The area being platted is located on the north side of Birger Pond in the form of two cul -de -sacs. This process involves checking the lots against the PUD requirements to ensure conformance with the preliminary plat as approved. A public hearing is not required. The plat includes lots intended for detached twnhomes. The Commissioners will recall that this area started out as upscale twinhomes called "Distinctive Townhomes". The PUD was recently amended to detach the units which will certainly still be "distinctive ". The builder is Charles Cudd who requested the amendment. There will be ten -foot gaps between all of the units as a minimum. In addition to the lots, street rights -of -way, easements and outlots are included in the plat. The outlots are either for drainage & ponding, parks or future development depending on the locations. The lots have been checked to ensure that they meet the dimensional requirements of the PUD and the zoning ordinance as applicable. This means that the lots are 'vkide and deep enough to be to accommodate the anticipated housing and meet the setback requirements, particularly on comer lots. No lots were found to be deficient. In addition, the Consulting Engineer's recommendations for easement expansions have been incorporated. The remaining critical issues with this plat are: 1. Ensure that the homes adjacent to Evermoor Parkway will conform to the minimum 30 ft. setback. 2. Driveways for access to Lots 1 and 2, Block 1 require cross - access easements with Lot 3, Block 1 to eliminate individual access to Evermoor Par" which functions as a collector street in this area. 3. The label for Block 2 on page 3 of 3 appears to be erroneously labeled "1 ". PLANNING COMMISSION REVIEW The Commissioners discussed the above - mentioned issues and concurred with the staff recommendation. RECOMMENDED ACTION: Motion to adopt a resolution approving the final plat for Evermoor P Addition. CITY COUNCIL ACTION: 4, CITY OF ROSEMOUNT DAKOTA COUNTY, MINNESOTA RESOLUTION 2000- A RESOLUTION APPROVING THE FINAL PLAT FOR EVERMOOR 3rd ADDITION WHEREAS, the Community Development Department of the City of Rosemount received an application for final plat approval submitted by Contractor Property Developers Company, as required by ordinance for the purpose of a commercial development on land legally described as: Outlot D and Outlot F, EVERMOOR, according to the recorded plat thereof, Dakota County, Minnesota. WHEREAS, the Planning Commission of the City of Rosemount reviewed the final plat application for Evermoor 3rd Addition at their regular meeting on September 12, 2000; and, WHEREAS, the Planning Commission adopted a motion to recommend approval of the final plat to the City Council as required by the Subdivision Ordinance, subject to conditions; and, WHEREAS, the City Council of the City of Rosemount reviewed the final plat application as required by the Subdivision Ordinance on September 19, 2000. NOW, THEREFORE, BE IT RESOLVED, the City Council of the City of Rosemount hereby approves the final plat for Evermoor subject to: 1. Execution of a subdivision agreement to secure public infrastructure including parks, streets and utilities. 2. Incorporation into the plat of recommendations of the Engineering/Public Works Department and the Consulting Engineer regarding drainage, easements, grading, public & private streets and utilities. 3. Recording of cross - access easements for access to Lots 1 and 2, Block 1 with Lot 3, Block 1. 4. Change "1" to "2" for Block 2 on page 3 of 3.
