Nature of Request The split will create two parcels of 37,801.4 (0.86 acre) and 57,253.6
(1.31 acres), respectively.
Planning Commission Action: Recommendation of Approval (4 -1)
SUMMARY
Carlson properties is requesting a simple lot split of their property on the northeast corner of Chippendale Ave.
and Carrousel Way. The property is a platted lot, which will be split into two parcels that will have a common
boundary line, aligning with the lots to the east. The subdivision ordinance allows splits of platted lots that
have simple legal descriptions as a result.
The resulting lots meet the minimum standards for the General Commercial zoning district. Staff is concerned,
however, about the proliferation of driveways to Chippendale Ave., which is a collector street. Therefore, the
recommendation of approval will include provisions for a shared driveway access between the two lots to limit
driveway connections to Chippendale Ave. to one. The southerly corner lot would still be able to have a second
driveway to Carrousel Way.
Lastly, subdivision is an appropriate time to secure needed public improvements. A sidewalk or trail is needed
along both Chippendale Ave. and Carrousel Way. Street lights should also be installed. A subdivision
agreement would be executed to secure the improvements. An alternative is to ask the applicant to execute a
Petition Waiver Agreement so that future assessments will not be appealed.
PLANNING COMMISSION PUBLIC HEARING
No one participated in the public hearing other than Mr. Carlson. Mr. Carlson indicated that he found the
shared driveway acceptable. He was against paying park dedication. He may be willing to cooperate with the
City regarding the future improvements as future assessments that would be passed on to the purchaser of the
property.
RECOMMENDED ACTION:
Motion to adopt a resolution approving the simple lot split for Lot 1, Block 1, South Rose Park 3' Addition.

RESOLUTION
A RESOLUTION APPROVING THE LOT SPLIT
FOR CARLSON PROPERTIES OF ROSEMOUNT
WHEREAS, the Planning Department of the City of Rosemount received an application from
Carlson Properties -of Rosemount for approval of a division of property, said property legally
described as:
Lot 1, Block 1, South Rose Park 3`' Addition, according to the recorded plat thereof,
Dakota County, Minnesota.
WHEREAS, the Planning Commission of the City of Rosemount conducted a public hearing on
September 12, 2000, as required by the subdivision ordinance for the purpose of receiving
testimony regarding the requested lot division; and,
WHEREAS, the Planning Commission adopted a motion to recommend approval of the lot
division to the City Council with conditions; and,
WHEREAS, on October 3, 2000, the City Council of the City of Rosemount reviewed the
recommendation forwarded by the Planning Commission;
NOW, THEREFORE, BE IT RESOLVED, the City Council of the City of Rosemount hereby
approves the division of the above referenced parcel resulting in the following described parcels:
Parcel A
The North 140 feet of Lot 1, Block 1, South Rose Park 3' Addition, according to the
recorded plat thereof, Dakota County, Minnesota.
Parcel B
All of Lot 1, Block I, South Rose Park Yd Addition, according to the recorded plat
thereof, except the North 140 feet thereof, Dakota County, Minnesota.
BE IT FURTHER RESOLVED, the approval of this lot split is subject to:
1. Payment of fees required according to the current fee schedule including G.I.S. and Park
Dedication;
2. Incorporation of recommendations by the Consulting Engineer concerning access, easements,
utilities and public improvements/nfrastructure;
3. Provision of one driveway access to Chippendale Avenue serving both lots and recording of
cross- access easements and maintenance agreements for both parcels relative to the use,
construction and maintenance of the driveway in a form acceptable to the City Attorney; and
4. Execution of a subdivision agreement to secure sidewalks (or trails) along Chippendale Ave.
and Carrousel Way and "acorn" style street lights as needed.

Pursuant to call and notice thereof, the Regular Meet' of the Planning Commission
was duly held on sday, September 12, 2000. Ch ' erson Bill Droste called the
meeting to order at 8:0 with members M n Napper, Kim Shoe- Corrigan, and
Jeffery Weisensel present. attend was City Planner Rick Pearson.
There were no additions or corr ns a agenda.

Public Hearing: Carlson Properties of Rosemount Lot S�lit
Chairperson Droste opened the public hearing on the application by Carlson Properties of
Rosemount for a Lot Split. The recording secretary has placed the Affidavit of
Publication and Affidavit of Mailing and Posting of a Public Hearing Notice on file with
the City.
Mr. Pearson presented the request by Carlson Properties of Rosemount to divide a 2.18
acre commercial lot. The parcel is located in the northeast corner of Chippendale Ave.
and Carrousel Way. An office building is anticipated for the northern parcel. The split
will create two parcels, which meet the minimum standards in the Commercial District.
Staff recommends that the two lots share a driveway onto Chippendale Avenue with
cross- access easements. Additionally, staff recommends that public improvements be
secured, including sidewalks /trails and streetlights.
Chairperson Droste opened the floor to the applicant. Cliff Carlson was present. on behalf
of Carlson Properties of Rosemount. Mr. Carlson indicated the shared driveway is
acceptable. Mr. Carlson requested that the recommended public improvements be put in
when the property is developed and assessed to the new property owner. Mr. Carlson
explained that Park Dedication fees were previously paid on the original South Rose plat.
He did not feel that additional fees are warranted at this time. Mr. Pearson responded that
the applicant could request relief from the City Council for payment of the fees.
Chairperson Droste opened the public hearing. There were no comments.
MOTION by Droste to close the public hearing. Seconded by Weisensel. Ayes:
Droste, Shoe- Corrigan, Weisensel, and Napper. Nays: 0. Motion carried.

Ch ' rson Droste opened the public hearing on Business Park re gs in
impleme ation of the Comprehensive Plan. The recording seer has placed the

Mr. Pearson indicat that state law requires that a c' 's zoning be in conformance with
its adopted Compreh ive Plan. In implementat' n of the Comprehensive Plan, staff is
proposing that land desi ated for Business P use be rezoned accordingly. The
rezoning pertains to appro ' ately 245 acre south of the Rosemount Business Park, east
of Hwy. 3 and west of Bisca e Ave. Mr earson reviewed the permitted uses and
building standards in the BP -1 BP- zoning districts. Mr. Pearson explained that the
BP -2 designation is suggested for s with higher profile, resulting in a higher
expectation for architectural mate 'al along with no outside storage.

Leo Stem 206 Central e., Minneapolis, is p owner of the parcel designated for BP -2
zoning. The BP -2 de gnation is based upon the p eel's potential access and exposure to
Hwy. 3 after it is r cated. Mr. Stern opposed the -2 zoning for his parcel, which
would impose hi er architectural standards based upo otential access to Hwy. 3 that
does not exist this time. `Mr. Stem feels the City shoul ase a zoning decision on facts
as they now xist, not upon a conceptual plan.
Mr. Pe on responded that, based upon conversations with MnD T, he feels an
inters tion on Hwy. 3 at the location of the Stem parcel is almost a ty. This
wo d be a key intersection with high visibility, requiring the same ds as Port
thority property on CSAH 42. Rezonings can be requested as the prop is
ubdivided and developed.

Dear Ms. Quinnell:
Enclosed herein and submitted to you please find the Lot Split
Application for Lot 1 Block 1 South Rose Park 3rd Addition. I
also enclose this firm's check in the amount of $330.00 for the
fee.
Further, I understand that a survey may not be required, as this
is platted property, and the split is a definitive.amount of
property (that being the North 140 feet) of the platted lot.
Please advise me as to when this matter is going to be placed on
the calendar, and whether it will be on the consent agenda, or
whether the appearance of a representative of Carlson Properties
will be necessary.
