Tavern On 42 Liquor License Application CITY OF ROSEMOUNT EXECUTIVE SUMMARY FOR ACTION CITY COUNCIL MEETING DATE: JANUARY 19, 1999 AGENDA ITEM: TAVERN ON 42 LIQUOR LICENSE AGENDA SECTION: APPLICATION OLD BUSINESS PREPARED BY: SUSAN WALSH AGENDA P�� � � B ASSISTANT TO ADMII�IISTRATOR ATTACHMENTS: NONE APPROVED BY: This agenda item was tabled from the January 5, 1999 council meeting at which time a public hearing was held to consider on-sale liquor license and special Sunday liquor license applications from Tavem on 42, Ltd. Owners Donald Fluegel, John and Susan Ursino and Robert Yanz have submitted additional information since the public hearing. This information included the floor plan, further details about the restaurant and additional background information about the o�mers. At a meeting with city staff, the owners implied that they would be willing to change the name of the business and reiterated that the business will primarily be a family restaurant. For your information, State Statutes, according to population, guide the number of on-sale liquor licenses. As of now,Rosemount can have six on-sale licenses; and when the 2000 census takes the city over 10,000, the city can issue up to twelve licenses if it so chooses. In either case, voters can increase the number over and above the number permitted by State law by a referendum. On-sale intoxicating liquor licenses issued to clubs are an exclusion from the license limits permitted by State law. The number of off-sale licenses are determined by the city council except for first class cities which cannot have more tHan one off-sale for each 5,000 population. Based on the applications and supplementary information provided by the applicants, staff recommends approval of the licenses. RECOMMENDED ACTION: MOTION TO APPROVE THE ISSUANCE OF AN INTOXICATING LIQUOR LICENSE AND SPECIAL SUNDAY LIQUOR LICENSE TO TAVERNON 42 LTD FOR THE PERIOD OF MARCH 1, 1999 THROUGH DECEMBER 31, 1999.
