Current Zoning: R -1, Low Density Residential Planning Commission Action: Recommendation of approval with modification based upon updated information (4 -0) SUM INLARY Mr. Tompkins is requesting a Conditional Use Permit (CUP) for a small 450 sq. ft. building east of Shannon Parkway to function as a service center for telephone, internet and potentially, video service. It is essentially a fiber- optics hub where sa"llite antennas will receive signals that will be distributed throughout the development. This structure will be treated much like the well house on Shannon Parkway, intended to blend in with the surrounding residential uses. An administrative plat is also needed, to create a lot for the structure as well as a remnant outlot. BUILDI! G AND SITE ISSUES The building site will be located on a 10,735 sq. ft. lot that is intended to be similar to residential lots within the Custom Classic neighborhood of the Evermoor Development. A driveway will connect to Evermoor Parkway, across from the entrance to the cul -de -sac immediately north of Shannon Park Elementary School. The building will consist primarily of E.I.F.S. -%dth cultured stone columns. The roof will be gabled and have asphalt shingles. Landscaping associated as a back -drop to the monument sign located on the corner will almost obscure the building. This landscaping is dominated by 17 Black Hills Spruce which are intended to form a line connecting the monument sign to the oak grove on the east side of Shantton Parkway. Staff recommended that the building be constructed of 100% brick or equivalent. PLAN NL -ViG COMMISSION PUBLIC HEARING On November 28 and December 12, 2000, the Planning Commission conducted the required public hearings for the CUP and the plat. No one attended or commented other than the applicant. Craig Rapp explained the materials for the proposed structure, indicating a combination of cultured stone and the E.I.F.S. material would be consistent with the entry monuments. The Planning Commission agreed that the correlation of the building materials with the monument was acceptable. RECO`IMENDED ACTION: Motion to adopt a resolution approving the CUP for the essential service building. —and - Motion to adopt a resolution approving the Administrative plat for Evermoor Fifth Addition. I CITY COUNCIL ACTION: _ I CITY OF ROSEMOUNT DAKOTA COUNTY, MINNESOTA RESOLUTION 2000- A RESOLUTION APPROVING THE CONDITIONAL USE PERMIT FOR CONTRACTOR PROPERTY DEVELOPERS COMPANY WHEREAS, the Community Development Department of the City of Rosemount received an application for a Conditional Use Permit for Contractor Property Developers Company to allow an essential services building at the northeast corner of Shannon Parkway and Evermoor Parkway in Rosemount, Minnesota; and WHEREAS, the Planning Commission of the City of Rosemount conducted a public hearing on December 12, 2000, as required by the subdivision ordinance for the purpose of receiving testimony regarding the requested Conditional Use Permit; and WHEREAS, the Planning Commission adopted a motion to recommend approval of the Conditional Use Permit for Contractor Property Developers Company; and, WHEREAS, on December 19, 2000, the City Council of the City of Rosemount reviewed the recommendation forwarded by the Planning Commission; NOW, THEREFORE, BE IT RESOLVED, the City Council of the City of Rosemount hereby approves the Conditional Use Permit for Contractor Property Developers Company to allow an essential services building at the northeast corner of Shannon Parkway and Evermoor Parkway, subject to providing a minimum of 2' of cultured stone around the base of the building along the southern elevation and wrapping around the corners. NOW, THEREFORE, BE IT RESOLVED, the City Council of the City of Rosemount hereby approves the Administrative Plat for Evermoor 5`h Addition, subject to execution and recording of restrictive covenants as needed to secure perpetual maintenance of the facility and landscaping. The fiberoptic infrastructure will provide the backbone of a state -of- the -art communication system. It is our intent to enable telephone, internet, and potentially video to be distributed across the system. The building will provide a central point for collecting the signals from each of the services. Within the building will be electronic equipment that i% ill convert the signals and send them over the fiberoptic lines to each home. The building will be constructed to fit into the surrounding neighborhood. It will be composed of materials similar to the land office, the adjacent monument sign, and will fit seemlessly with nearby homes. While we anticipate providing video services, 'tie have not yet secured local approval for that service. We do, however, need this facility to provide the basic services of telephone and internet on a timely basis to our new residents. It is our intention to proceed with this project regardless of the outcome of our video service proposal. Sincerely, Cr J-Rapp Vice President 12.7: CONDITIONAL USE PERMITS (CUP): A. Purpose: The purpose of conditional use permits is to allow for those uses which are not generally suitable within the zoning district, but which under some circumstances may be suitable. The applicant fora CUP shall have the burden of proof