City Engineer/Public Works Director ����� � � � ATTACHMENTS: Resolution,Petition,Drawing APPROVED BY• The City has received a petition to install street and utility improvements in the third phase of the Biscayne Pointe Addition. The attached map shows the third phase as proposed by the Developer, Heritage Development. Biscayne Pointe is located immediately adjacent to the raikoad tracks and east of Biscayne Avenue and received preliminary plat approval in June, 1997. The 3id Addition will require the extension of Biscayne Avenue to the northern limits of the plat. Since the petition is signed by 100%of the property owners benefiting from the proposed improvements,the City will not have to hold a public haring to consider the improvements. The schedule is tentatively set as follows: Order Feasibility Report September 21, 1999 Receive Feasibility Report/Order Plans & Spec's November 2, 1999 Approve Plans & Spec's/Order Ad for Bid December 21, 1999 Receive Bids February 9, 2000 Award Contract February 15, 2000 Begin Construction March, 2000 Complete Construction June, 2000 Assessment Hearing September, 2000 Staff recommends that the City Council pass the resolution as stated below. COUNCIL ACTION: CITY OF ROSEMOUNT DAKOTA COUNTY, MINNESOTA RESOLUTION 1999 - A RESOLUTION RECEIVING PETITI�N AND ORDERING FEASIBILITY REPORT FOR BISCAYNE POINTE 3RD ADDITION STREET AND UTILITY IMPROVEMENTS CITY PROJECT #313 WHEREAS, the City Council of the City of Rosemount has received a petition from a property owner who will benefit from the proposed Biscayne Pointe 3rd Addition Street and Utility Improvements, City Project #313. NOW THEREFORE BE IT RESOLVED, by the City Council of the City of Rosemount as follows: (1) A certain petition requesting utility improvements to their property, filed with the Council on September 21 , 1999, is hereby declared to be signed by the required percentage of owners of property affected thereby. This declaration is made in conformity to Minnesota Statutes, Section 429.035. (2) The petition is hereby referred to the City Engineer and that person is instructed to report to the Council with all convenient speed advising the Council in a preliminary way as to whether the proposed improvement is necessary, cost-effective, and feasible and as to whether it should best be made as proposed or in connection with some other improvement, and the estimated cost of the improvement as recommended.
