The second additon of Biscayne Pointe is ready for approval; it conforms to the approved preliminary plat.
RECOMMENDED ACTION: MOTION to Approve a Resolution Approving the Final Plat for Biscayne
Pointe Second Addition.

A RESOLUTION APPROVING THE FINAL PLAT FOR
BISCAYNE POINTE SECOND ADDITION
WHEREAS,the Community Development Department of the City of Rosemount received an
application for final plat approval submitted by Heritage Development of MN, Inc. as required
by ordinance for the purpose of a residential development on land legally described as:
Outlot A, Biscayne Pointe,Dakota County,Minnesota.
WHEREAS,the Planning Commission of the City of Rosemount reviewed the final plat
application for Biscayne Pointe Second Addition at their regular meeting on May 25, 1999; and,
WHEREAS,the Planning Commission adopted a motion to recommend approval of the final
plat to the City Council as required by the Subdivision Ordinance; and,
WHEREAS,the City Council of the City of Rosemount reviewed the final plat application as
required by the Subdivision Ordinance on July 6, 1999.
NOW, THEREFORE,BE IT RESOLVED,the City Council of the City of Rosemount hereby
approves the final plat for Biscayne Pointe Second Addition subject to conformance with the
conditions of Resolution 1997-52.

A RESOLUTION APPROVING THE PRELIMINARY PLAT
FOR BISCAYNE POINTE
WHEREAS,the City of Rosemount received an application for approval of the Biscayne Pointe
preliminary plat; and
WHEREAS,on June 11, 1996, the Planning Commission of the City of Rosemount reviewed the
Biscayne Pointe preliminary plat and recommended approval subject to conditions; and
WHEREAS, on July 2, 1996, the City Council of the City of Rosemount indefinitely tabled
action regarding the preliminary plat by Biscayne Pointe because the property was not within the
Metropolitan Urban Service Area; and
WHEREAS,Heritage Development purchased the plans from the original developer, Render-
Putnam-Prins Partnership, and has asked that the City Council of the City of Rosemount remove
the Biscayne Pointe preliminary plat from the table for final disposition.
NOW,THEREFORE,BE IT RESOLVED,the City Council of the City of Rosemount does
hereby approve the Biscayne Pointe preliminary plat subject to:
1. Incorporation of recommendations relative to grading, utilities and easements identified
by the Public Works Department;
2. Incorporation of recommendations relative to the Parks and Recreation Committee for
park dedication, sidewalks and trail linkages;
3. Rezoning of the preliminary plat area to R-1 Single Family Residential (Detached); and
4. Conformance with the subdivision ordinance requirements for final plat approval
including execution of a development agreement to secure the public improvements,
landscaping and potential future phasing considerations.
ADOPTED this 3rd day of June, i997 by the Ci ouncil of the City of Rosemount.

MOTION by Dros to approve the May 11, 1999 ar Planning Commission Meeting
Minutes. Seco ed by Tentinger. Ayes: Tentinger,Droste; e-Corrigan and WeisenseL
Present: Kl en. Nays: 0. Motion carried. Commissioner Klassen ' icated she reviewed the
audio ta of the May 11, 1999 meeting that she did not attend.

New Business: Biscavne Pointe Second Addition Final Plat
Mr. Pearson presented the Final Plat for Biscayne Pointe Second Addition, located east of
Biscayne Avenue and north of the railroad tracks. This phase of the Biscayne Pointe
development consists of 63 lots. One change from the preliminary plat is the eliinination of a
cul-de-sac on the eastern edge due to a pipeline easement,resulting in the loss of one lot.
Otherwise, the final plat is consistent with the approved preliminary plat.
MOTION by Tentinger to recommend that the City Council approve the final plat for Biscayne
Pointe Second Addition subject to conformance with the conditions of Resolution 1997-52.
Seconded by Klassen. Ayes: Tentinger,Droste, Shoe-Corrigan, Weisensel, and Klassen. Nays:
0. Motion carried.
MOTION by Droste to recess the meeting unti17:00 p.m. Motion carried unanimously.
