Attached for City Council consideration and adoption is a resolution adopting city fees and rates for
2000. Memorandums are provided from department directors explaining their reasons for
amending certain fees and rates.
The resolution references Appendix I, which is general city fees, and Appendix II, which are Parks
and Recreation/Community Center fees.
Liquor — The Minnesota Department of Public Safety requested cities to implement penalties for
failure of Alcohol Compliance Checks to enforce underage drinking laws. We suggest that a $1,000
fine be issued to any Rosemount liquor establishment failing this compliance test. The Rosemount
Police Department has received funding through the Alcohol & Gambling Enforcement Division.
As part of this funding City Council is expected to impose a substantial civil penalty and report
what action was taken. We do not recommend revoking or suspending the liquor license with this
penalty at this time.
Parks & Rec. — The fees and regulations for using outdoor facilities (an additional four pages at the
end of the report) has been added to Appendix II.
Page numbering, spelling corrections, and indexing were also updated.

Mineral Extraction Permits
The City requires that excavation contractors post a surety bond to guarantee that restoration and
re- vegetation are accomplished once mining is complete. The amount of the bond currently
required by the City is $3,000 per acre. Two years ago, when the City was renewing the
Johnson/Shafer permit, staff recommended that this amount be increased to $5,000 an acre. This
was acceptable to Shafer and staff has been recommending this amount for all permits since that
time. The $5,000 per acre amount is probably minimal for re- seeding, and is intended to cover re-
grading and spreading black dirt as well. Staff recommends the proposed increase.
2020 Comprehensive Guide Plan
Actual cost of printing copies of this guide plan has increased to $37.98. We recommend
increasing the fee to cover expenses.

SUBJECT: 2001 Proposed Fees for Public Works and Engineering
Attached are the proposed changes and fees for 2001 for Public Works and Engineering. The
following is a summary of the changes in these fees.
1. The Water, Sanitary Sewer and Storm Water Utility and Capital Charges have all changed
per the recommendation of the Utility Commission. The User Fees will be in effect for
the next four years and the Capital Charges will be increased per the Rate Study.
2. The Metro SAC Charge went up $50.00 to a new total of $1,150 per SAC unit.
3. In the assessment area, the construction cost index showed a 2.6 % increase for the last
year. The assessments for reconstruction projects were increased 2.6 %.
For undeveloped property, the proposed street and utility increases were determined by
actual bid prices for those units averaged over the previous two years as constructed by
the City.
4. Half section maps were increased to be consistent with Dakota County.
5. Right -Of -Way and Utility easement vacation application fee was started to help defer
costs of research, plan review, published hearing notices, legal costs and recording costs
associated with this action.
6. The City SAC and WAC charges for developments with final plat approval prior to Jan.
2000, increased 3% as per the Rate Study.
7. The City SAC charges for newly developed properties that haven't paid trunk area
assessments, increased 10% as per the Rate Study.

SUBJECT: Proposed 2001 Fees and Fee Policy
Attached is a copy of the proposed 2001 fees and fee policy changes for the Parks and
Recreation Department. Listed below are the explanations for the proposed changes for each area
of the Parks and Recreation Department.
Parks Facilities - The last increase was made to park fees in 1995. Since that time we have seen
the cost of operating the parks increase. Staff recommends some minor increases to the fees to
help cover operating costs.
Community Center - In 1999, staff proposed increases to the rental rates at the Community
Center. One item overlooked last year was the increase to the full dad- rental of the gym. The
proposed 2001 fees reflect staffs' recommendation.
Arena — Staff does not recommend any changes to the fees currently being charged in the arena.
However, staff does recommend not publishing dates on the Arena fee policy, but rather list what
months ice is sold at prime and non -prime rates versus summer ice rates.
Parks Dedication Fees The parks dedication fees for residential were last increased in 1991
and the commercial and industrial rates have not seen an increase in over 10 years. The reasons
for the increases are due to the rising land values and the increasing costs of developing parks.
The Parks and Recreation Committee has reviewed the proposed changes and felt they were
acceptable.

