedestrian Access. Sidewalks (5 -feet concrete) shall be installed at the Developer's expense along the east side of Claret Avenue, the south side of 151st Street, and along one side of the main private streets within the residential areas. The City may require the construction of a bituminous path (8 -feet) at the Developer's expense from the public park path to Chippendale Avenue. C. Parking. Parking shall meet the corresponding parking standards as identified in Section 8 of the Zoning Code to be reviewed at the time of site plan review. D. Landscaping. Street and project landscaping shall meet the minimum standards as prepared by Damon Farber Associates dated June 18, 1996. However, future residential projects will be reviewed in more detail under the site plan review process. E. Street Design. Street rights -of -way and curb -to -curb widths shall be based on the following standards: Chippendale/42 Partnership Pate 7 of 12 Uses permitted shall be those identified in zoning district C -4, General Commercial, Section 6.13 of Ordinance B; provided that no auto - oriented sales/service establishments or outdoor display of merchandise shall be permitted west of Crestone Avenue. Hours of operations shall be limited to 6:00 a.m. to 10:00 p.m. for businesses operating in the commercial lots adjacent to Shannon Parkway. Amendments to the C-4 zoning district regulations within two (2) years of this Agreement shall not apply to this Plat. J. Public Utilities. 1. Storm Drainage: The Walgreens site will require catch basins and appropriate piping from 151st Street to its parking lot. From that point the area will drain to the O'Leary's Hills pond south of this site. The Rosemount National Bank site (the most northeasterly lot in the Plat) will be temporarily allowed to drain to the wetland to the west with appropriate easements submitted and will be required to connect to storm drain in the 151st Street when that is constructed. A drainage easement from CSAH 42 to the detention pond in the southwest comer of the Plat shall be vacated once public storm water utilities are constructed to replace said easement. All storm water detention ponds shall be constructed according to a schedule to be determined by the City Public Works Director, and all storm drainage improvements shall be constructed at the Developer's expense. The designated wetland shall be evaluated for replacement according to a completed WCA Wetland Replacement Form. 2. Sanitary Sewer:. The sanitary sewer to serve the Walgreens site will be as on the revised plan from Engineer Jim Johnson of Bolton & Menk dated June 18, 1996, a copy of which is on file with the Rosemount Public Works This sanitary sewer will be constructed at the Developer's expense and will provide service to all properties west of the proposed Crestone Avenue and to the southwest townhome development area (the area south of 151st Street and west of Claret Avenue extended). This area will eventually flow to the Empire Treatment Plant. The remainder of this site described as east of Creston Avenue and east of the south leg of Claret Avenue will be provided sanitary service at the Developer's expense to flow to the Rosemount Treatment Plant. 3. Watermain: A 12 -inch watermain shall by contructed in the 151st Street alignment from Shannon Parkway to Chippendale Avenue. The City will participate in one- half (1/2) of the cost of oversizing it from an 8 -inch to a 12 -inch line. An additional 12 -inch watermain shall be constructed from 151st Street north to the proposed Walgreens along the north -south private drive, then east to Cimmaron Avenue and south to 151st Street. All required watermains will be constructed at the Developer's expense with the exception of oversizing as identified. 4. Lighting:. All public streets will include typical lighting required by the City except where the NSP decorative lighting ( "acorn" style) previously chosen by the City will be required on both sides of Claret, Crestone and Cimmaron Avenues from CSAH Chippendale/42 Partnership Page 6 of 12 C. Creston Avenue and Cimmaron Avenue, 66 -feet wide right -of -way, 36 -feet wide street. d. 151st Street, 80 -feet wide right -of -way, 40 -feet wide street. e. A minimum four (4) feet screen with ninety percent (90 %) opacity year round shall be provided along Shannon Parkway north of 151st Street and along CSAH 42 by using a combination of landscaping and berming; berming slopes shall not exceed a 3:1 ratio. Exceptions to this screen may be permitted for certain features, including but not limited to, site triangles, sidewalks and drainage. 2. All waste containment areas shall be fully screened with a wall material the same as the commercial building. A solid gate shall also be used for access to the waste area. Landscaping should enhance the screening measures at appropriate locations. F. Architecture, Lighting and Signage. Individual project architecture shall meet the guidelines as identified in the Architectural Guidelines by CNH Architects dated June 7, 1996, a copy of which is on file with the Rosemount Community Development Director, with the exception that lap siding is not permitted. Fifty percent (50 %) of the unglazed portion of each facade shall be faced with brick. Lighting and signage plans shall be approved for each project after considering coiresponding plans for the Plat. G. Street Des*gn. 1. Streets rights -of -way and curb -to -curb widths shall be based on the standards as follows: a. Claret Avenue, north of 151st Street, 80 -feet wide right -of -way, 24 -feet wide street each way, or as approved by Dakota County, with center landscaped median (16 -feet wide), no parking both sides. b. Consideration of parking requirement reductions will be made by the City based on provisions for shared parking among multiple tenants and/or other related factors that impact parking demand, with reciprocal enhancements made to green space above minimum requirements. 