Guide Plan Desig: Rural Residential Current Zoning: Rural Residential Nature of request: Shift common lot line fifteen feet north to solve a driveway encroachment problem. SUMMARY This item is a result of the development of Lot 1, Block 2 Oakridge Estates which is the first lot on the east side of CoffeeTrail. The driveway for the property was installed in such a manner as to encroach onto the property to the north by eight feet. The options available to correct the problem are: 1. Move the driveway Which is problematic because of the location of the drainfield in the front yard. 2. Move the propertyline north to eliminate the encroachment. Option 2 is the choice because it has the least impact on both properties, and it can be accomplished without creating any non - conforming issues with either lot as a result. This item is not considered to be a subdivision because the parcel being created by the split will be recombined with the other property. Therefore, a public hearing and Planning Commission review is not required. RECOMMENDED ACTION: Motion to adopt a resolution approving the common boundary line relocation for M. W. Johnson & Maureen K. Johnson. CITY COUNCIL ACTION: CITY OF ROSEMOUNT DAKOTA COUNTY, MINNESOTA RESOLUTION 2000- A RESOLUTION APPROVING THE COMMON BOUNDARY LINE RELOCATION FOR M.W. JOHNSON & MAUREEN K. JOHNSON WHEREAS, the Planning Department of the City of Rosemount received an application from M.W. Johnson and Maureen K. Johnson to relocate the common boundary line separating the following described parcels: Lots 1 and 2, Block 2, Oak Ridge Estates, according to the recorded plat thereof, Dakota County, Minnesota; and WHEREAS, because the existing driveway for Lot 1 encroaches onto Lot 2, the boundary line separating the two parcels must be relocated 15 feet to the north; and WHEREAS, the Subdivision Ordinance allows for City Council approval of a common boundary line relocation if there are no new parcels created by the relocation; NOW, THEREFORE, BE IT RESOLVED, the City Council of the City of Rosemount hereby approves the relocation of the common boundary line separating Lots 1 and 2, Block 2, Oak Ridge Estates, resulting in the following legal descriptions: Parcel A: Lot 2, Block 2, Oak Ridge Estates, according to the recorded plat thereof, Dakota County, Minnesota, EXCEPT the south 15.00 feet thereof. Parcel B: Lot 1, Block 2, Oak Ridge Estates, according to the recorded plat thereof, Dakota County, Minnesota, TOGETHER with the south 15.00 feet of Lot 2, Block 2, said Oak Ridge Estates.
