As part of the platting process for the Carrousel Plaza Townhomes plat, Heritage Development
has requested the vacation of an existing drainage and utility easement on Outlot A of Carrousel
Plaza South. At the time of platting of Carrousel Plaza Townhomes, the utility and drainage
easement will be expanded to include most of this area and other areas within the plat.
The easement to be vacated is a drainage and utility easement over and across the southerly 30.00
feet of Outlot A, Carrousel Plaza South, beginning at the southwest corner then east a distance of
approximately 585.08 feet, according to the recorded plat thereof, Dakota County, Minnesota.
Because the easement was dedicated for public use (drainage & utilities), a public hearing is
required to vacate it. A condition of the approval for vacation is the execution of the Carrousel
Plaza Townhomes plat.
Staff is recommending approval of the easement vacation resolution contingent on the above
condition.
RECOMMENDED ACTION: MOTION TO ADOPT A RESOLUTION CAUSING EASEMENT
VACATION ON THE CARROUSEL PLAZA SOUTH PLAT, OUTLOT A.

RESOLUTION 2000 -
A RESOLUTION CAUSING EASEMENT VACATION FOR
CARROUSEL PLAZA SOUTH, OUTLOT A
WHEREAS, a public hearing was scheduled and held before the City Council of the City of
Rosemount on November 21, 2000 after due publication as required by law, and all
interested persons were given an opportunity to be heard; and
WHEREAS, it appears the current easement serving a public purpose is based upon the
property in a predevelopment state, and will be replaced by a modified easement for
public purpose that will be incorporated with the development plat.
NOW THEREFORE BE IT RESOLVED, that the following drainage and utility easement
hereby vacated, to wit:
Over and across the southerly 30.00 feet of Outlot A, Carrousel Plaza
South, beginning at the southwest corner then east a distance of approximately
585.08 feet, according to the recorded plat thereof, Dakota County, Minnesota
BE IT FURTHER RESOLVED, that the City Attorney shall prepare a notice of completion of
the proceedings and necessary Quit Claim Deeds which shall contain the name of the
City, identification of the vacation and a statement of the time of completion thereof, and
shall present the same to the County Auditor and then file a copy with the County
Recorder.
ADOPTED this 21 st day of November, 2000.