2. Landscaping. 1, Street and project landscaping shall meet the minimum standards as prepared by Damon Farber Associates dated June 18, 1996, a copy of which is on file with the Rosemount Community Development Director. In addition, the conditions are incorporated: a. A minimum of twenty -five percent (25 %) of the total commercial PUD area shall be landscaped. Variations for lesser amounts may be permitted for individual site development, provided that adequate assurances are provided that at least 25 % of the total commercial PUD area will be landscaped. b. Parking lot landscaped islands shall be a minim width of eight (8) feet, except that islands along the main internal east -west street shall be a minimum width of twelve (12) feet. C. A minimum of fifty percent (50 %) of the lineal foot total of all building perimeters shall be landscaped with a minim Meet wide planting area. The following is a summary the prominent facts of the site: • Total Site Area of 9.67 acres or 421,184 square feet. • Total building area of 100,000 square feet. • Total green area of 23.12 %. • Grocery Operation of 80,000 square feet - • Additional Retail of 20,000 square feet. - The site is currently part of a Planned Unit Development (PUD)-which was set in place to accommodate retail users in the city. The original PUD had anticipate a combination of smaller retail users and larger "big box' users throughout the site. The uses anticipated - included service _ retail, grocery, liquor, restaurants, auto users (no dealerships) and other ancillary uses. The PUD also indicated proposed areas for the users and building sizes and locations. In fact, street improvements have been made in accordance with recommendations of the traffic study prepared by WSB Consultants. The development meets all of the standards foe Commercial Development and the PUD requirements except for the amount of brick and the proposed sign substitution. Therefore, staff recommends: A motion to recommend that the City Council approve the PUD Amendment for KTI Limited Partnership on Outlot B, McNamara Addition subject to: 1. Execution of an amendment to the PUD Agreement. 2. Revision of Grading, Parking and Utility plans as necessary in accordance with recommendations by the City Engineer. - 3. The elevations facing Crestone Avenue to the west have close to or more than the required amount of brick. It seems appropriate to encourage as close as possible the required amount of brick on the exterior walls of the block. The Developer feels that the southerly elevation will be thoroughly screened with bemiing and landscaping, so the brick is not justified. LANDSCAPING The plan is consistent with the PUD requirement for 125% of the minimum landscaping requirements. Plantings ring the site, but with visible gaps at the comers along CSAH 42 for visibility. The intent is to partially screen the views from the north side of CS_M 42, but allow glimpses of the site to traffic along '42. The 151` Street setback yard is heavily landscaped to screen the loading docks from the residential development to the south. Staff has suggested that more landscaping be provided to fill gaps in the screening of the loading docks. SIDEWALKS Sidewalks were installed along CSAH 42, Claret and 151` Street. The Developer has agreed to install a sidewalk along Crestone Avenue and pedestrian connections into the site from the outer sidewalks. LIGHTING AND OTHER ISSUES Light standards were originally proposed at 40 ft. heights. The Developer has agreed to lower the fixtures to 30 feet. Cub will be open 24 hours, but the night traffic is expected to be quite light (that is when the shelves are stocked). There have been many questions regarding traffic. The original PUD included a traffic study by WSB, the Cities' consulting engineer (see attached). Most of the recommended improvements have already been made. The PUD anticipated an additional (approximate) 160,000 sq. ft. of commercial/retail space beyond the Walgreens', Kindercare and Goodyear developments. This is the "big box" anticipated by the Chippendale 42 Partnership Planned Unit Development. The PUD amendment is requires because the proposal requests relief from the 50% brick requirement. In addition, two 150 sq. ft. monument signs are proposed in trade for three 100 sq. ft. pylon signs that would otherwise be permitted. ACCESS, CIRCULATION & PARKING Primary customer access occurs at Crestone and Claret Avenue, connecting across the middle of the site in front of the main building. 