Area in Acres: 1/4 acre(in total)transferred to the four lots of Winds Crossing. SUMMARY This replat will transfer approximately 1/4 acre of land from an outlot ponding area to four townhouse or quad units and solve setback deficiencies for the units. The two "quad"buildings are located between Cornell Trail and Chippendale Avenue adjacent to the pond along Chippendale Avenue. This part of Outlot A is associated with the drainage ponding area and is not part of the Winds Park. The land was platted for quad development in 1980 and apparently, the four units backing up to the ponding area are within ten feet of the property line. T'he building setback requirement or standard is thirty feet, and the proximity of the four decks to the property line ranges from 3.5 feet to actually .78 feet over the line. While variances could be requested,there is no way to legitimize a structure or deck which extends across a property line. Perhaps more importantly,many lending institutions will not finance non-conforming property. This is the primary reason for the idea of moving the property line instead of pursuing a variance process. The pond was improved last year along with Chippendale Avenue, and there will be no further changes. Only the property line will move from the outer edge into the ponding area. An easement will be required that will retain control of what happens in the pond itself. As a result,the buildings as they currently exist will be legitimized, and the occupants would have the ability to construct slightly larger decks. However,they will be restricted by the easement fro altering the pond in any way, or building into the ponding easement. The City Engineer has reviewed the boundary line change and finds no material impact on the pond. In fact, the request is consistent with current city practice of having ponds privately owned,yet preserving them with easements. PLAN1vING COMMISSION PUBLIC HEARING One person in addition to the affected property owners attended and participated in the public hearing. He questioned the impact on the park,possible impacts on the pond and how large the new decks could be. One Commissioner asked about current platting methods. Current methods would probably result in a smaller Outlot A for park use and the pond would have been left with the development,restricted by easements. RECOMMENDED ACTION: Motion to adopt a resolution approving the replat for Winds Crossing. CITY COUNCIL ACTION: CITY OF ROSEMOUNT DAKOTA COUNTY,MINNESOTA RESOLUTION 1999- A RESOLUTION APPROVING THE ADMINISTRATIVE PLAT FOR WINDS CROSSING WHEREAS,the Community Development Department of the City of Rosemount received an application from Winds Crossing Homeowners Association for approval of the Administrative Plat to divide property located west of Chippendale Avenue, south of 156"' St. W. in Rosemount, Minnesota; and WHEREAS, on July 13, 1999, the Planning Commission of the City of Rosemount reviewed the Administrative Plat for Winds Crossing and adopted a motion to recommend approval to the City Council; and WHEREAS,on July 20, 1999,the City Council of the City of Rosemount reviewed the Administrative Plat for Winds Crossing. NOW,THEREFORE,BE IT RESOLVED,the City Council of the City of Rosemount hereby approves the Administrative Plat for Winds Crossing, subject to the provision of a ten foot wide drainage and utility easement retained within the outer perimeter of Lots 1, 2, 3, and 4,Block 1, Winds Crossing. Public Hearing: Winds Crossing Administrative Plat Chairperson Droste opened the public hearing on the application by Winds' Crossing Homeowners Association for an Administrative Plat. The recording secretary has placed the Affidavit of Publication and Affidavit of Mailing and Posting of a Public Hearing Notice on file with the City. Nir. Pearson explained the purpose of this application is to resolve setback deficiencies for two quad buildings located in Winds Crossing adjacent to the ponding drainage area along Chippendale Avenue. Presently,the quad units do not meet the 30' setback requirement and are nonconforming. By expanding the townhome properties with 1/4 acre from Outlot A, the setback issue would be resolved. The city would retain an easement over the ponding area. Chairperson Droste opened the floor to the applicant. There were no comments. Chairperson Droste then opened the floor to the public. Dan McNultv, 15670 Cicerone Path, expressed concerns about the city giving up park land, any impact on the park,building into the ponding area, and drainage. Mr. Pearson responded that it is current city practice of having ponds privately owned while preserving them with easements. Mr. Litterer explained that stormwater will remain managed by the city. Carita Green, 15604 Cornell Trail, inquired about the financial responsibilities for this application. Mr. Pearson indicated that all costs associated with this application will be the responsibility of the townhome association. MOTION by Tentinger to close the public hearing. Seconded by Shoe-Corrigan. Ayes: Droste, Shoe-Corrigan, Weisensel,Klassen, and Tentinger. Nays: 0. Motion carried. MOTION by Weisensel to recommend that the City Council approve the replat subject to the provision of an easement retained over the ponding area which will become parts of lots 1, 2, 3, and 4, Block 1, Winds Crossing. Seconded by Tentinger. Ayes: Shoe-Corrigan, Weisensel, Klassen, Tentinger, and Droste. Nays: 0. Motion carried.
