Action: Recommendation of approval (unanimous) SUMMARY The city is requesting approval of this lot split in order to acquire a 4.2 acre site for a water tower in eastern Rosemount. The parcel is currently part of 27.19 acres owned by JoAnn & Marlin Rechtzigel at the south east corner of CSAH 42 and US 52. The water tower itself will be sited on a 350'x 300' parcel with an 80' wide strip of land for access. This is an important step in the process of providing urban services to the east side. Given that the nature of this lot split request is for essential services, rather than specifically for commercial, industrial or residential development, staff recommends that park dedication not be required. PLANNING COMMISSION PUBLIC HEARING On January 11, 2000, the Planning Commission conducted the required public hearing. JoAnn and Marlin Rechtzigel attended but had no comments. The Planning Commission had questions about the water tower, but expressed no concerns about the lot split. A motion was then adopted to recommend approval. RECOMMENDED ACTION: Motion to adopt a resolution to approve the lot split for a 4.2 acres site for the east side water tower. CITY COUNCIL ACTION: CITY OF ROSEMOUNT DAKOTA COUNTY, MINNESOTA RESOLUTION 2000- A RESOLUTION APPROVING THE AGRICULTURAL LOT SPLIT FOR MARLIN & JOANN RECHTZIGEL WHEREAS, the Planning Department of the City of Rosemount applied for approval of a division of property in the Agricultural District, said property legally described as: The Northwest Quarter of the Southwest Quarter of Section 30, Township 115, Range 18, Dakota County, Minnesota. Subject to roads and easements of record. WHEREAS, the Planning Commission of the City of Rosemount conducted a public hearing on January 11, 2000, as required by the subdivision ordinance for the purpose of receiving testimony regarding the requested Agricultural division; and, WHEREAS, the Planning Commission adopted a motion to recommend approval of the Agricultural division to the City Council with conditions; and, WHEREAS, on January 18, 2000, the City Council of the City of Rosemount reviewed the recommendation forwarded by the Planning Commission; NOW, THEREFORE, BE IT RESOLVED, the City Council of the City of Rosemount hereby approves the division of the above referenced parcel resulting in the following described parcels: Parcel A: The Northwest Quarter of the Southwest Quarter of Section 30, Township 115, Range 18, Dakota County, Minnesota, excepting therefrom the West 270 feet of the East 350 feet of the South 300 feet, and further excepting therefrom the West 80 feet. Subject to roads and easements of record. Parcel B: The West 270 feet of the East 350 feet of the South 300 feet of the Northwest Quarter of the Southwest Quarter of Section 30, Township 115, Range 18, Dakota County, Minnesota. AND The West 80 feet of the Northwest Quarter of the Southwest Quarter of Section 30, Township 115, Range 18, Dakota County, Minnesota. Subject to roads and, easements of record.