3. RESERVATION PROCEDURES:
PRIOR TO THE DAY OF THE EVENT/PICNIC
1. Call the Rosemount Parks and Recreation Department at 322 -6000 to make a reservation. A
form will be mailed to you to obtain additional information.
2. Reservations will be tentatively book. A completed facility reservation request form, signed
permit and the appropriate fee 1,1%7111 confirm your reservation.
3. Fill out the facility reservation request form. Mail or drop off the completed form to the
Parks and Recreation Department, 13885 South Robert Trail, Rosemount, MN 55068 -3438.
The appropriate fee must accompany the form. See attached sheet for appropriate fees.
4. Prior to the reservation date, any additional equipment (IE. volleyball nets, balls) or facility
keys must be picked up by the person reserving the park between the hours of 1 pm to 4 pm
the day prior to the reservation day and returned the next business day. Equipment must be
picked up on Friday and returned on Monday for reservations on the weekend. A $50.00
lost key fee will be charged to those users not returning the key(s).

Easels, paper and markers may be rented for $15 per use. (Easels are free of
charge if no paper and markers are requested.) The remaining equipment
including the overhead projectors, slide projector, VCR and TV monitors may
be rented for $10 per use. There is no charge for use of microphones and
lecterns.

Appendix I -2000
PARK DEDICATION FEES
Park dedication fees are outlined in City Ordinance No. XVII.103' which states:
In all new residential subdivisions, the City shall require that a sufficient portion of such land be set
aside and dedicated to the public for parks, playgrounds or other public use exclusive of property.

been dedicated for parks and playgrounds for the present and future residents of the subdivision, if the
subdivider dedicates at least 1/25 of an acre per dwelling unit that can be constructed in the
subdivision. The City upon consideration of the particular type of development proposed in the
subdivision may require larger or lesser amounts of land be dedicated if the City determines that the
present and future residents of the subdivision would require greater or lesser amounts of land for such
purposes. The City shall determine whether a cash in lieu of land dedication is more appropriate. The
amount of cash dedication shall be determined by multiplying the number of acres otherwise required
to be dedicated by the average value of comparable undeveloped land set by resolution by the City
Council.
In all new commercial and industrial subdivisions, it shall be presumed that a sufficient amount of land

at least five percent (5 %) of the land in the subdivision for parks, recreation and usable open space.

provides for the local licensing authority to fine up to $2,000 or to revoke or suspend
the license of the retailer for each N iolation.
The Alcohol & Gambling Enforcement Division encourages the local licensing
authority to take necessary- civil action against a licensee who fails a compliance
check. We are pleased with your continued support of this youth access project and if

A RESOLUTION ESTABLISHING RATES AND FEES FOR 2001
WHEREAS, the City Council has reviewed the 2000 fee schedule and recognizes the need to
amend certain rates and fees for 2001.
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Rosemount
hereby approved the rates and fees for 2001 as outlined in Appendix I and Appendix II.

City Staff Billing
For applications that include excessive staff time, services performed by City personnel
will be billed at two and one -half (2.5) times the actual payroll hourly rate. Services
provided by City consultants will be billed at the current consultant rates.

preliminary plat at the discretion of the Community Development Director.

Administrative Fees: For Chapter 429 or private improvements project charges shall be calculated
at 5 percent of public improvement construction costs.
Services provided by City consultants will be billed at the current consultant rates plus 5 percent

PARK DEDICATION FEES
Park dedication fees are outlined in City Ordinance No. XVII.103 which states:
In all new residential subdivisions, the City shall require that a sufficient portion of such land be set
aside and dedicated to the public for parks, playgrounds or other public use exclusive of property
dedicated for streets and other public ways. It shall be presumed that a sufficient amount of land has
been dedicated for parks and playgrounds for the present and future residents of the subdivision, if the
subdivider dedicates at least 1/25 of an acre per dwelling unit that can be constructed- in the
subdivision. The City upon consideration of the particular type of development proposed in the
subdivision may require larger or lesser amounts of land be dedicated if the City determines that the
present and future residents of the subdivision would require greater or lesser amounts of land for such
purposes. The City shall determine whether a cash in lieu of land dedication is more appropriate. The
amount of cash dedication shall be determined by multiplying the number of acres otherwise required
to be dedicated by the average value of comparable undeveloped land set by resolution by the City
Council.
In all new commercial and industrial subdivisions, it shall be presumed that a sufficient amount of land

