The Rosemount American Legion Club 65 will be participating in the Leprechaun Days celebration with food
and drink under their pavilion in their parking lot at 14590 Burma Ave. on July 28, 29, and 30. They will
construct a temporary fence around the area.
The American Legion Club has provided the correct application, paid the fee, and have proper insurance
coverage. If the City Council approves the license, it is then referred unto the State of Minnesota for their
approval. Staff recommends approval.
RECOMMENDED ACTION: MOTION to approve the temporary on -sale liquor license for the
Rosemount American Legion Club #65 for July 28,29, and 30 of 2000.

SUBJECT: Temporary On -Sale Liquor License
The American Legion Post #65 has requested a temporary on -sale liquor license for three
dates during Leprechaun Days. This license is requested to allow the sale of liquor in the
parking lot area of the Legion. Liquor sales outside licensed establishments has the
potential to lead to problems of drinking outside of the designated area, drinking by
under -aged persons, littering, trespassing, etc.
Minnesota State Statute 340A regulates the issuing of temporary on -sale licenses.
MSS 34A Sub. 10 allows municipalities to issue licenses subject to terms determined by
the municipality. In order to address the concerns mentioned above, it is recommended
that if a temporary license is granted that the following terms be placed on the licensee:
1. The parking lot is to be fenced to control access to the area being used for the outside
service of food and beverages.
2. An employee or Legion member shall staff each entrance to the fenced area of the
parking lot and the public entrance(s) of the American Legion building to control
access and to prevent the taking of beverages from the Legion premises.
These conditions have been discussed with the manager of the American Legion. The
Legion plans to take these actions even if they are not terms of the temporary license.