473 parking spaces are located on the north side of the Cub and associated retail building relative to these access points. No additional access is proposed at CSAH 42. A second connection to Crestone Avenue allows access to the 31 parking spaces behind the 13,000 sq. ft. retail shops west of Cub. This area will be primarily for employees. Lastly, an access from 151' Street West will be intended for semi -truck traffic for the five loading docks. An exit for the loading docks occurs at Claret Avenue, which also includes the entrance for drive -up window for the pharmacy. In total, there are 504 parking spaces provided which is sufficient to meet ordinance parking requirements for shopping centers. Staff does have a concern about the 17 spaces in front of the retail shops. A potential conflict occurs with cars backing into a primary traffic lane. It may be possible to redistribute the spaces among the stalls to the north and south of the building. BUILDING CHARACTERISTICS Both buildings have a base course of rock faced concrete block in the first two feet from ground level. Then, brick alternating with glass up to a height of ten feet. A two foot wide accent band of glazed block provides "trim" above the brick. The remaining elevations above the twelve foot height are EFIS (stucco appearance) for the wall sign areas. The west and south walls of the Cub building are treated with rock - faced concrete block with accent bands. Smaller retail units would not generate as much traffic. He requested a new traffic study based on Cub's presence. Jean Prichard, 3868 Upper 149 St. W., felt the concerns of the residents living north of CSAH 42 have not been sufficiently addressed and that their property values will decrease. She wants to maintain the small town atmosphere. She indicated that Cub is not - taking the risk, but the small town community. Michael Palmer inquired about traffic flow and road improvements. I vas told of the intent 1br a new Cub Fools in the area next to my new home, Of course this was of great concem to my husband and 1, as vve just mo%ed from the tow tares (on Cedar Avenue) directly accross from Cub Foods. One of our biggest reasons for relocating mes to escape the traffic, noise and over-all hustle and bustle of this location. While I'm sure that some people fleel that this verture wnuld benefit the City of Rosemount, I personally feel that it is a mistake. Although we have only recently heard this news we have several concerns we hope you will bring before the city planners prior to any final decision. My wife Cathi and I moved to Rosemount from Iowa in November of 1997. We chose to r move to the Twin Cities as the result of a wonderful job opportunity. We chose to live in Rosemount for its quality of life. In other words we prefer small to medium sized communities with peace, quiet and small businesses whose owners know their customers and value their business. We have enjoyed living in Rosemount. We frequent local businesses such as Evergreen Gardens, Video Update, Subway, Loch Pharmacy, Big Daddy's Diner, McDivot's, TOPS Pizza, Knowlan's and Walgreen's. Our neighborhood is quiet and we have a lovely view of the newly redone pond in our backyard as the result of Wensman's development near Walgreen's. We must admit we do not shop at Cub primarily because of its overwhelming size and lack of what we call a "shopper friendly" environment. Having a Cub closer to us will not cause us to shop there. We find it absurd that Cub wants to locate only a few minutes away from an existing store. Cub's choice to locate in Rosemount is not my primary concern. Our concern lies with the location of the store in a residential area. furthermore Cub will be one of the first things a newcomer will see when entering Rosemount from the West. We would hardly call the sight of a Cub Foods a warm welcome. We would much rather see a group of small specialty shops and restaurants in a small clustered environment than the overwhelming presence of Cub Foods. Although we live a couple of blocks away we have concerns traffic will increase as heavier traffic flows cause people to take alternate routes which ultimately will cause traffic flow to increase on our street. Truck traffic will also impact the area with 24/7 service to Cub to say nothing of the increased risk to children in the area. New development this past year created a park on 151 Street less than a block from the proposed Cub location. In addition Kindercare is less than a block. We can think of no other Cub Foods in the South Metro area with this set of circumstances. We encourage the City of Rosemount to take steps to attract new business to locate in Rosemount. While we do not object to Cub Foods coming to Rosemount we do object to the proposed location. It seems more logical for them to locate East of Highway 3, South of County 42. Obviously there are other considerations as well. We will admit there are positive aspects to a Cub in Rosemount, most notably their ability to draw larger numbers of people which could increase customer traffic for some Rosemount business'. However Knowlan's, Dakota Floral, Video Update, Walgreen's and Loch Pharmacy stand to lose a great deal. To risk the loss of these small businesses is not prudent in our opinion. Rather the City should encourage business' which compliment existing business and add to the quality of life Rosemount offers. Rosemount, even with its growth, offered the qualities which we sought and hoped to enjoy for many years to come. We fear that the very qualities that we searched for our family in which to grow and for which the city states to strive are being threatened by the proposed construction of a Cub Foods. Such a proposal seems to contradict the city's mission as stated on its web site's home page: "...while maintaining its unique historical background and continuing to enhance its small town character through neighborhoods, parks, downtown, schools and community activities." Furthermore, it concerns us that the city's policies regarding highway /mixed use areas will be disregarded