PREPARED BY: Dan Rogness, Community Development Director �TE� � � � ATTACHMENTS: Proposed Ordinance Amendment �/�� An application was received from the Dairy Queen to amend the city's Sign Ordinance. This request would allow off-premises signs (not billboards) within commercial areas of the city. More specifically,the Dairy Queen wants to install a DQ sign in conjunction with a pylon sign for the future business at the former Tom Thumb property along Highway 42. Staff proposed an amendment with standazds for all off-premises signs within the Commercial, Business Park and General Industrial zoning districts. In order to be specific to this new type of sign, staff is proposing that it be defined and designated as an"Off-premises Business Sign". The Planning Commission held a public hearing on the matter, and is now recommending the attached proposed amendment to the City Council. This proposed amendment includes numerous standards that would provide a strong measure of control. For example, if an off-premises sign were to locate along Highway 42, it would need to be on the existing free- standing sign of the on-premises business with no additional total sign area allowed. Furthermore, the off- premises sign would be no larger than the on-premises sign and be of the same design quality with no directional symbols or lettering. The original proposed amendment of the Sign Ordinance also included changes to allow off-premises signs for subdivision developments under construction. However, this was removed from further review and discussion due to the applicant's request concerning business signs only, but it will be processed at a later date. RECOMMENDED ACTION: For Discussion Only. PROPOSED SIGN ORDINANCE AMENDMENT Rosemount, Minnesota The proposed sign ordinance amendment would allow another business to use other allowable business signage for off-premises advertising within zoning districts for Commercial, Business Park and General IndustriaL 10.1.B. OFF-PREMISES Any sign that directs attention to the name of a BUSINESS SIGN: business not located on the premises on which such siqn is located. An off-premises business siqn is part of an on-premises free-standinq siqn and is not considered an advertisinq (billboard) siqn. 10.2.E. Signs Allowed by Permit in Commercial and BP Districts: 7. Off-premises business siAns provided each sign meets the followinq standards: a. Only one off-premises business sign shall be allowed on an on- premises free-standing siqn� no off-premises business siqns shall be allowed as wall siqns. b. The maximum allowable area of the free-standinq siqn shall not be increased bv the addition of the off-premises business siqn. c. No more than fifty percent (50%) of an on-premises free-standinq siqn or fortv (40) square feet, whichever is less, mav consist of an off- premises business siqn. d. No off-premises business siqn shall be located further than one- thousand feet (1,000') as measured from the off-premises siqn to the closest building point for the advertised business. e. The off-premises business siqn shall only identifv the business beinq advertised with the corresponding business name and/or loqo without the use of directional words or svmbols. f The off-premises business sign shall be constructed of comparable materials as the on-premises siqn with identical liqhtinct for both siqn areas. q The business that is identified on the off-premises business siqn shall be located within the same land use district as identified in the city's comprehensive plan. Off-premises business siqns provided each sign meets the following standards: a. Only one off-premises business siqn shall be allowed on an on- premises free-standing siqn; no off-premises business siQns shall.be allowed as wall siqns. b. The maximum allowable area of the free-standing sign shall not be increased bv the addition of the off-premises business sign. c. No more than fifty percent (50%) of an on-premises free-standing siqn or fortv (40) square feet, whichever is less, mav consist of an off- premises business sign. d. No off-premises business siqn shall be located further than one- thousand feet (1,000') as measured from the off-premises sign to the closest buildinq point for the advertised business. e. The off-premises business siqn shall onlv identifv the business being advertised with the correspondinq business name and/or loqo without the use of directional words or svmbols. f. The off-premises business siqn shall be constructed of comparable materials as the on-premises siqn with identical liqhtinq for both siqn areas. g. The business that is identified on the off-premises business siqn shall be located within the same land use district as identified in the citv's comprehensive qlan. h. No part of an off-premises business sign shall be a reader board siqn.
