Action: Recommendation of Approval(unanimous) SUMIVIARY: This Industrial Planned Unit Development is necessary because of the development of a new trucking terminal for Wayne Transports and expansion of the parking lot for Fleet Development. In addition, a 4.69 acre remnant is being added to the Solberg Aggregate site. Lastly, all three sites will front along a new frontage road(Conley Avenue) connection CSAH 42 with 140t�St.E. The PUD is required by ordinance because of the combination of multiple uses and parcels. Fleet Development already has site plan approval for their building which is almost finished, and most of their site improvements. However,Fleet is expanding their parking lot to the west and needs setback variances along the ne�v frontage road. At the same time, Wayne Transports is requesting similar variances for parking lot setbacks along the west side of Conley Avenue and US 52. The attached memo details the concept PUD with emphasis on the Wayne Transport site plan issues. PLANNING COMMISSION PUBLIC HEARING Two residents expressed concerns about Conley Avenue. The location of the intersection with CSAH 42 should align with future frontage roads on the south side. Also,there may be allowance for a driveway connecting Conley Avenue to the golf course. Planning Commissioners discussed landscaping in particular,and the image along US 52. The Commissioners agreed that landscaping should be concentrated along the US 52 edge,rather than extensive landscaping along Conley Avenue. One Commissioner questioned the timing of the PUD review in light of a pending tax increment financing request. Recommended Action: Motion to adopt a resolution approving the concept PUD requested by C-70 Construction for Wayne Transports,Fleet Development and Solberg Aggregate. -and- Motion to adopt an ordinance rezoning the property to IG,General Industrial in conformance with the Comprehensive Plan. CITY COUNCIL ACTION: City of Rosemount Ordinance No. B- AN ORDINANCE AMENDING ORDINANCE B CITY OF ROSEMOUNT ZONING ORDINANCE Construction 70, Inc. THE CITY COUNCIL OF THE CITY OF ROSEMOUNT, MINNESOTA, ORDAINS AS FOLLOWS: ct'on 1. Ordinance B, adopted September 19, 1989, entitled "City of Rosemount Zoning Ordinance,"is hereby amended to rezone from AG, Agriculture to IG, General Industrial, the following described property located within the City of Rosemount, Minnesota, to-wit: The West Half of the Northwest Quarter of Section 30,Township 115, Range 18,Dakota County, Minnesota,EXCEPT: l. A tract of land in the Southwest Quarter of the Northwest Quarter of said Section 30 described as follows: Commencing at a point on the south line of said Northwest Quarter 700.53 feet east of the southwest corner thereof; thence north perpendicular to the last described line 50.00 feet to the actual point of beginning of the land to be described; thence continuing north on the last described line, 832.25 feet; thence west 646.79 feet to the easterly boundary of State Trunk Highway No. 56; thence South 16 degrees 31 minutes East along said Highway Boundary 868.07 feet; thence east 400.00 feet to the point of beginning, according to the Government survey thereof, Dakota County, Minnesota. 2. CITY OF ROSEMOUNT DAKOTA COUNTY, MINNESOTA RESOLUTION 1999- A RESOLUTION APPROVING THE CONCEPT PLANNED UNIT DEVELOPMENT FOR CONSTRUCTION 70, INC. WHEREAS, the Community Development Department of the City of Rosemount received an application from Construction 70, Inc. for approval of a concept planned unit development located at 3550 E. 140' St. in Rosemount, Minnesota; and WHEREAS, on February 23, 1999, the Planning Commission of the City of Rosemount reviewed the Concept Planned Unit Development for Construction 70, Inc. and adopted a motion to recommend approval, subject to conditions, to the City Council. WHEREAS, on April 6, 1999, the City Council of the City of Rosemount reviewed the Concept Planned Unit Development for Construction 70, Inc. NOW, THEREFORE, BE IT RESOLVED, the City Council of the City of Rosemount hereby approves the Concept Planned Unit Development for Construction 70, Inc., subject to the following conditions: A. Wayne Transports' Parcel: The office and maintenance buildings shall be constructed of 100% masonry exterior materials with some architectural design features (e.g., color and bands). 2. Screening on the north side of the parking lot will be accomplished by an 5-10 foot high berm with grouped trees on the northerly slope; existing significant trees shall be protected and preserved. 