plus 1 /10 of one percent (1 %) on any amount in excess of $30,000.00 to be paid
by persons or firms requesting the review.
8. When re- inspection is necessary to determine whether unsafe conditions have
been corrected and such conditions are not subject to an appeal pending before
any court, a re- inspection fee of $25.00 may be assessed in writing by the
inspector.
9. For inspections not covered herein, or for requested special inspections or
services, the fee of $32.00 per man hour, including travel time, plus $.40 per mile
traveled, plus the reasonable cost of equipment or material consumed. This
section is also applicable to inspection of empty conduits and such jobs as
determined by the City.
10. For inspection of transient projects including, but not limited to carnivals and
circuses the inspection fees shall be computed as follows:
Power supply units according to item 2 of the fee schedule. A like fee will be
required on power supply units at each engagement during the season, except that

a fee of $32.00 will be charged for additional time spent by the inspector if the
power supply is not ready for inspection at the time and date specified on the
Request for Inspection as required by law.
Rides, devices or concessions shall be inspected at their first appearance of the
season and the inspection fee shall be $25.00 per unit.
11. Fees for services, feeders and circuits operating at over 250 volts shall be double
those listed in items 2 and 3 above.
12. A $.50 State surcharge is to be added to each permit.

3. FACILITY FEES
A. Purpose
The City Council establishes the following user classification for the purpose of
setting fees. Specific fee charges are dependent on the purpose of the activities, type
of group, facility that is requested and special services and/or equipment needed,
with consideration to the, market place and such other factors as may be deemed
relevant. A fee schedule will be established by the City Administration after review
and recommendation of the Parks and Recreation Committee. The fee schedule will
be reviewed as necessary but not less than annually by the Parks and Recreation

The Gymnasium Kitchen may be rented for $50 per day.
Groups of 50 or more, using the gymnasium will be charged a custodial fee of

charge if no paper and markers are requested.) The remaining equipment
including the overhead projectors, slide projector, VCR and TV monitors may be
rented for $10 per use. There is no charge for use of microphones and lecterns.

limits mutually agreed upon.
3. Rosemount Area Hockey Association.

4. Other hockey associations or organizations requesting 200 or more hours per
year.
After the above groups have been scheduled consecutively, ice time for secondary users
(less than 200 hours per year) will be scheduled on a first come first serve basis.
D. Deposits
1. Specific to the auditorium, banquet room and gymnasium, a damage deposit of
$150 is required two weeks prior to the event. Pending there are no damages,
the deposit will be refunded within 21 days after the event date. Fee Class One,
Dakota Technical College, Dakota County Offices, State of Minnesota Offices,
municipal offices from cities adjacent to Rosemount, and School District #196
are exempt from damage deposits.
2. Specific to the auditorium, banquet room and gymnasium, a non - refundable
rental deposit of one half the fee is required within two weeks of permit issue.
The renter will forfeit the reservation if the rental deposit is not received within
two weeks after the permit issue date. The balance of the room fee is due two
weeks prior to the event.
3. Specific to the ice arena, a minimum non - refundable deposit of $45 per hour is
required upon receipt of ice arena contract for use.
4. Specific to the classrooms, a damage deposit of $25 is required two weeks
prior to the first meeting date for any organization reserving classroom space for
monthly meetings for a period of one year. The damage deposit may also be
assessed to one -time users based on the activity etc.
4. BUILDING USE
A. Smoking is prohibited in all areas of the building.
B. The consumption of alcoholic beverages is allowed in the Community Center in
designated areas according to the procedures and guidelines of the Community Center
and any applicable laws. Liquor must be served by an approved liquor provider as
designated through the City of Rosemount Liquor Ordinance. A uniformed licensed
police officer is required for rentals where alcoholic beverages are served. Security is
arranged by the rental coordinator in conjunction with the Rosemount Police
Department. The application of the security rule will be dependent on the activity type
and the appropriate staff will have the option of waiving the security rule. (see
Reservations N.).
C. The renter may arrange food service through the caterer of their choice. All caterers
must receive a facility orientation from the appropriate staff before the date of the
event. 6

