Property Owner(s): Carlson Tractor & Equipment Co. Area in Acres: 8.39 total which includes the Outlot for Wachter Lake Number of Lots /units: 38 Overall Density: 6 units per acre Comp. Guide Plan Desig: Business Park Current Zoning: BP -3 Required Zoning: BP -4 Planning Comm. Action: Recommendation of approval with conditions (4 -0) SUMMARY Mr. Von Bische of Heritage Development has provided a revised plan that incorporates some of the Planing Commission recommendations. In particular, the east side of the development has been modified by consolidating units to create needed additional space for common parking. To accomplish this, four twin buildings have been revised into five and three unit buildings. In addition, a landscaping plan has been prepared that combines evergreen and shade trees on the berm proposed for the southern edge of the movie theater property. However, in return for the use of the theater's space, Marcus Theaters wants a sign on Chippendale Avenue to enhance their visibility. Council should discuss this trade -off as a possible addition or amendment to the PUD process. There are two unresolved issues in which the developer does not intend to conform to the recommendations: 1. The fence /wall along the northern edge of the driveway is proposed to be a cedar board -on -board fence instead of the masonry (or wrought iron) fence /wall recommended by the Planning Commission. The ordinance requires a 3.5 to 6 foot high fence or wall of 90% opacity to screen residential uses from parking lots. While masonry is not specifically required, staff would still recommend that over a wooden fence. 2. The developer does not wish to install a sidewalk along the private street within the development. Lastly, staff has added conditions to the resolution to ensure that the landscaping on the berm is maintained and that cross - access easements and joint maintenance agreements for the common driveway be recorded. RECOMMENDED ACTION: Motion to adopt a resolution approving the PUD final development plan and preliminary plat for Carrousel Plaza Townhomes. CITY COUNCIL ACTION: CITY OF ROSEMOUNT DAKOTA COUNTY, MINNESOTA RESOLUTION 2000- A RESOLUTION APPROVING THE PLANNED UNIT DEVELOPMENT (FINAL DEVELOPMENT PLAN) AND PRELIMINARY PLAT FOR CARROUSEL PLAZA TOWNHOMES WHEREAS, the Community Development Department of the City of Rosemount received an application from Heritage Development of Minnesota, Inc. for approval of the Planned Unit Development (Final Development Plan) and Preliminary Plat for Carrousel Plaza Townhomes; and WHEREAS, on August 8, 2000, the Planning Commission of the City of Rosemount reviewed the Planned Unit Development (Final Development Plan) and Preliminary Plat for Carrousel Plaza Townhomes and recommended approval, subject to conditions; and WHEREAS, on September 19, 2000, the City Council of the City of Rosemount reviewed the Planned Unit Development (Final Development Plan) and Preliminary Plat for Carrousel Plaza Townhomes. NOW, THEREFORE, BE IT RESOLVED, the City Council of the City of Rosemount hereby approves the Planned Unit Development (Final Development Plan) and Preliminary Plat for Carrousel Plaza Townhomes, subject to: 1. Execution of a PUD or Subdivision Agreement as needed to secure public and private improvements. 2. Conformance with the requirements of Section 4.18. and 8.3 of the zoning ordinance and the conditions of Resolution 2000 -51. 3. Conformance with architectural detail of townhomes as shown on the architectural design and elevation plans submitted to the City, drawn by Johnson, Sheldon & Sorensen on August 20, 1996, to ensure they are built as proposed. 4. Installation of a sidewalk or trail along Chippendale Avenue and on the proposed private street. 5. Rezone to BP -4, Business Park. 6. Plan revisions including: a) Modification to the plan to eliminate the deck encroachment onto the southern utility easement; b) Landscape enhancements as necessary to provide sufficient screening along Chippendale Avenue, and along the northern property line to screen the townhomes and the movie theater; c) Adjustments to the plan to provide the sufficient number of common parking stalls and properly sized garage spaces. Installation of a masonry or similar type or wrought iron fence for screening. 