This section adopts"option 8a" as a special fire protection requirement for certain occupancy classifications that exceed 5,000 square feet in gross floor area. This ordinance is being proposed in order to address situations in eastern Rosemount where new building projects may be financially penalized for the new water tower being planned for 2000. This penalty is possible for some businesses, such as Wayne Transports, since Section 9 requires the installation of an on-site water reservoir and pump for fire suppression purposes (within a short time of the city's new water system being available). The proposed ordinance would amend Section 9-1-1 C. by allowing the option for a commercial/industrial property owner to agree with the city on a variation from the normal code requirements (up to one year). Seven conditions are listed as prior requirements if a business chooses this option. AN ORDINANCE RELATING TO FIRE SUPPRESSION SYSTEMS; AMENDING ROSEMOLTNT CITY CODE SECTION 9-1-1 C. THE CITY COUNCIL OF THE CITY OF ROSEMOUNT ORDAINS AS FOLLOWS: � Section 1. Rosemount City Code Section 9-1-1 C. is amended to read as follows: C. Special Fire Protection Systems: As authorized by Minnesota Rule part 1306.0100 subpart 2, the sprinkler system requirements of Minnesota Rule part 1306.0100 subpart 3, with the selection of option Item "8a", are hereby adopted without change and incorporated as part of the Building Code for the City. In the case of commercial or industrial properties, the Council may, upon application by the owner, allow occupancy without completed automatic sprinkler systems subject to all of the following conditions. 1. The municipal water supply system is not currently available, but the Council has determined that it is expected to be made available within one year of the date of building occupancy. 2. A building sprinkler system shall be constructed prior to issuance of a certificate of occupancy which is prepared for connection to the municipal water supply system and the owner has executed an agreement in a form satisfactory to the City Council that the building's sprinkler system will promptly be connected to the municipal water supply system upon availability. 3. The owner has demonstrated to the satisfaction of the building official that an on- site water supply system for the building's sprinkler system is feasible, and the owner executes an agreement in a form satisfactory to the City Council that if the municipal water supply system is not made available within one year of occupancy, the on site water supply system will be constructed and connected to the building's sprinkler system. Construction of an on site water supply system may be waived by the City Council if it determines that availability of the municipal water supply system is imminent and that construction of the on site water system would be unreasonable given the needs of the public, the expense of the system and the expected date of completion of the municipal water supply system. 4. The property owner agrees to hold the City of Rosemount harmless from any actions that relate to fire protection at its facility prior to connection to the municipal water supply system or an approved on site water supply system. 5. The property owner executes a petition for the municipal water supply system and a waiver of assessment appeal for costs associated with the system. CLL-168169 RS215-4 6. The building and site plans associated with the proposed new building, building � addition, or occupancy reclassification change have been approved by the City of Rosemount and the Council has determined that delay in connecting the sprinkler . system does not pose an unreasonable hazard. 7. Occupancy prior to connection of the building sprinkler system to a water supply system will not be permitted in M occupancies as defined in the Uniform Building � Code. Section 2.