D. Any liquor provider and caterer used are responsible for busing tables after the event
and consolidating trash into receptacles.
E. The City of Rosemount has the right to exclude caterers or liquor providers if
appropriate policies and procedures are not followed.
F. The Rosemount Community Center does not provide linens and table skirts.
G. Discrimination - The City of Rosemount will not discriminate against or harass any
applicant because of race, color, religion, national origin, sex, disability, age, marital
status, or status with regard to public assistance.
H. The Rosemount Community Center is not liable for any loss, damage, injury, or illness
by the users of the facilities in the Community Center. Neither the City of Rosemount
or its employees can be held responsible for any items that are left at the facility by
either the renter, caterer or contracted service.
I. Fees cover the use of reserved facilities according to the hours indicated on the permit,
contract or lease. This includes all set -up time by the caterer and/or the customer.
Occupancy of the reserved facility after the time indicated on the agreement will result
in an additional rental fee which will be deducted from the deposit or assessed to the
renter.
J. Specific to the auditorium, the fee includes RCC Staff, table and chair set -up, tear -
down, and cleanup. The auditorium and banquet fee includes the dance floor and
portable bar in addition to those items listed above as specific to the auditorium.
K. Specific to the banquet room, the fee includes RCC Staff, table and chair set -up, tear-
down, and general cleanup, and the use of the dance floor, portable bar, outdoor patio,
coat room and caterers kitchen.
L. Specific to the classrooms, fees do not cover table and chair set up. The class room
will be set up in a standard configuration. The room is expected to be set up in the
original configuration before the user leaves the facility. It is also the responsibility of
the user to consolidate any trash into receptacles and leave the room in a presentable
condition.
M. Specific to the gymnasium, the fee includes RCC Staff, 6 basketballs, 2 volleyballs
with two nets and standards. If the gymnasium is used for recreational purposes such
as basketball or volleyball; no black soled shoes, no gum, and no food or beverage is
allowed in the gymnasium. If the gymnasium is used for banquet purposes, the renter
is responsible for table and chair set up.
N. Additional charges are required for all portable audiovisual equipment.

5. RESERVATION PROCEDURES
A. All groups using the center must have an approved permit, contract or lease prior to
facility use. One contact person must be designated to make all arrangements with
Community Center staff.
B. Facility Use Permit requests will be approved by the Parks and Recreation
Department on the basis of the community center policies established by the City
Council
C. Tentative reservations may be taken over the phone and space will be held three
weeks or 21 days prior to permit issue and request of a rental deposit.
D. Specific to the auditorium and banquet room, fee class one and two can reserve the
auditorium and/or banquet room up to two years in advance of the event. Fee class
three and four can reserve the auditorium and/or banquet room up to 18 months in
advance.
E. Specific to the gymnasium, fee class one and two can reserve the gymnasium up to
12 months in advance of the event. Fee class three and four can reserve the
gymnasium up to the 9 months in advance.
F. Specific to the classrooms, reservations can be made for regular use of the
rooms for monthly meetings. Groups must submit an "Application for Regular
Meetings ". These applications will be accepted initially in the month of June
for the next school year, and thereafter.
G. Copies of the permit will be distributed to lessee and the appropriate staff as
deemed necessary.
H. Users take fall responsibility for their group's conduct and for any loss,
breakage, or damage to the rooms, equipment, or other community center
property. The City reserves the right to assign supervisory staff or maintenance
personnel at an additional cost to the user, if deemed necessary by the particular
function or activity.
I. Cancellations will be subject to 50% of the rental fee.
J. Once a permit has been authorized, the holder cannot assign, transfer nor
sublet to another party the use of the facility they reserved.
K. The hours stated on the Facility Use Permit must be adhered to as the facility
will be opened for the applicant and locked at the times stated on the permit.
L. Youth groups (participants ages 18 and younger) must be chaperoned on a
ratio of one adult per fifteen youth, or other ratio Community Center Staff
deem necessary.

M. No decorations, banners, or signs can be taped, pinned, or affixed to the
walls, ceilings or windows unless permission has been granted by the
appropriate staff.
(Refer to banquet room rules and regulations for more detailed information.)
N. A uniformed licensed police officer /reserve is required at the cost of the
renter when alcohol beverages are served. The Rental Coordinator will
arrange all police officers and renter will assessed a charge to be paid prior to
event date.
OUTDOOR FACILITIES:
1. PARK FACILITY PRIORITY USE:
All City of Rosemount Parks and Recreation Activities will be given priority, all
facilities will be scheduled to accommodate these activities. After all Parks and
Recreation activities have been scheduled accordingly, then requests will be
granted to other users in order of their priority as listed below.
A. City Sponsored Events
All Parks and Recreation Activities which include, but not limited to, Adult
Leagues, tournaments, playground programs, special events, etc.
B. Resident, Resident Civic, Non - Profit Groups and Rosemount Schools
Youth Athletic Associations, (RAAA, RAHA), Jaycees, St. Joes School,
Rosemount Middle School Athletics, Baptist Softball, etc.
C. Non - Resident, Non- Resident Civic, Non - Profit Groups, remainder of School

