Bloomfield 2nd Subdivision AgreementCITY OF ROSEMOUNT DAKOTA COUNTY, MINNESOTA RESOLUTION 2000 - 19 A RESOLUTION AUTHORIZING ACQUISITON OF STREET RIGHT OF WAY BY EMINENT DOMAIN WHEREAS, the City of Rosemount ( "City') is a municipal corporation and subdivision of the State of Minnesota organized and operating under Minnesota law, and is authorized by Minnesota Stat. § 412.211 and § 465.01 to acquire real estate by exercising the power of eminent domain under and pursuant to Minn. Stat., Ch. 117; and WHEREAS, under Minn. Stat. § 412.221, subdivision 6, the City Council has the power to change or widen public streets and public ways; and WHEREAS, the City has determined a need to install certain public streets and utilities in order to provide access and municipal services to a residential development known generally as "Bloomfield Second Addition," and WHEREAS, the City staff has been unable to negotiate an agreement with the property owner for the conveyance of the needed right of way to the City. NOW THEREFORE, BE IT RESOLVED, by the City Council of the City of Rosemount: 1. The City council hereby finds that it is necessary and in the public interest to acquire easements for public right of way and public drainage and utility purposes over portions of the property described on the attached Exhibit A (the Subject Property). 2. The City attorney and staff are authorized and directed to commence eminent domain proceedings to acquire permanent easements for public right of way purposes and drainage and utility purposes over those portions of the Subject Property as described on the attached Exhibit A. ADOPTED this 21 st day of March, 2000 by the City Council of the City of Rosemount.
