RECOMMENDED ACTION: MOTION TO GIVE NOTICE OF TERMINATION TO THE EMPLOYEE IDENTIFIED IN THE STAFF REPORT. COUNCIL ACTION: PRIVATE DATA — DO NOT RELEASE TO THE PUBLIC DATE: November 21, 2000 TO: FROM: SUBJ: Mayor Busho Councilmembers Cisewski, Edwards, Klassen, and Caspar Paula A. Graff, HR/Comm Coord. Termination of Firefighter John Van Ruler This is a recommendation for the City Council to consider terminating firefighter Jon Van Ruler from employment with the City of Rosemount. Mr. Van Ruler has been an employee with the City since August 19, 1998. This action is being recommended by the Fire Chief, Scott Aker and comes as a result of an on -going violation of Section 13 of the Fire Department Personnel Policy, concerning Participation Requirements. On the following dates Mr. Van Ruler was notified of violations of the Participation Requirements which resulted in the following action taken: Date Violation Action Taken 12/31/1999 Low call percentage Verbal warning given by Chief Aker 3/31/2000 Low drill percentage (62% ) Verbal warning given by Chief Aker 3/31/2000 Low call percentage (26 %) Written warning given by Chief Aker and City Administrator Burt 6/30/2000 Low drill percentage (48 %) Written warning given by Chief Aker and HR Coordinator Graff 6/30/2000 Low call percentage (23 %) Written warning and 15 day suspension given by Chief Aker and HR Coordinator Graff The Fire Department Personnel Policy clearly states: Failure to maintain the minimum fire training percentage shall be cause for disciplinary action. Fire training attendance percentage shall be reviewed on a quarterly basis. During any quarter, if a firefighter fails to meet minimum fire training percentage, s/he shall be subject to disciplinary action. The first occasion shall result in a verbal warning. The second shall result in a written warning. The third occasion shall result in a suspension form the fire department for a period of fifteen (15) days. The fourth occasion shall result in a recommendation by the fire chief for termination. Based upon this clear policy statement and the strict adherence with the policy of progressive discipline, it is my recommendation that Mr. Van Ruler's employment be terminated.