8. An agreement between the developer and movie theater property owner shall be recorded to ensure maintenance and replacement (as needed) for the landscaping proposed for the movie theater property. Public Hearing: Heritage Development PUD Fin De velopment Plan and Preliminary Plat for Carrousel Plaza South Chairperson Droste opened the public hearing on the application by Heritage Development for the PUD Final Development Plan and Preliminary Plat for Carrousel Plaza South. The recording secretary has placed the Affidavit of Publication and Affidavit of Mailing and Posting of a Public Hearing Notice on file with the City. Ms. Hoium provided details on the 38 -unit townhome development located east of Chippendale Avenue, south of the movie theater. Access to the development is by an extended cul -de -sac entering from a private driveway shared with the theater. Staff recommends modifications to the plans to include ad d i tional ous idewalks along hippendale Ave. and between the theater and townhomes, bituminous Ave. connecting to the sidewalks along Claret Springs East, sidewalks along the interior private street, and a berm along the northern property line. Additionally, modifications are required to eliminate deck encroachments in the drainage utility easement and to increase garage sizes and the number of parking stalls to meet city standards. Ms. Hoium indicated a 100% opaque wall or fence is the desired screening between the townhomes and theater. The developer must secure any required easement for the berm along the northern property line. Chairperson Droste opened the floor to the Applicant. Tom Von Bishe of Heritage Development indicated he is willing to make all modifications as requested by staff. He is not in favor of sidewalks along the interior private street. He will work with the theater regarding the berm. Chairperson Droste opened the public hearing. There were no comments. MOTION by Droste to close the public hearing. Seconded by Weisensel. Ayes: Droste, Weisensel, and Napper. Nays: 0. Motion carried. Discussions continued concerning sidewalks along the interior private street. Commissioners also discussed screening, including additional screening for the townhome units along the driveway. Guide Plan Desig: Business Park Requested Land Use Desig: Multiple Family Current Zoning: BP -3 Requested Zoning: BP -4 (which allows attached or multiple housing via PUD) Tom Von Bische of Heritage Development is requesting a PUD final development plan approval for a 38 -unit townhouse development on Outlot A, Carrousel Plaza South. Mr. Von Bische is also requesting preliminary plat approval. In May of 2000, concept approval was granted. The property will have to be rezoned to BP -4, Business Park as a condition to the approval of the final plat to allow multiple family housing with a PUD. The development consists of an extended private cul -de -sac entering from a private driveway that also provides access to the movie theater via an easement. The housing units are row style townhouses ranging from doubles to 6 unit buildings. Staff's primary concerns are: Ensuring that the private driveways have appropriate shared access and maintenance agreements. Existing and proposed private streets that serve the development are constructed to city standards, which include curb & gutter. Ensuring that effective landscape screening is built between the theater and the new townhouses. Screening should consist of a fence, wall or hedge that is not less than six feet in height and one hundred percent (100 %) opaque. In addition adequate landscape screening is needed along Chippendale Avenue. Sidewalks, adequate pedestrian access should be constructed along Chippendale and possibly along the private drives. The proposed berm north of the development is located on the theater's property. The developer must determine the need for an easement. Staff recommends that the proposed berm be adequately landscaped. The deck on Lot 2 Block 5 extends into a drainage and utility easement. Modifications need to be made to eliminate this encroachment as specified in Section 7.2.C.d.2 of the zoning ordinance. A successful levy referendum is for learning and will restore class sizes and prevent more drastic cuts. It is NOT a bond referendum for buildings or stadiums. To balance the 2000 -01 general fund budget, our district was forced to cut the budget by $6 million resulting in larger class sizes, higher student fees and fewer cocurricular actvities. Our schools use resources wisely Our schools work hard to control costs. Records from the Department of Children, Families and Learning show that District 196 spends less money per student than any other district in the Lake Athletic Conference.