RESERVATION PROCEDURES:
PRIOR TO THE DAY OF THE EVENT /PICNIC
1. Call the Rosemount Parks and Recreation Department at 322 -6000 to make a
reservation. A form will be mailed to you to obtain additional information.
2. Reservations will be tentatively book. A completed facility reservation request form,
signed permit and the appropriate fee will confirm your reservation.
3. Fill out the facility reservation request form. Mail or drop off the completed form to
the Parks and Recreation Department, 13885 South Robert Trail, Rosemount, MN
55068 - 3438. The appropriate fee must accompany the form. See attached sheet for
appropriate fees.
4. Prior to the reservation date, any additional equipment (IE. volleyball nets, balls) or
facility keys must be picked up by the person reserving the park between the hours of 1
pm to 4 pm the day prior to the reservation day and returned the next business day.
Equipment must be picked up on Friday and returned on Monday for. reservations on
the weekend. A $50.00 lost key fee will be charged to those users not returning the
key(s).
5. Reservations include the park shelter or any other requested areas within the
park/facility only. (Please Note: In the summer, many parks have little league ball fields
that may have games and /or practices scheduled. However, the remaining portion of
the park is available for use by the facility user reserving the park.)
6. All parks are equipped with an outdoor portable toilet. No running water is available.
Only Erickson Park, Erickson Community Square and Jaycee Park have indoor rest
rooms, running water and electricity. (You may ask what additional parks have access
to electricity.) ,
7. The Parks and Recreation Department will not move tables from one park to another to
accommodate large groups.

8. No Refunds will be given due to inclement weather.
DAY OF THE EVENT /PICNIC
1. Persons reserving a facility/park must have their copy of the signed permit with them.
In case another user of. the park disputes the reservation, having the form available will
verify that party does have the facility reserved.
2. In the case of emergencies or problems you may contact the Rosemount Police
Department at 423 -4491 or the supervisor's digital pager at 909 -8945.
3. The person reserving the park facility, is responsible for enforcing all City of .
Rosemount park rules and ordinances. This person is also responsible for the conduct
of the people participating in the event /picnic.
4. Groups reserving the facility /park must pick up their trash before leaving the park.
FOLLOWING THE COMPLETION OF THE EVENT /PICNIC
1. All recreational equipment requested and all facility keys must be returned the next
business day between the hours of 7:30 a.m. - 4 p.m. to the Rosemount Parks and
Recreation office located at the Rosemount Community Center, 13885 South Robert
Trail, Rosemount, MN 55068 -3438. A $50.00 lost key will be charged to those users
not returning the key(s).
2. The Facility will be inspected by Parks and Recreation Staff the morning after the
event. The inspection will be made to look for cleanliness of the park and to inspect
any damages that may have occurred from the event. All cleaning time and damages
will be deducted from the damage deposit. Any or all remaining amount from the
damage deposit will be refunded to the user within two (2) - four (4) weeks from
reservation date.
4. RULES AND POLICIES FOR CONDUCTION A TOURNAMENT:
1. The fields will be dragged initially before the start of the first games) of the scheduled
tournament. Fields will NOT be chalked /lined. It is the tournament director's
responsibility to line the fields, as well as provide the materials /equipment to line the
fields if he /she wishes to do so, unless otherwise arranged with the Parks and Recreation.
Department.
2. Base lengths are set at sixty-five feet (65') unless requested otherwise. If different base
lengths are scheduled during a tournament, games must be scheduled so that the base
length distance decreases (ie. 75' to 65'). Unless special permission is approved, the base
paths will remain the same each day of the tournament per each field.
3. Additional maintenance services may be contracted with the City of Rosemount, providing
the City has available staff. This fee includes one (1) city employee with access to a
tractor drag. Dragging of the fields during the tournament is based upon weather
conditions, timing of the tournament (if it is not running behind, etc.). This person is
NOT responsible to pick up litter, run errands, and similar types of tasks.
4. NO GLASS CONTAINERS are permitted in the parks (including food or beverage
containers). This includes containers used to serve food in at the concession stand.

