The area being platted is located between Diamond Path and Shannon Parkway, on either side of Evermoor Parkway, the primary east -west street. This process involves checking the lots against the PUD requirements to ensure conformance with the preliminary plat as approved. A public hearing is not required. The plat includes lots for two different housing types. 43 larger lots in the Estate housing area labeled Upplands in the PUD. 56 lots are located east of Birger Pond, on either side of Evermoor Parkway distributed between the Westmeath and Drumcliffe neighborhoods. In addition to the lots, street rights -of -way, easements and outlots are included in the plat. The outlots are either for drainage & ponding, parks or future development depending on the locations. The lots have been checked to ensure that they meet the dimensional requirements of the PUD and the zoning ordinance as applicable. This means that the lots are wide and deep enough to be to accommodate the anticipated housing and meet the setback requirements, particularly on corner lots. Of the 99 lots included with the Evermoor plat, only one was found that could benefit from plat revisions. Lot 2, Block 8 (on page 5 of 7) is a corner lot that is large but almost square. It measures 127' x 120' at the setback lines. This is slightly less than the 130' to 190' depth range specified in the PUD Agreement. Fortunately, the adjacent lots are large enough to contribute additional width to solve the problem. There are several other instances of smaller lots that may appear to have problems, but in all cases, they have sufficient width and/or depth to be consistent with the standards. PLANNING COMMISSION REVIEW The Planning Commissioners were most concerned about the final plat's consistency with the PUD. Upon receiving reassurances to that effect, the Commissioners adopted the staff recommendation. RECOMMENDED ACTION: Motion to adopt a resolution approving the final plat for Evermoor. CITY COUNCIL ACTION: CITY OF ROSEMOUNT DAKOTA COUNTY, MINNESOTA RESOLUTION 2000- A RESOLUTION APPROVING THE FINAL PLAT FOR EVERMOOR WHEREAS, the Community Development Department of the City of Rosemount received an application for final plat approval submitted by Contractor Property Developers Company, as required by ordinance for the purpose of a commercial development on land legally described as: That part of the Northwest Quarter and the Northeast Quarter, Section 19, Township 115, Range 19, Dakota County, Minnesota and that part of Government Lot 1 and Government Lot 2, Section 24, Township 115, Range 20, Dakota County, Minnesota, described as follows: Beginning at the northwest corner of said Northwest Quarter; WHEREAS, the Planning Commission of the City of Rosemount reviewed the final plat application for Evermoor their regular meeting on September 12, 2000; and, WHEREAS, the Planning Commission adopted a motion to recommend approval of the final plat to the City Council as required by the Subdivision Ordinance, subject to conditions; and, WHEREAS, the City Council of the City of Rosemount reviewed the final plat application as required by the Subdivision Ordinance on September 19, 2000. NOW, THEREFORE, BE IT RESOLVED, the City Council of the City of Rosemount hereby approves the final plat for Evermoor subject to: 1. Execution of a subdivision agreement to secure public infrastructure including parks, streets and utilities. 2. Incorporation into the plat of recommendations of the Engineering/Public Works Department and the Consulting Engineer regarding drainage, easements, grading, public & private streets and utilities. 3. Modification of the plat to provide additional lot depth to one side of Lot 2, Block 8. RESOLUTION 2000- ADOPTED this 19` day of September, 2000, by the City Council of the City of Rosemount. ATTACHMENTS: Revised Draft Resolutions APPROVED BY: SUMMARY The City Attorney has recommended that three additional recommended conditions of approval be included with the resolutions approving the final plats for the Evermoor first phase development. The focus of the additional conditions is to ensure that the PUD Agreement is recorded so that it will be in effect after the properties are sold, and that the restrictive covenants required of, the PUD will be enforced by the Homeowner's Association(s). The additional recommended conditions are: 1. An amendment to the PUD Agreement to reflect recently approved changes to the Planned Unit Development. 2. Recording of the PUD Agreement. 3. Execution and recording of neighborhood Homeowner's Association covenants to assure compliance with the Planned Unit Development. RECOMMENDED ACTION: Motion to adopt the amended resolutions for the approval of Evermoor, Evermoor 2" Addition and Evermoor 3' Addition Final Plats. CITY COUNCIL ACTION: CITY OF ROSEMOUNT DAKOTA COUNTY, MINNESOTA RESOLUTION 2000- A RESOLUTION APPROVING THE FINAL PLAT FOR EVERMOOR 3rd ADDITION WHEREAS, the Community Development Department of the City of Rosemount received an application for final plat approval submitted by Contractor Property Developers Company, as required by ordinance for the purpose of a commercial development on land legally described as: Outlot D and Outlot F, EVERMOOR, according to the recorded plat thereof, Dakota County, Minnesota. WHEREAS, the Planning Commission of the City of Rosemount reviewed the final plat application for Evermoor 3rd Addition at their regular meeting on September 12, 2000; and, WHEREAS, the Planning Commission adopted a motion to recommend approval of the final plat to the City Council as required by the Subdivision Ordinance, subject to conditions; and, WHEREAS, the City Council of the City of Rosemount reviewed the final plat application as required by the Subdivision Ordinance on September 19, 2000. NOW, THEREFORE, BE IT RESOLVED, the City Council of the City of Rosemount hereby approves the final plat for Evermoor subject to: 1. Execution of a subdivision agreement to secure public infrastructure including parks, streets and utilities. 2. Incorporation into the plat of recommendations of the Engineering/Public Works Department and the Consulting Engineer regarding drainage, easements, grading, public & private streets and utilities. 3. Modification of the plat to provide additional lot depth to one side of Lot 2, Block 8. Resolution 2000 4. Amendment to the Planned Unit Development Agreement to reflect recently approved changes to the Planned Unit Development Agreement. 5. Recording of the Planned Unit Development Agreement. 6. Execution and recording of neighborhood homeowners association covenants to assure compliance with the Planned Unit Development Agreement.
