The Phase 2 Improvements for the McNamara Addition include the converting of the ditch
section to a urban section on CSAH 42 between Chippendale Avenue and Shannon
Parkway. Due to requirements of the Dakota County Highway Department, the
Contractor would be limited to working during normal working hours between 9:00 a.m.
and 3:00 p.m. on utility work on CSAH 42. This is due to the amount of traffic during
the peak rush hours on CSAH 42 and County policies requiring four lanes being open
during these times. If these normal working hours were followed, the CSAH 42 traveling
public would be hindered with lane changes and a slow work zone for approximately 4-6
weeks.
The Contractor has requested to be allowed to work at night between the hours of 8:00
p.m. to 6:00 a.m. He also would then totally close CSAH 42 and detour traffic onto
151 st Street between Shannon and Chippendale. By doing this he believes he can get the
pipe work complete on CSAH 42 in approximately 8 days. Staff feels this is a fair request
and will have less of an impact on the public.
Chapter 7 of the City Code has specific hours allowing construction activities between
7:00 a.m. and 10:00 p.m. Monday through Friday. However, the City can grant approval
for working outside of those regulated hours. The purpose of this item is a formal request
to allow the contractor, Ryan Contracting, Inc., to work between the hours of 8:00 p.m.
to 6:00 a.m., Monday through Friday to complete this project in a timely manner.
If Councif does move forward with the recommendation, Staff will notify the public
through the three newspapers.

9-7-1: APPLICATION OF PROVISIONS: For the purposes of
general prohibition relating to construction activities, no
person shall make or cause to be made any distinctly and loudly audible
noise that unreasonably annoys, disturbs, injures, or endangers the
comfort, repose, health, safety or welfare of any person which impairs their
right of enjoyment of property or affects their property's value. This general
prohibition is not limited by the specific restrictions of the following sections.

9-7-2: CONSTRUCTION HOURS:
A. Specific Prohibitions: Construction activities described below shall be
restricted to the hours of seven o'clock (7:00) A.M. through ten
o'clock (10:00) P.M. Monday through Friday, seven o'clock (7:00)
A.M. to seven o'clock (7:00) P.M. on Saturdays and nine o'clock
(9:00) A.M. to five o'clock (5:00) P.M. on Sundays. Except for
emergencies or conditions for which the City has granted approval,
the following activities are prohibited outside o sai regu ate
working hours
1. Construction activities related to buildings and structures,
excavations and grading projects and roadways and utilities. See
Rosemount Zoning Code section 14.8 for regulations on mineral
extraction and mining activities.

2. Construction activities involving the operation of appiiances, tools,
generators, compressors, or chainsaws powered by electric, electric
motors, internal combustion engines or compressed air. (Ord.

9-7-3: EXCEPTION FOR EMERGENCY WORK: Noise created
exclusively in the performance of emergency work to preserve
the public health, safety, or welfare, or in the performance of emergency
work necessary to restore a public service or eliminate a public hazard shall
be exempt from the provisions of this Chapter for a period to be established
by the administrative authority. Persons responsible for such work shall
inform the issuing authority of the need to initiate such work, or if the work
is commenced during nonbusiness hours of the City, at the beginning of
business hours of the first business day thereafter. Any person responsible
for such emergency work shall take all reasonable actions to minimize the
amount of noise. (Ord. XV111.10, 9-2-1997)
9-7-4: ENFORCEMENT AND PENALTIES:
A. Enforcement Duties: The Rosemount Police Department and the
Protective Inspections Division of the Community Development
Department shall enforce the provisions of this Chapter.
Representatives of said Departments shall make all reasonable
efforts to prevent violations of this Chapter.
B. Penalties: Every person who violates any provision of this Chapter
shall be deemed guilty of a misdemeanor offense in accordance with
Minnesota Statutes, section 609.02. Each act of violation or each
day a violation occurs or continues shall constitute a separate
