The massage ordinance was updated July 5th this year with suggestions from our attorney. I did not think about
fee changes at the time, however, after reviewing surrounding cities and the LMC survey, I believe the fees
could be lowered. There is a more modern surge in business to include massage as therapy for injuries, even
depression, and often I do get calls from people graduating from massage therapy schools looking for
opportunities. So far, most have remarked how high our fees are. I believe it would be good to encourage this
new type of business as a convenience to our residents.
The fee research showed the following facts:

Staff would suggest lowering fees to: Personal Massage License $150 Business Massage License $1,500 and
investigation fees for Personal as $100 the first year, $25 the following years, and for Business investigation
$250 the first year, and $100 the following years.
RECOMMENDED ACTION: MOTION to adopt AN ORDINANCE TO CHANGE FEES FOR
MASSAGE THERAPY, CITY CODE 3 -2B-3, Section D.

It has come to my attention that the ordinance regarding massage therapy contains several
outdated aspects. When comparing our ordinance to the ordinances of the surrounding
communities some differences were noted. Specifically, the fee for licensure in Rosemount
is extremely high. I have provided a list of the surrounding communities and the fees they
require below. The fees should be lowered to be in line with the fees of the surrounding
communities.
The other point needed to be looked at and re- assessed is the requirement that male
massage therapists massage only male clients, and female massage therapists only massage
female clients (3 -28-4: B -11). In this day and age, massage therapy has become a respected
profession that provides a unique and needed service to the communities it serves. There
may have been a need for the strict ordinance, but times have changed. There is no
restriction like this in any of the cities surveyed.

Please review the ordinance and make the applicable changes. I realize the City Council must
vote to change the ordinance, but I hope this can be done in an expedient manner.

ORDINANCE NO. -
AN ORDINANCE AMENDING CITY CODE TITLE 3, CHAPTER 2, ARTICLE B,
SECTION 3. D. LICENSE FEES for
MASSAGE THERAPY
The City Council of the City of Rosemount, Minnesota, ordains as follows:
Section 3 -2B -3, D FEES:
1. License Fees. Each application for a license shall be accompainied by payment in full of
the required license fee. The fee for personal srevices license shall be three hundred
dollars ($300) one hundred and fifty dollars ($150 and for a business license it shall be
two thousand five hundred dollars ($2,500.00) one thousand five hundred ($1,500) .
Upon rejection of any application for a license, the City shall refund the amount paid. No
other refunds shall be made
2. Investigation Fees. At the time of each original application for a business license, there
shall be paid in full an investigation fee of five hundred dollars ($500.00 two hundred
fifty dollars $250.00) A renewal investigation fee of two hundred fifty dollars ($250.00)
one hundred ($100.00) shall be paid at the time the renewal application is submitted At
the time of each original application for a personal license, there shall be paid in full an
investigation fee of one hundred dollars ($100.00) and a renewal investigation fee of
twenty -five dollars ($25.00) shall be paid at the time the renewal application is submitted
No investigation fee shall be refunded. (Ord. SVI.14, 10- 28 -77)
This Ordinance shall be effective immediately upon its passage and publication.
