City Attorney LeFevere resolved the assessment appeal for Donald Wachter with an agreement lowering the
assessment amount from $27,790 to $17,500. This assessment has been paid in full. The attached resolution
allows the county to remove its pending amount from the assessment roll.
Staff recommends approval of the attached resolution.

RE: Wachter v. City of Rosemount
Dear Tom:
As you will recall, the City Council authorized settlement of the special assessment in the
Wachter case for a total assessment of $17,500. Both parties have executed a Stipulation and
Mr. Wachter has paid the assessment in full.
Therefore, I would recommend that the attached Resolution be put on the consent agenda for an
up- coming Council meeting and, after it is adopted, forwarded to the County for removal of the
assessment from the assessment roll.

RESOLUTION 2000-
A RESOLUTION AMENDING ASSESSMENT ROLL FOR
CHIPPENDALE AVENUE STREET AND UTILITY IMPROVEMENTS
CITY PROJECT 290
WHEREAS, by Resolution 1999 -134 adopted by the City Council of the City of Rosemount,
Minnesota, on October 19, 1999, the City Council approved an assessment roll for special
assessments levied for the Chippendale Avenue Street and Utility Improvements, City Project
290: and
WHEREAS, the Council has determined that certain assessments should be adjusted as
hereinafter set forth;
NOW THEREFORE BE IT RESOLVED, by the City Council of the City of Rosemount,
Minnesota, that:
The amount of special assessment levied against property identification number 34-
03210- 011 -25, located at 15400 Chippendale Avenue West, in the total original amount of
$27,790.00 by the assessment roll adopted by Resolution 1999 -134 is cancelled.
ADOPTED this 7h day of November, 2000 by the City Council of the City of Rosemount.