5. Charcoal fires permitted in barbecue grills only. NO WOOD FIRES ALLOWED!
6. Motorized vehicles are prohibited in the parks off the parking lot areas. NO cars may be
parked around the concession area. Use of the entrance by motorized vehicles should be
only to drop off supplies. Vehicles are not to obstruct the emergency entrance into the
shelter area.
7. All litter MUST be picked up throughout the entire day(s) of the tournament. A special
effort must be made at the end of the day. This includes parking lots and all ball fields
being used for the tournament (not just the fields by the shelter). Garbage bags are not
provided. All equipment and supplies that a tournament director brings in to the shelter
specifically for the weekend are to be removed from the park on the last scheduled day of
the tournament (ie. popcorn machine, coffee pots, kegs, semi - trucks /coolers that food
and /or beer is stored in, etc.). A request must be made PRIOR to the tournament for an
extension to leave equipment in the shelter longer than this time period.
8. Except for initial dragging, the tournament director must provide the maintenance of
fields (and /or coordinate efforts of field maintenance with city staff if this service has been
contracted).
9. BASES MUST BE TAKEN OFF FIELD prior to dragging it (every time it is dragged).
Set the bases along the side of the fence area. Reset the base after the field has been
dragged.
10. Give the Parks and Recreation Department a copy of the publicity (flyers) being sent out
for the tournament.
11. A tournament schedule must be on file with the Parks and Recreation Department the
Thursday prior to the tournament. This schedule can be dropped off when you check out
the keys for the shelter.
12. Rosemount Parks and Recreation Department has scheduled league games on Friday
evenings. Tournaments will not be permitted use of fields on Friday evenings.
13. No game may start before 8:00 a.m.. Erickson Park closes at 11 :00 p.m. All games
must be completed, lights off and all users and participants must leave the park and
parking lot area at this time.
14. The tournament director is to enforce the no parking policy on the EAST side of Brazil
Avenue. This is a fire lane. Cars will be ticketed and /or towed if found in violation.
15. Selling of alcoholic beverages is not allowed without a liquor license purchased through
the City of Rosemount at a fee set by the City Council. If you wish to obtain a liquor
license, the city requires a Certificate of Dram Shop Insurance from all tournament
directors showing they have in force a liquor liability policy and meet the city's
minimum coverage requirements. For information in obtaining a liquor license, please
contact the City Clerk's office at 423 -4411.
16. Beer trophies are prohibited.

17. No smoking or alcohol is allowed on the playing fields. Only smoking is allowed on
the benches.
18. Flyers cannot be put on vehicles (windshields, windows, etc.), establishments, or other.
Tournament directors or vendors must receive approval to do so by the Rosemount
Parks and Recreation Department by calling 322 -6000.
19. The tournament director must enforce all Parks Ordinance, including the following
portions of Rosemount's animal ordinance:
RESTRAINT: (ord. XIV.9, 7 -5 -89)
"...a dog or cat is considered to be under restraint on park property only when it is
controlled with the use of a leash no longer then 10 feet (10') or when it is under voice
or signal command in the exercise areas designated by the City. "
SANITATION: (7- 413 -8)
All persons in control of an animal on park property shall have in his /her possession at
all times an apparatus which can be used for cleaning up feces and /or a bag for proper
disposal of feces. The person in control of an animal is responsible for picking up
his/her animal's feces and disposing of it properly."
20. The tournament director's copy of the approved tournament form must be in the
possession of the user at all times while in the park and made available to park
personnel or police upon request.
21. During the course of the tournament, it is the responsibility of the tournament director
to ensure the cleanliness of the restrooms and shelter /concession area. The tournament
director is responsible to keep all equipment in clean, working order. At the conclusion
of the tournament, it is the responsibility of the tournament director to ensure that all
equipment in the restrooms and shelter /concession area are in clean, working order (IE.
toilets unclogged and flushed, garbage dumped, counter tops wiped clean.).
22. The Rosemount Parks and Recreation Department reserves the right to accept orreject
applications based upon past performance or cooperation of the applicant or factors
determined because of field conditions, priority of applicants, etc.
