SUMMARY
September of 1998, the Council approved a lot split and combination for Mr. Jordan's property located at the
south end of Chinchilla Avenue. The parcel was previously landlocked and the split /combination was intended
to solve the access problem for his 6 acre parcel purchased from Martha Simonette who lives at 12765
Chinchilla Ave. The result gave him about 50 feet of frontage on the Chinchilla Avenue right -of -way.
Subsequently, Mr. Jordan attempted to record the approval resolution with Dakota County (Resolution 1998
99). The County would not accept the split/combination because Ms. Simonette's property is platted, and Mr.
Jordan's is not.
Therefore, Mr. Jordan has had a plat prepared for his 6 acre parcel that reflects the City approval and will be
acceptable to the County. Nothing has changed from the original City action other than that Mr. Jordan's
property will be a platted lot called "Buckthorn Pond ".
RECOMMENDED ACTION:
Motion to adopt a resolution approving the administrative plat for Buckthorn Pond.

A RESOLUTION APPROVING
THE ADMINISTRATIVE PLAT
FOR BUCKTHORN POND
WHEREAS, the Community Development Department of the City of Rosemount received an
application from James Jordan for approval of the Administrative Plat for property.located south
of 12765 Chinchilla Avenue in Rosemount, Minnesota; and
WHEREAS, on September 15, 1998, the City Council approved a lot split and lot combination
resulting in the legal description for the Administrative Plat known as Buckthorn Pond; and
WHEREAS, on December 19, 2000, the City Council of the City of Rosemount reviewed the
Administrative Plat for Buckthorn Pond.
NOW, THEREFORE, BE IT RESOLVED, the City Council of the City of Rosemount hereby
approves the Administrative Plat for Buckthorn Pond.
ADOPTED this 19"' day of December, 2000, by the City Council of the City of Rosemount.

A RESOLUTION APPROVING
THE LOTSPLIT AND LOT COMBINATION
CONCERNING ROSEMOUNT HILLS SECOND ADDITION
Martha Simonett & James Jordan
WHEREAS, the Planning Department of the City of Rosemount received an application to split
the following described parcel of land:
Lot 5, Block 1, Rosemount Hills Second Addition, according to the recorded plat thereof, Dakota
County, Minnesota.
The split consists of a .04 acre triangular piece in the southeastern comer of said lot and
combination with the adjacent 6 acre parcel to the south, described as follows:
That part of the Southwest Quarter of Section 17, Township 115, Range 19, Dakota County,
Minnesota described as follows: Beginning at the southwest comer of Lot 5, Block 1, Rosemount
Hills Second Addition, according to the recorded plat thereof, Dakota County, Minnesota; thence
South 02 degrees 56 minutes 39 seconds East (assumed bearing) along the west line of said
Southwest Quarter a distance of 720.26 feet; thence North 87 degrees 03 minutes 21 seconds
East a distance of 362.78 feet; thence North 02 degrees 56 minutes 39 seconds West a distance of
720.26 feet to the southeast comer of said Lot 5; thence South 87 degrees 03 minutes 21 seconds
West a distance of 362.78 feet to the point of beginning.
Together with an easement for roadway purposes over a strip of land 30 feet in width described
as follows: Beginning at the southeast corner of Lot 5, Block 1, Rosemount Hills Second
Addition; thence North 87 degrees 03 minutes 21 seconds East a distance of 30 feet; thence
South 02 degrees 56 minutes 39 seconds East a distance of 720.26 feet; thence South 87 degrees
03 minutes 21 seconds West a distance of 30 feet; thence North 02 degrees 56 minutes 39
seconds West 720.26 feet to the point of beginning.
WHEREAS, the Planning Commission of the City of Rosemount conducted a public hearing on
September 8, 1998, for the purpose of receiving testimony regarding the requested lot split and
combination; and,
WHEREAS, the Planning Commission adopted a motion to recommend approval of the lot split
and combination; and,
WHEREAS, on September 15, 1998, the City Council of the City of Rosemount reviewed the
recommendation forwarded by the Planning Commission.
NOW, THEREFORE, BE IT RESOLVED, the City Council of the City of Rosemount hereby
approves the lot split and combination, resulting in the following legal descriptions:

along the south line thereof, 60.00 feet; thence North 45 degrees 30 minutes 23 seconds East
89.81 feet to a point on the east line of said Lot 5 distant 60.00 feet northerly of said southeast

Containing 118,239 square feet = 2.71 acres.

Dear Rick,
As you and I have discussed in the past, and again last week, I am moving forward with the platting
of the 2 pieces of property that my wife and I own in Rosemount.
Some brief background:
➢ A 6 -acre parcel was purchased by Jim and Marie Jordan in September 1998, along with a 0.04 -
acre piece of adjacent land (a portion of Lot 5, Block 1, Rosemount Hills Second Addition).
The purchase was contingent upon successfully obtaining a Lot Split, Lot Combination, and
Lot Width Variance from the City of Rosemount.
The City of Rosemount approved the applied -far lot split and combination, along with a 140-
foot lot width variance, as detailed in Resolution 1998 -99.
The request for combination of the 2 parcels was submitted to Dakota County as part of our
closing on the sale of the properties.
We learned in early 1999 that Dakota County would not combine the 2 parcels since the 6 -acre
parcel was currently unplatted and the 0.04 -acre parcel came from the platted Lot 5, Block 1,
Rosemount Hills Second Addition.
The end result is that we still have 2 properties with 2 property ID numbers that, in the eyes of
Dakota County, are not combined as one piece. The lot width variance granted by the City of
Rosemount was based on the combined property totalling 6.04 acres and having a 60 -foot frontage
on the city right -of -way.
Since it appears that the only way to achieve our goal of a single property from these 2 parcels is to
plat them, I am submitting this request to the City of Rosemount for platting of the 2 parcels. My
previous application for the Lot Combination was represented. by the public hearing process, and
no property boundaries are being changed as part of this platting.
I have enclosed several copies of the preliminary plat drawing, and I hope to receive platting
approval from the Rosemount City Council at their December 19th meeting. I appreciate your
efforts to have the platting application and related fees waived, in consideration of the previous
application fees that I paid (}530) for the Lot Division and Combination. Please let me know if
