The area being platted is located east of Shannon Parkway, on the south sides of Shannon Park Elementary School. There is much land that remains south and east of this area, which is phase II and will be platted in the future. This process involves checking the lots against the PUD requirements to ensure conformance with the preliminary plat as approved. A public hearing is not required. The plat includes lots intended for the "Active Senior" style which translates to a detached townhome similar to the Pulte project The Enclave. In contrast to Pulte, however there is significant variantions in the housing facades as demonstrated in the PUD amendment. All of the lots are narrower than typical R -1 at about 52 -56 feet wide. There is considerable open space provided by outlots on the perimeter of the neighborhood and in the interior as well, including and association building. The outlots will remain private as part of the development and are either for drainage & ponding, or interior trail connections. The lots have been checked to ensure that they meet the dimensional requirements of the PUD and the zoning ordinance as applicable. This means that the lots are wide and deep enough to be to accommodate the anticipated housing and meet the setback requirements, particularly on comer lots. There is one portion of the anticipated private street — outlot B, which will require an easement for the street construction because of a "notch" resulting from the redesigned street. The notch is part of the Phase II area which has not yet been purchased by the developer. PLANNING COMMISSION REVIEW The Commissioners were primarily concerned about the temporary street connection to Shannon Parkway across from Dahlia Court, and the protection of the wetland buffer south of the school on Outlot M, and its proximity to the private street boundary. RECOMMENDED ACTION: Motion to adopt a resolution approving the final plat for Evermoor 4' Addition. CITY COUNCIL ACTION: ONTRACTOR PROPERT DEVELOPERS CAMP Creating Neighborhoods of Merit October 17, 2000 Mr. Tom Burt City Administrator City of Rosemount 2878 145th Street West Rosemount, MN 55068 Re: Request for approval of Sales office location Evermoor Dear Mr. Burt: It has been brought to my attention that the sales office in Evermoor apparently does not meet the required front yard setbacks. The building itself meets the setbacks, however the front canopy structure/ overhang, which extends out from the front of the building does not. We had full intentions on building the structures based on the approved site plans, but we modified our initial plan and failed to present the revised canopy plan to the City for further approval prior to construction. There is no excuse for our failure to effectively communicate this with the City. The intent of the sales office is to be a temporary one. In accordance with the PUD Agreement, the sales office may only remain until 7536 of the lots have been built upon. Based on current market trends and project phasing we estimate the sales office will be needed in its current location for a period of three years and then moved to a new location on Connemara for the remaining duration of the project. We respectfully request that we be given administrative approval for encroachment of the sales canopy into the front setback area and apologize for any inconvenience we have caused. Thank you in advance for your consideration in this matter. Also, please note the canopy structure will be moved to a permanent location in the traditional neighborhood to be used as a park amenity. CITY OF ROSEMOUNT DAKOTA COUNTY, MINNESOTA RESOLUTION 2000- A RESOLUTION APPROVING THE FINAL PLAT FOR EVERMOOR 4th ADDITION WHEREAS, the Community Development Department of the City of Rosemount received an application for final plat approval submitted by Contractor Property Developers Company, as required by ordinance for the purpose of a residential development on land legally described as: Outlot H, Evermoor 2' Addition, according to the recorded plat thereof, Dakota County, Minnesota. WHEREAS, the Planning Commission of the City of Rosemount reviewed the final plat application for Evermoor 4th Addition at their regular meeting on October 10, 2000; and, WHEREAS, the Planning Commission adopted a motion to recommend approval of the final plat to the City Council as required by the Subdivision Ordinance, subject to conditions; and, WHEREAS, the City Council of the City of Rosemount reviewed the final plat application as required by the Subdivision Ordinance on October 17, 2000. NOW, THEREFORE, BE IT RESOLVED, the City Council of the City of Rosemount hereby approves the final plat for Evermoor 4' Addition subject to: 1. Execution of a subdivision agreement to secure public infrastructure including parks, streets and utilities. 2. Incorporation into the plat of recommendations of the Engineering/Public Works Department and the Consulting Engineer regarding drainage, easements, grading, public & private streets and utilities. 3. Provision of an easement over the Phase II "notch" area next to Outlots B, J and K. 4. Execution of the PUD Amendment agreement.
