Guide Plan Desig: Business Park Current Zoning: BP -1 Planning Commission Action: Recommendation of approval (3 -0) SUMMARY The basis of this request is to create a lot along the north side of Dakota Fence fronting on Biscayne Avenue. The lot is actually being created with Dakota Fence in mind as a purchaser for long term expansion plans. It is anticipated that Dakota Fence would combine the new parcel with their existing site when they are ready to develop it. In the mean time, it will be a separate parcel that could stand alone if it were sold. The split does not require any variances and is consistent with Business Park standards. It also does not negatively impact surrounding properties. PLANNING COMMISSION PUBLIC HEARING On November 14, 2000, the Planning Commission conducted a public hearing as required for the subdivision. No one attended other than the owner "applicant Mr, Fischer and the buyer, Mr. Engelmeyer. The Planning Commissioners had no issues with the lot split, being consistent with previous actions. One Commissioner inquired about the compatibility of the anticipated use of the parcel with the University of Minnesota's plans for the land east of Biscayne. Staff indicated that the use is compatible, however, the U of M buffer is still a recommendation that has not been implemented as a land use control. RECOMMENDED ACTION: Motion to adopt a resolution approving the lot split requested by R.C.D. Real Estate. CITY COUNCIL ACTION: ... CITY OF ROSEMOUNT DAKOTA COUNTY, MINNESOTA RESOLUTION 2000- A RESOLUTION APPROVING THE LOT SPLIT FOR RCD REAL ESTATE PARTNERSHIP WHEREAS, the Planning Department of the City of Rosemount received an application from RCD Real Estate Partnership for approval of a division of property, said property legally described as: The South Half of the Southeast Quarter of Section 32, Township 115, Range 19, Dakota County, Minnesota; EXCEPT the west 1645.05 feet thereof; also EXCEPT the south 327.84 feet thereof which lies east of the west 1976.99 feet thereof; and also EXCEPT the east 331.94 feet of the west 1976.99 feet of the south 656.14 feet thereof. Containing 20.32 acres. Subject to all easements, if any. WHEREAS, the Planning Commission of the City of Rosemount conducted a public hearing on November 14, 2000, as required by the subdivision ordinance, for the purpose of receiving testimony regarding the requested lot division; and, WHEREAS, the Planning Commission adopted a motion to recommend approval of the lot division. to the City Council with conditions; and, WHEREAS, on November 21, 2000, the City Council of the City of Rosemount reviewed the recommendation forwarded by the Planning Commission; NOW, THEREFORE, BE IT RESOLVED, the City Council of the City of Rosemount hereby approves the division of the above referenced parcel resulting in the following described parcels: Parcel A That part of the north 328.30 feet of the south 656.14 feet of the South Half of the Southeast Quarter of Section 32, Township 115, Range 19, Dakota County, Minnesota lying easterly of the west 1976.99 feet of said South Half of the Southeast Quarter. Containing 5.00 acres, including the right -of -way of Biscayne Avenue. Parcel B The South Half of the Southwest Quarter of Section 32, Township 115, Range 19, Dakota County, Minnesota; EXCEPT the west 1645.05 feet thereof; and also EXCEPT the south 656.14 feet thereof. Containing 15.32 acres. Subject to all easements, if any. BE IT FURTHER RESOLVED, the approval of this lot split is subject to: 1. Payment of fees required according to the current fee schedule including G.I.S. and Park Dedication.
