Relocate property boundary line between two platted lots
Approval of this request would transfer a small fragment of land from lot 4 to lot 5. The desired result would be
a building location on a highpoint of lot 5, which overlooks the pond on lot 4. This action is an exception to
the subdivision ordinance because it does not create any new lots. Therefore, Planning Commission review and
public hearing is not required. The important consideration for the Council is that it also does not create any
non- conforming situations as a result.
The only concern identified by staff is, that the house on Lot 5 will dominate the western half of lot 4. An
alternative would be to split Lot 4 across the pond so it meets the 2.5 acre minimum size. The resulting remnant
would be combined with Lot 5, thus controlling all of the immediately adjacent land. However, this cannot be
required. Council should be comfortable with the idea that no variances would have to be granted if requested
in the future that do not meet the "hardship" criteria.
RECOMMENDED ACTION:
Motion to adopt a resolution approving the common boundaryline relocation for M. W. Johnson & Maureen
K. Johnson.

A RESOLUTION APPROVING THE
COMMON BOUNDARY LINE RELOCATION
FOR M.W. JOHNSON & MAUREEN K. JOHNSON
DRAFT
WHEREAS, the Planning Department of the City of Rosemount received an application from
M.W. Johnson and Maureen K. Johnson to relocate the common boundary line separating the
following described parcels:
Lots 4 and 5, Block 1, Oak Ridge Estates, according to the recorded plat thereof, Dakota
County, Minnesota; and
WHEREAS, relocation of the common boundary line will not result in any variances or lot
deficiencies in the Rural Residential District; and
WHEREAS, the Subdivision Ordinance allows for City Council approval of a common
boundary line relocation if there are no new parcels created by the relocation;
NOW, THEREFORE, BE IT RESOLVED, the City Council of the City of Rosemount hereby
approves the relocation of the common boundary line separating Lots 4 and 5, Block 1, Oak
Ridge Estates, resulting in the following legal descriptions:
Parcel A: Lot 4, Block 1, Oak Ridge Estates, as platted and of record in the office of the
Registrar of Titles, Dakota County, Minnesota except that part lying north of the
following described line: Commencing at the northwest comer of said Lot 4;
thence South 0 degrees 02 minutes 34 seconds East, bearing assumed along the west
line of said Lot 4, a distance of 70.00 feet to the point of beginning of the line to be
described; thence North 65 degrees 45 minutes 51 seconds East, a distance of
313.78 feet; thence North 27 degrees 29 minutes 33 seconds East, a distance of
42.43 feet to the north line of said Lot 4 and there terminating.
Parcel B; Lot 5, Block 1, Oak Ridge Estates, as platted and of record in the office of the
Registrar of Titles, Dakota County, Minnesota and that part of Lot 4, said Block 1,
lying north of the following described line: Commencing at the northwest corner of
said Lot 4; thence South 0 degrees 02 minutes 34 seconds East, bearing assumed
along the west line of said Lot 4, a distance of 70.00 feet to the point of beginning
of the line to be described; thence North 65 degrees 45 minutes 51 seconds East, a
distance of 313.78 feet; thence North 27 degrees 29 minutes 33 seconds East, a
distance of 42.43 feet to the north line of said Lot 4 and there terminating.