that the use is suitable and that the standards set forth in this subdivision have been met. B. Application, Public Hearing, Notice and Procedure: The application, public hearing, notice and procedure requirements for CUPs shall be the same as those for amendments to the Zoning Ordinance, as identified in Section 16.2 of this Ordinance. CUPs may be granted only by a 4/5 vote of the entire Council. Specific submissions required to complete an application for a CUP shall address all standards applicable to the proposed use. The applicant shall provide information as required in the site plan review. C. Standards: The Commission shall recommend a CUP and the Council may issue such CUP if it finds that such use at the proposed location: 1. Will not be detrimental to or endanger the public health, safety, or general welfare of the neighborhood or the city. 2. Will be harmonious with the objectives of the Comprehensive Plan and city code provisions. 3. Will be designed, constructed, operated and maintained so as to be compatible or similar in an architectural and landscape appearance with the existing or intended character of the general vicinity and will not change the essential character of that area, nor substantially diminish or impair property values within the neighborhood. 4. Will be served adequately by existing (or those proposed in the project) essential public facilities and services, including streets, police and fire protection, drainage, structures, refuse disposal, water and sewer systems and schools. 5. Will not involve uses, activities, processes, material equipment and conditions of operation that will be hazardous or detrimental to any persons, property, or the general welfare because of excessive production of traffic, noise, smoke, fumes, glare or odor. City of Rosemount Page 207 6. Will have vehicular ingress and egress to the property which does not create traffic congestion or interfere with traffic on surrounding public streets. 7. Will not result in the destruction, loss or damage of a natural, scenic, or historic feature of major importance and will comply with all local, state, and. federal environmental quality standards. 8. These standards apply in addition to specific conditions as may be applied throughout this code. D. Conditions: In reviewing applications for CUPS, the Commission and the Council may attach whatever reasonable conditions they deem necessary to mitigate anticipated adverse impacts associated with these uses, to protect the value of other property within the district, and to achieve the goals and objectives of the Comprehensive Plan and City Code provisions. Such conditions may include, but are not limited to, the following: 1. Controlling the number, area, bulk, height, density, intensity, and location of such uses. 2. Regulating ingress and egress to the property and the proposed structures thereon with particular reference to vehicle and pedestrian safety and convenience, traffic flow and control, and access in case of fire or other catastrophe. 3. Regulating off -street parking and loading areas where required. 4. Specifying utilities with reference to location availability and compatibility. 5. Requiring berming, fencing, screening, landscaping or other facilities to protect nearby property. 6. Ensuring compatibility of appearance. In determining such conditions, special consideration shall be given to protecting immediately adjacent properties from objectionable views, noise, traffic and other negative characteristics associated with such uses. E. Revocation: Failure to comply with any condition set forth in a CUP, or any other violation of City Code provisions, shall also constitute sufficient cause for the termination of the CUP by the Council following a public hearing. City of Rosemount Page 208 F. Expiration: In any case where a conditional use has not been established within one (1) year of the date on which the CUP was granted, the permit shall be null and void. If the conditional use is discontinued for six (6) months, the CUP shall be null and void. G. Permittee: A CUP shall be issued for a particular use and not for a particular person. 12.8: INTERIM I USE PERMITS (IUP): A. Application, Public Hearing, Notice and Procedu : The application, public hearing, public notice and proc ure equirements for interim use permits shall be the ame as those for endments as provided in Section 16 of this dinance, except tha epermit shall be issued on the affirms ve vote of a majority of the ntire Council. Specific submissions equired to complete an applica n for an interim use permit shal be specified for each type of int use allowed. B. Termination: IUP shall termin a on the happening of any of the following ev ts, whichever t occurs: 1. The date state in the p rmit. 2. Upon violation of condition under which the permit was issued. 3. Upon change ' the City's oning regulation which renders the use none orming. C. Standards: 1. The in ' use must be allowed in th zoning district wher the property is located. 2. Th interim use must meet or exceed the pe rmance s dards set forth in this Ordinance and other plicable ity ordinances. 3. The interim use must comply with the specific stan ds for he use identified in this Ordinance, and must comply with City of Rosemount Page 209
