SUMMARY
This request for a lot split is located next to Dakota Fence on 160 Street, and has previously been discussed as
a site for a contractor shop for Wensmann Builders. That and a subsequent deal fell through, but now, staff is
expecting that the lot split will facilitate a development for Interstate Batteries.
The lot will have access from 160'' Street, where there will be a frontage road to consolidate access. Additional
right -of -way has been acquired by the County as part of the County Road 46 project. The proposal is consistent
with BP -1 lot standards.
PLANNING COMMISSION RE`UW
The Planning Commission did not express any concerns, nor did any one other than the applicant appear for the
public hearing. Because this is not a plat, park dedication and G.I.S. fees will be collected subsequent to
Council approval. The other fees «-i11 be collected with the building permit.
RECOMMENDED ACTION:
Motion to adopt a resolution approving the lot division requested by R.C.D. Real Estate Partnership.

RESOLUTION 2000-
A RESOLUTION APPROVING
THE LOT DIVISION REQUESTED BY
RCD REAL ESTATE PARTNERSHIP
WHEREAS, the Planning Department of the City of Rosemount received an application for
approval of the division of property in the Agricultural District, said property legally described
as:
The South Half of the Southeast Quarter of Section 32, Township 115, Range 19,
Dakota County, Minnesota, lying east of the west 1645.05 feet; EXCEPT the south
327.84 feet of said South Half of the Southeast Quarter lying east of the west 1976.99
feet thereof. Containing 25.318 acres including road rights -of -way. Subject to all
easements of record.
WHEREAS, the Planning Commission of the City of Rosemount conducted a public hearing on
August 22, 2000, as required by the subdivision ordinance for the purpose of receiving testimony
regarding the requested Agricultural division; and,
WHEREAS, the Planning Commission adopted a motion to recommend approval of the
Agricultural division to the City Council with conditions; and,
WHEREAS, the City Council of the City of Rosemount reviewed the recommendation
forwarded by the Planning Commission on September 19, 2000.
NOW, THEREFORE, BE IT RESOLVED, the City Council of the City of Rosemount hereby
approves the division of the above referenced parcel resulting in the following described parcels:
Parcel A
The east 331.94 feet of the west 1976.99 feet of the south 656.14 feet of the South Half
of the Southeast Quarter of Section 32, Township 115, Range 19, Dakota County,
Minnesota. Containing 5.00 acres including road right -of -way. Subject to easements of
record.
Parcel B
The South Half of the Southeast Quarter of Section 32, Township 115, Range 19,
Dakota County, Minnesota lying east of the west 1645.05 feet; EXCEPT the south
327.84 feet of said South Half of the Southeast Quarter lying east of the west 1976.99
feet thereof, and also except the east 331.94 feet of the west 1976.99 feet of the south
656.14 feet of said South Half of the Southeast Quarter. Containing 20.318 acres
including road right -of -ways. Subject to all easements of record.
RESOLUTION 2000- 4
BE IT FURTHER RESOLVED, the approval of this Agricultural division is subject to:
1) Approval of the Dakota County Plat Commission;
2) Incorporation of recommendations relative to access /public streets, utilities and street
easement/right -of -way needs as identified by the City's Consulting Engineer;
3) Payment of required fees as specified by the current fee schedule including: a) Storm
Drainage Capital Charges; b) GIS fees; c) City WAC charges; d) Park Dedication;
4) Cross - access easements (if needed) with adjoining properties.
ADOPTED this 19"' day of September, 2000 by the City Council of the City of Rosemount.

Regular Meeting Minutes August 22, 2000
Pursuant to due call and notice thereof, the Regular Meeting of the Planning Commission
was du held on Tuesday, August 22, 2000. Chairperson Bill Droste c lied the meeting
to order at •40 p.m. with members Myron Napper, Kim Shoe -Co an, and Jeffery
Weisensel pres t. Also in attendance was City Planner Ric earson.

Meeting Minutes. Seconded by N r. Ayes: Napper, Droste, Shoe - Corrigan and
Weisensel. Nays: 0. Motion c ed.
Discussion
Chairperson Dros shared for discussion published ' es on a new Cub Foods store
and adjacent r it in Blaine, together with articles on affor ble housing in Eagan and
Lakeville. he focus of the articles is on the change in deman affordable housing.
Droste recessed the meeting at 6:55 p.m.
Public Hearing: RCD Real Estate Partnership — Lot Split
Chairperson Droste opened the public hearing on the application by RCD Real Estate
Partnership for a Lot Split. The recording secretary has placed the Affidavit of
Publication and Affidavit of Mailing and Posting of a Public Hearing Notice on file with
the City.
Mr. Pearson summarized the request by RCD Real Estate to split five acres from a 25-
acre parcel. It is anticipated that Interstate Battery will locate at this site. The 5 -acre
parcel is located on 160 St. next to Dakota Fence. The lot will have access from 160
St., and is on a frontage road with a cul -de -sac turnaround.
Chairperson Droste opened the floor to the applicant. David Fischer, Curt Fischer, and
Stan Palmer were present to answer questions.
Chairperson Droste opened the public hearing. There were no comments.
MOTION by Droste to close the public hearing. Seconded by Weisensel. Ayes:
Droste, Shoe - Corrigan, Weisensel, and Napper. Nays: 0. Motion carried.
MOTION by Weisensel to recommend that the City Council approve the lot split for
RCD Real Estate Partnership subject to: 1) Approval of the Dakota County Plat
Commission; 2) Incorporation of recommendations relative to access /public streets,
utilities and street easement/right -of -way needs as identified by the City's Consulting
Planning Commission

Engineer; 3) Payment of required fees as specified by the current fee schedule including:
a) Storm Drainage Capital Charges; b) GIS fees; c) City WAC charges; d) Park

by Droste. Ayes: Shoe - Corrigan, Weisensel, Napper, and Droste. Nays: 0. Motion
carried.
There being no further business to come before this Commission, upon MOTION by
Droste and upon unanimous decision, the meeting was adjourned at 7:07 p.m.
