Dear Mr. Burt:
As you know,the undersigned represents the landowners of the property generally referred
to as the Kelley Trust Property in the City of Rosemount. The City is currently considering a
development plan offered by Contractor PropeRy Developers Company through its representative
Homer Tompkins. The City is also currently considering an amendment to the Comprehensive
Guide Plan for the City of Rosemount. It is my understanding that the proposed amendment to the
Comprehensive Guide Plan,which would include a Comprehensive Guide Plan change to the
Kelley Trust Property,will be considered by the Rosemount City Council at a meeting on February
9, 1999. As a representative of the property owner, I am greatly concerned that the City Council
may take action which will have a significant detrimental effect on the property.

Comprehensive Guide Plan Amendment text which would, if approved, be applicable to the Kelley
Trust Property. We have not been provided with a complete copy of the proposed Comprehensive
Guide Plan Amendment which will be forwarded to the Metropolitan Council for its review. It is
imperative that I receive a complete copy of the proposed Comprehensive Guide Plan Amendment
as soon as possible. Please contact me as soon as you receive this letter and I will arrange for a
messenger to come to the Rosemount City Hall to pick up a complete copy of the proposed
Comprehensive Guide Plan Amendment.
Based upon information provided to me,I have determined that it is important for the
landowner to have expert testimony to present to the City Council with regard to the financial
impact on the Kelley Trust Property if a proposed Comprehensive Guide Plan Amendment is
approved which significantly reduces the potential density per acre in the development of the Kelley

Trust Property. Additionally,I believe it is necessary for the property owner to provide testimony to
the City Council concerning the fiscal impact on the City of Rosemount should the K�lley Trust
Property not be allowed to develop to its maximum potential density. In order to properly address
these issues, it will not be possible for us to have those witnesses available to testify at the February
9, 1999 hearing. On behalf of the property owner,I am requesting that the City Council's
consideration of the Comprehensive Guide Plan Amendment, specifically relating to the Kelley
Trust Property,be delayed at least an additional two weeks to allow the property owner to
adequately prepaze its case for the City Council's consideration.
Please advise me as soon as possible whether or not the City of Rosemount will agree to
table consideration of the Comprehensive Guide Plan Amendment for the Kelley Trust Property to
allow the property owner an additional two weeks to prepaze for a hearing.
