At the work session, the substance of the trade was the Rosemount portion of the Valleywood golf course for six estate lots and the edge of Birger pond. There has been one minor addition to the swap, that is the driveway for three of the Apple Valley townhouse units north of "Street A" has been included. This way, the residents will not back out of their garages in Apple Valley onto their Rosemount driveways. If the Council adopts the resolution, then the Apple Valley City Attorney will take the lead on processing the detachment/annexation documents with the Municipal Board. RECOMMENDED ACTION: Motion to adopt a Joint Resolution requesting concurrent detachment from Rosemount and annexation to Apple Valley, and Joint Resolution requesting concurrent detachement from Apple Valley and annexation to Rosemount of property pursuant to Minn. NOW, THEREFORE, BE IT RESOLVED: 1. That the City of Rosemount and the City of Apple Valley jointly request that the director of the office of strategic and long- range planning concurrently detach Property I from the City of Rosemount and annex the same to the City of Apple Valley at the earliest possible date. 2. That the City of Apple Valley and the City of Rosemount jointly request that the director of the office of strategic and long - range planning concurrently detach Property II from the City of Apple Valley and annex the same to the City of Rosemount at the earliest possible date. .11 3. We are going to proceed assuming that you are okay with this change. Let me know if this is a bad assumption. We will be preparing legal descriptions for the annexation yet this week. The City of Apple Valley also made it a condition of final plat approval that the annexation had to occur before final plat. They indicated that Rosemount was leading that charge. Let me know if we can do anything to make sure that happens within the next 60 days or so. CITY OF app valley MEMO Planning and Development Department TO: Administrator, Mayor, and Councilmembers of Apple Valley FROM: Rick Kelley, Community Development Director DATE: June 5, 2000 SUBJECT: 'Detachment and Annexation with the City of Rosemount The residential development known as Evermoor straddles the common boundary of the cities of Apple Valley and Rosemount, with the vast majority of the project being located within Rosemount. In order to best preserve the natural features of the site, the detached single family portion of the development in Apple Valley will be accessed by a roadway connection from Rosemount.- As this would result in a circuitous %2 mile route through Rosemount for Apple Valley service providers to reach the homes (as well as creating an unusual post office delivery route), staff believes that a detachment of this property to allow its annexation by the City of Rosemount would best serve the public interest. In addition, in order to provide for the most efficient and effective regulation of the large'natural storm water pond (referred to as the "Birger Pond ") which also straddles the city boundary, it is recommended that a similar detachment and annexation occur so that Rosemount has sole jurisdiction over it. In exchange for the property. Apple Valley is giving up, Rosemount would detach the land area occupied by the "back nine" of Valleywood Golf Course so that Apple Valley could annex and have complete jurisdiction over it as well as a sliver of land for one of the Talcot Glen townhouse driveways. The process for detachment and annexation begins with the adoption of a resolution by each of the affected municipalities. These resolutions are transmitted to the Minnesota Department of Planning, which has the responsibility to review and approve municipal boundary adjustments, incorporations, and dissolutions. When the affected municipalities support boundary adjustments such as this, such approval is generally procedural in matter and will occur as a matter of course. Attached is a joint resolution prepared by the City Attorney's Office to be approved and executed by both Apple Valley and Rosemount. The area described as Property I would become part of the City of Apple Valley and represents the portion of Valleywood Golf Course and a 50' wide sliver of land encompassing one of the townhouse cluster private driveways. The area described as Property II would become part of the City of Rosemount and represents the portion of the Evermoor development encompassing six single- family lots on the end of a cul-de -sac and the westerly part of "Binger Pond Staff recommends adoption of the draft resolution approving the detachment and annexation as described in the attachments. f:\users\rkeiley \memos- =\2000\060800\evermoor annexation.dot
