However, discussions with pipeline company officials resulted in staff's recommendation to provide a public street crossing the multiple pipelines instead of forcing AWP and possibly other companies to negotiate for their own crossings. Therefore, the attached revision of the Business Park Second Addition includes a cul -de -sac for local access across the ENRON and Williams Bros. Pipeline easements. RECOMMENDED ACTION: Motion to approve the revised final plat of Rosemount Business Park Second Addition which includes 151" Court West. WHEREAS, the Planning Commission of the City of Rosemount reviewed the final plat application for Rosemount Business Park Second Addition at their regular meeting on February 22, 2000; and, WHEREAS, the Planning Commission adopted a motion to recommend approval of the final plat to the City Council as required by the Subdivision Ordinance; and, WHEREAS, the City Council of the City of Rosemount reviewed the final plat application as required by the Subdivision Ordinance on March 6, 2000. NOW, THEREFORE, BE IT RESOLVED, the City Council of the City of Rosemount hereby approves the final plat for Rosemount Business Park Second Addition, subject to comments by the Dakota County Highway Department. APPROVED BY: Contract Attached is an Addendum to the SKB Environmental, Inc. contract for operation and maintenance of the yardwaste facility located in Lakeville. The Cities of Apple Valley, Farmington, Lakeville and Rosemount entered into said contract on May 27` 1998. The changes reflected in the Addendum include the term of the contract, and the capacity, closure, and clean -up of the facility. City Attorney LeFevre has reviewed the Addendum. Staff recommends that Council approve the attached Addendum to the SKB Environmental, Inc. RECOMMENDED ACTION: Approve attached Addendum to the SKB Environmental, Inc. Contract for operation and maintenance of yardwaste facility and authorize the necessary signatures. COUNCIL ACTION: ADDENDUM TO CONTRACT BETWEEN THE CITITS OF LAKEVILLE, APPLE VALLEY, ROSEMOUNT, AND FARMINGTON AND SKB ENVIRONMENTAL, INC. FOR OPERATI0�1 AND MAINTENANCE OF XARDWASTE FACrLITY This Addendum, by and between the Cities of Lakeville, Apple Valley, Rosemount, and Far (hereinafter "Client"), and SIB Environmental, Inc. (hereinafter "Vendor"), amends the previous Contract made and entered into the 27 day of May. 1998, for the operation and maintenance of a yardwaste facility. IN CONSIDERATION OF THE MUTUAL COVENANTS CONTAINED HEREIN, CLIENT AND VENDOR AGREE AS FOLLOWS: ' 1. Prior Agreement The Contract between the parties dated May 27, 1998, for the operation and maintenance of a yardwaste facility, shall remain in full force and effect, except as specifically amended by this Addendum. 2. Amendment. The paragraphs to the Contract identified below are amended to read as follows: 95546 1.4 Term The term of this contract shall commence January 1, 2000, and terminate on December 31, 2002, unless both parties agree to an extension of this contract, or unless earlier terminated by law or according to the provisions herein. 3.1 g The Vendor shall operate and maint in each season (January 1, 2000 through December 31, 2002), the Facility at a capacity sufficient to handle Acceptable Materials generated by Client's communities. Unprocessed pallets on site at any given time shall not exceed 1000 cubic yards. 3.9 Closure of Facility The Vendor shall not accept any Materials after February 15, 2002, at the Lakeville Compost Facility. During the period of February 16, 2002 through December 31, 2002, Vendor shall have exclusive access to the Facility for the purpose of processing on site materials, selling, or otherwise distributing finished products and site clean up. 3.10 Cleap- 3M of the FaciRty. All chips, finished compost, unprocessed Acceptable Materials and Unacceptable Materials present at the Lakeville Compost Facility shall be removed and the portion that has a gravel surface shall be graded to ensure proper drainage, and any soil portion of the parcel distributed by grading activities shall be seeded such that the reestablished vegetation is sufficient to control erosion by the Vendor on or before December 31, 2002.