3. Variances to allow a 15 -foot setback on the east side and a 35 -foot setback on the west side of the parking/storage area will be permitted with additional landscaping as follows: (a) Overstory trees shall be planted along the west side of the parking/storage area spaced 50 -feet apart with varied clusters of evergreen/overstory trees. (b) Overstory trees shall be planted along Conley Avenue spaced a minimum of 100 feet apart on private property. (c) Overstory and evergreen trees shall be planted in clusters on the north side of the parking/storage area, including the berm's slope. (d) Shrubs shall be planted on the east side of the office building along its perimeter; evergreen/overstory trees shall be planted directly east of the office building. Resolution 1999- B. Fleet Development's Parcel: 1. Variances to allow a 15 -foot setback for the parking/storage area on the west side will be permitted with additional landscaping as follows: (a) Overstory trees shall be planted along Conley Avenue spaced a minimum of 100 feet apart on private property. (b) Evergreen and overstory trees shall be planted along the north side of the new parking area. (c) The new auto parking area at the northwest corner of this site shall be evaluated for a design change that would include one-way parking for automobiles, resulting in an increased setback (greenspace) along Conley Avenue. (d) If the ponding area south of Fleet's parking area is removed and added to Fleet's property, then the landscape plan shall include additional tree plantings in that area. C. Other Conditions: 1. All lighting for parking lots, storage areas and building security shall be directed away from adjacent properties with cut-off style down -lighting design. 2. All landscaping shall include the following minimum sizes: 2.0-2.5 inch caliper for overstory trees, 6 feet in height for evergreen trees, and 1/3 of mature size for shrubs. 3. The PUD shall conform with the city's Subdivision Ordinance. 4. The PUD shall incorporate recommendations of the Public Works Department concerning grading, streets and public utilities. 5. The PUD shall conform with all applicable building and fire codes. 6. The PUD area shall be rezoned from Agriculture (AG) to General Industrial (IG). Nir.Pearson presented the Planned Unit Development request of Construction 70, consisting of a new trucking temunal for Wayne Transports,expansion of the parking lot for Fleet Development, and addition of a 4.69 acre remnant to the Solberg Aggregate site. Both Fleet and Wayne require variances for setbacks along Conley Avenue. In exchange for the variances, extensive greenspace and a higher performance of landscapin�are requested. Chairperson Droste opened the floor to the applicant. 7oe Eschenbacher of Wayne Transports was present. . There was a discussion concerni.ng the effect of a pending TIF application on the PUD. Landscaping and any envuonmental impact was also discussed. Mr.Eschenbacher expressed Wayne's commitment to landscaping and confirmed there would be no outside storage. Chairperson Droste opened the floor to the public. Dave Anderson,Fleet Development,concurred with Mr•Eschenbacher regarding the desire to make the area presentable. • Discussions continued concerning the Fleet parkiu8 lot. The pazking lot will have curb &gutter and be paved, except for an approximate 150'x150'loading ramp azea. Marlin Rechtzi�el,was concemed with the location of the frontage road connection with Hwy 42 and suggested it should be moved to align with the road to the south. Plans for the Hwy. 52/42 interchange were discussed. Russ Rahn,Rich Valley Golf Course,inquired about a driveway off Conley Ave. and expressed concems regarding water runoff. Commissioner Klassen noted premature elements of this project,including TIF issues for Wayne Transports and expansion of the Solberg site. Commissioners discussed landscaping requirements along Hwy. 52,including parking lot indentations to allow clusters of trees. Commissioners suogested movi.ng the vegetation away from the interior boundaries to side along the highway corridor. The remaining 28.3 acres in between was purchased from JoAnn and Marlin Rechtzigel by Koch Refining Company. Koch is interested in cooperating with Wayne Transport to relocate their facility currently in Inver Grove Heights to this site in Rosemount. The move is necessary because Wayne Transports' current site has very limited expansion opportunities. Wayne Transport will occupy slightly less than 20 acres on the northwest corner of the site along side of US 52. A new frontage road will separate Wayne from Fleet Development, and provide access for both sites. This frontage road is needed because of the eventual closure of access to US 52 from 140th Street East. The remnants of the property not utilized by Wayne will be combined with Fleet Development and Solberg Aggregate. The General Industrial district standards require Planned Unit Development for projects involving multiple buildings,parcels and/or uses. An obvious