V ATTACHMENTS: Draft Resolution, Final Plat Reductions APPROVED BY: j Applicant & Property Owner(s): Homer Tompkins of Contractor Property Developers Company Location: North West corner of Evermoor (Kelley Trust) development Number of Lots: 54 Classic (Heath Haven) Lots Planning Commission Action: Recommendation of Approval (4 -0) SU11NiARY This action will result in individual lots for building (and sale) of part of the first phase of Evermoor. The area being platted is located east of Shannon Parkway, on the north and east sides of Shannon Park Elementary School. There is much land that remains east of this area, which is phase II and will be platted in the future. This process involves checking the lots against the PUD requirements to ensure conformance with the preliminary plat as approved. A public hearing is not required. The plat includes lots generally intended for the "Classic Homes" style. There is much variation in the range of value and lot size, however. On the north side, lot sizes will tend to be larger and custom graded for the homes. East of the school, the lots are more typical of R -1 or Country Hills standards (all but three exceed R -1 lot area standards). In addition to the lots, street rights -of -way, easements and outlots are included in the plat. The outlots are either for drainage & ponding, parks or future development depending on the locations. The lots have been checked to ensure that they meet the dimensional requirements of the PUD and the zoning ordinance as applicable. This means that the lots are wide and deep enough to be to accommodate the anticipated housing and meet the setback requirements, particularly on corner lots. Lots 31 and 33, Block 4 have lot width deficiencies (page 4 of 5). Both measure 67 feet at the front yard setback lines compared to the range of 70'— 80' specified in the PUD. Fortunately, the lots on either side have width to spare, so that the deficiency can be eliminated. PLANNING COMMISSION REVIEW The Commissioners were primarily concerned about the distance between the new lots of the 2 nd Addition and the Rural Residential uses to the northeast, along 131 Street. The narrowest gap at the corner is at least 50 feet. In addition, the Commissioners were reminded that the PUD agreement specifies a thirty foot rear -yard setback for those lots. Upon hearing this, the Commissioners were satisfied. RECOMMENDED ACTION: Motion to adopt a resolution approving the final plat for Evermoor 2 nd Addition CITY COUNCIL ACTION: f CITY OF ROSEMOUNT DAKOTA COUNTY, MINNESOTA RESOLUTION 2000- A RESOLUTION APPROVING THE FINAL PLAT FOR EVERMOOR 2 nd ADDITION WHEREAS, the Community Development Department of the City of Rosemount received an application for final plat approval submitted by Contractor Property Developers Company, as required by ordinance for the purpose of a commercial development on land legally described as: That part of the Northeast Quarter and the Southeast Quarter of Section 19, Township 115, Range 19, Dakota County, Minnesota, described as follows: Beginning at the northeast corner of said Northeast Quarter; thence South 00 degrees 45 minutes 37 seconds East, assumed bearing along the east line of said Section 19, a distance of 2341.70 feet; thence South 81 degrees 08 minutes 58 seconds West, a distance of 507.02 feet; thence South 19 degrees 39 minutes 04 seconds West, a distance of 31.82 feet; thence southerly along a tangential curve, concave to the east having a radius of 280.00 feet and a central angle of 42 degrees 45 minutes 23 seconds for an arc distance of 208.95 feet; thence South 61 degrees 00 minutes 43 seconds West, not tangent to last described curve, a distance of 30.14 feet; thence southeasterly along a non - tangential curve, concave to northeast having a radius of 310.00 feet, and a central angle of 12 degrees 39 minutes 08 seconds, for an arc distance of 68.45 feet, the chord of said curve bears South 30 degrees 00 minutes 08 seconds East to a point of reverse curvature; thence along said reverse curve having a radius of 450.00 feet and a central angle of 55 degrees 57 minutes 42 seconds and an arc distance of 439.52 feet; thence South 19 degrees 38 minutes 00 seconds West, tangent to last described curve, a distance of 62.11 feet; V RESOLUTION 2000- WHEREAS, the Planning Commission of the City of Rosemount reviewed the final plat application for Evermoor 2 " Addition at their regular meeting on September 12, 2000; and, WHEREAS, the Planning Commission adopted a motion to recommend approval of the final plat to the City Council as required by the Subdivision Ordinance, subject to conditions; and, WHEREAS, the City Council of the City of Rosemount reviewed the final plat application as required by the Subdivision Ordinance on September 19, 2000. NOW, THEREFORE, BE IT RESOLVED, the City Council of the City of Rosemount hereby approves the final plat for Evermoor subject to: 1. Execution of a subdivision agreement to secure public infrastructure including parks, streets and utilities. 2. Incorporation into the plat of recommendations of the Engineering/Public Works Department and the Consulting Engineer regarding drainage, easements, grading, public & private streets and utilities. 3. Modification of the plat to provide additional lot azdth for Lots 31 and 33, Block 4. ADOPTED this 19" day of September, 2000, by the City Council of the City of Rosemount.