particularly with respect to safety and compatible land use between retail and neighborhood areas. Within a block of the proposed Cub Food site, a wonderful park was recently bunt. Many families and especially children frequent the park. The resulting increase in traffic due to such a large store will create safety concerns for those who walk and rice bikes to and from the'park and will increase the amount of traffic noise. Also, the transition from retail to neighborhood will be extreme. What kind of "landscaping, buffering and screening" will be done to make the land uses compatible between the park and neighborhood with such a large retail structure? To us, the compatibility along with maintaining the historical context of the city would be done better with smaller businesses and stores that enhance and even replicate the downtown area. Cub Foods would never pass to be a neighborhood grocery store as seen in the old days. The Cedar and County Road 42 retail area in Apple Valley is more than convenient for Rosemount residents in need of warehouse type businesses. As appealing as some of the tax potential may be with a Cub Foods, please consider the impact on the neighboring blocks and the city's heritage. Please keep Rosemount different from the sprawling warehouse shopping so common in the suburbs. Please maintain the quaintness of Rosemount which our family sought and which a Cub Foods would diminish. We appreciate your consideration and representation of our concerns. The new City park, the ponds, the walling paths, (all perfect) I asked the builder at that ti me if they new what would be built across the street an the %acant property. They said they believed it would be a strip mall and that there would probably be a fence to separate this area from us. I had no problem with a strip mall of shops. Typically strip malls close at 9 :00 P.M. or so. Progress is good in moderation and when it considers the citizens first.. I have recently heard of the plan to consider a Cub Foods between Creston and Clark. This bothers me in'that the traffic and noise will be twenty four hours a day and our beautiful neighborhood will be imeded. I am not sire if 1 would hays built my home where it is had I known that Cub would be across the street. I doubt that I would have. My other great concern is for the tra children that play at the wonderful new park across the street. The ffic and a Kill put those children at risk. We shop at Cub foods people P g every week and know traffic aid that this kind of a business brings. Please protect the commirtity from this happening. We built our house in 1993, when our backyard was bordered by a cornfield. lam concerned about the n ew Cub Foods that is proposed for the location on Claret. I live behind the proposed Cub on 152nd Street West. I am concerned about the added traffic and noise of a business that is open 24 hours a day. l have heard several reasons v fur we should welcome a Cub Foods in Rosemount: Convenience: A guy went to get ice cream for his kids. It was 9:30 at right and Knowians was clQsed. He had to ddve all the way to Apple Valley. Wall, Apple Valley is only 4 miles. They also seem to sell ice cream at the Dairy Queen, Holiday, SA, KWk Trip, etc. Revenue: With a large businesslike this one coming here, we will attract other businesses and will grow. That is probably rxrt true, Krrowlans will either go out of business and the building there will be abarxToned or Cub will realize that they aren't making the money they should and will abandon their building. Either way the town suffers. Remember, Super Value and Kno fans, combined were too much for Rosemount and one of them went out of business. Wouldn't we just be killing another business that has served us so well? The building won't be as large as proposed. I know of several people that live in Eagan and Burnsville that don't go to their Cub in town and opt to drive several miles to shop the Apple Valley store because of the larger building and more selections. Flow can this store thrive with another one so close, not to mention larger than the proposed one? We are going to see about having the Cub only open until midnight. Well it sounds like the planning commission already okayed this to be a 24 hour /day store. Will we be able to ever open our Wndaws at right in the summer? The tmffip won't be any worse than it already is. I would think there would be some kind of a bottle neck with people slowing to tun into and out of the store. VMI1 there also be an additional stop light added? There will be a lovely buffer between the store and the homes. Is this the same buffer that was put around IQndercare mid Wdgreens? This really needs to be discussed before the okay is ever given. There is a park within a few feet of the land proposed, there are people that would fake to keep a quiet neighborhood. This buffer should not only be rice looking, but a buffer that actually blocks the view of the store to our homes to reduce the sound and lights of the store and traffic, such as a large fence. Two years ago we had to go through this same thing when we found out that there would be hundreds of townhouses put behind us. As an added bonus to our neighborhood, we were promised a rice park where our children could play. That at the ti me sounded rice but as of today, almost all the gp, . The next thing we know a Walmart will S-8: built. Why can't this' Cub Food store be built in the Industrial park area and keep it out of site of all the residential owners.