benefit of the PUD process is to grant setback variances for both parking lots along Conley Avenue in return for landscaping concessions. Trucking terminals are pernutted uses in the General Industrial District. WAYNE TRANSPORTS SITE PLAN REVIEW The Wayne Transports Trucking Terminal involves two buildings and extensive outdoor trailer parking. Access occurs via two driveways connecting with the proposed Conley Avenue, which will be constructed in the summer of this year. The two buildings consist of a 9,600 sq. ft. office building and a 26,500 sq. ft. Maintenance building. The two story office building will be constructed of colored/textured CMLJ(concrete block). The maintenance building will consist to architectural precast concrete panels. The buildings exceed the materials requirements of the General Industrial District by a substantial February 23, 1999 Planning Commission Reviews-General Industrial Concept PUD Page 2. margin. The farm buildings located on the northern edge of the site (along 140th Street East) should be demolished, especially since the space in needed for green space and ponding requirements. Landscaping requirements for the site comes to 117 foundation plantings and the Planning Commission's recommendation. Staff recommends that additional landscaping in the form of boulevard and evergreen trees be planted on the edges of the parking lot and along the various right-of-ways to screen the extensive trailer parking and as a trade-off for the setback variances. FLEET DEVELOPMENT Fleet development is expanding their parking capabilities with a new lot west of their current site for both trailers and cars/semi tractors. The geometry of the site(purchased for the Rechtzigels) allows for only a 15 foot setback along the proposed Conley Avenue. This is a result of the maneuvering space requued for the semis. The site dimensions were fixed along with the original transaction, and there is no stated ability to further compress the site. SOLBERG AGGREGATE The Solberg Aggregate site will expand by more than four acres. The proposed Conley Avenue Right-of-Way(ROV�will be located approximately 255 feet east of their current ten acre site. No development plans are available at this time. Conley Avenue gives Solberg the ability to relocate their driveway from CSAH 42 to the new frontage road. SETBACK VARIANCES Standards for parking setbacks in the General Industrial District. Front�ard ide ard ear ard Required- 40 feet 25 feet 50 feet Wayne Trans. 15 feet @ Conley Ave. 50 feet @(south pty.line.) 25 feet @ US 52 ROW. Fleet Development 15 feet @ Conley Ave. N/A 35 feet @ Golf Course (originally a side lot line). The PUD process will allow the granting of variances if the Planning Commission is willing to accept extraordinary.landscaping in retum. Because chain-link security fences are proposed, opaque walls which would be preferred, are impractical. Green space requirements are provided for by both sites, given the 250 foot setback of Wayne Transport from 140th Street. Fleet Development will retain a large ponding azea south of their parking area and a"pan handle" along Conley Avenue down to CSAH 42. FINDINGS FOR PLANNED UNIT DEVELOPMENT In approving the Concept Plan, the Planning Commission must find as follows and forward its findings to the City Council. 1. The Plan provides sufficient useable open space and evidences a substantial preservation of natural features to warrant the granting of variances throueh Planned Unit Development. Planned Unit Development is required for this project. While preservation of natural features is not applicable, substantial setbacks and ponding areas along 140th Street East(Wayne Transport) and the Fleet Development ponding area adjacent to the Golf Course create extensive open space and opportunities for extraordinary landscaping. 2. The Plan complies with the intent of the Comprehensive Guide Plan. The trucking terminals are permitted uses in the General Industrial District and rezoning the land still zoned Agriculture u consistent with the Comprehensive Guide Plan. 3. The proposed development will not be detrimental to sunounding properties. The opportunity to require extensive landscaping on the outer edges of both Fleet Development and Wayne Transport should mitigate any objectional effects of the extensive parking lots. 4. The Plan is more creative and will provide a better living,working or shopping environment than is possible under strict ordinance requirements. The PUD is required by ordinance and the variances are needed for the maneuvering of tractor- trailer combinations. The need for the variances gives the city the opportunity to require extraordinary landscaping that would not otherwise be available, especially for screening large trailer parking areas.
