Attached is a Quit Claim Deed,which will give to the Minnesota Department of Transportation the
access rights to 140"' St. E. on US Hwy. 52. This was part of the consideration that MnDOT received for
providing the city the $350,000 in funding for the Conley Avenue project. The legal description is of
the right-of-way for 140"' St. E. (former CR 38) on the east side of US Hwy. 52/STH 56.
Staff recommends the action be taken as described below.
RECOMMENDED ACTION: MOTION TO APPROVE THE QUIT CLAIM DEED FOR THE 140Tx
ST. E. ACCESS TO US HWY. 52/STH 56 AND TO AUTHORIZE THE NECESSARY SIGNATURES.
COUNCIL ACTION:
QUIT CLAIM DEED
THIS QUIT CLAIM DEED, executed this 3rd day of August, 1999,by the CITY
OF ROSEMOLJNT, a Minnesota Municipal Corporation, (the"Grantor"), to STATE OF
MINNESOTA,DEPARTMENT OF TRANSPORTATION, (the "Grantee").
WITNESSETH,That Grantor, in consideration of the sum of One Dollar($1.00)
and other good and valuable consideration,the receipt whereof is hereby acknowledged,
does hereby remise,release and quitclaim unto Grantee forever, all right, interests and
claim to construct a roadway access over and across the following described parcel of
land, and improvements and appurtenances thereto, in the County of Dakota, State of
Minnesota, described as follows, to-wit:
The North 33.00 feet of the West 33.00 feet of the West half of the Northwest
Quarter of Section 30, Township 115,Range 18,Dakota County, Minnesota;
AND
The South 33.00 feet of the West 33.00 feet of the Southwest Quarter of Section
19, Township 115,Range 18,Dakota County,Minnesota.
IN WITNESS WHEREOF, Grantee has signed and sealed these presents the day
and year first above written.
