SUMMARY
The former Tom Thumb site on the south east comer of Canada Avenue and CSAH 42 is being redeveloped as a
sit-down restaurant including a lounge area serving liquor. The current zoning of C-1, Convenience
Commercial only permits convenience stores and self-service gasoline sales and accessory uses. The proposed
use of the site requires rezoning to C-4, General Commercial,which permits"Eating and drinking
establishments including drive-ups and taverns." The General Commercial zoning classification provides the
highest flexibility for the redevelopment of the Tom Thumb site. It has the largest list of permitted uses, and
has standards of development appropriate for a suburban site.
The property is guided for Commercial Land Use and Rezoning to C-4, General Commercial would be
consistent with the Comprehensive Guide Plan. The three surrounding properties to the east, south and west are
also zoned C-4, General Commercial (Carlson Tractor, ISD 196, and McDonald's). The property north of
CSAH 42 is R-1 A, Low Density Residential (single family). Most residential properties backing up the CSAH
42 have fences and extensive landscape buffering.
No major exterior improvements to the building are anticipated. There will be modifications to the former
canopy and parking area to enhance parking. The property has landscaping from the previous use.
PLANNING COMMISSION PUBLIC HEARING
On December 22, 1998, the Planning Commission conducted a public hearing for the rezoning. The applicant
and several family members attended. Mr. Don Fluegel(Father-in-law) explained the nature of the tavem, and
indicated a similar establishment in Hastings. No other adjacent property owners appeared to speak at the
public hearing. After discussion regarding parking issues,the Planning Commission adopted a motion to
recommend that the City Council rezone the property to C-4, General Commercial.
RECOMMENDED ACTION:
Motion to adopt an ordinance amending Ordinance B City of Rosmount Zoning Ordinance rezoning the
property at 15040 Canada Avenue to C-4, General Commercial.

THE CITY COUNCIL OF THE CITY OF ROSEMOUNT, MINNESOTA, ORDAINS AS
FOLLOWS:
ection 1. Ordinance B, adopted September 19, 1989, entitled "City of Rosemount
Zoning Ordinance,"is hereby amended to rezone from C-1 Convenience Commercial to C-4
General Commercial, the following described property located within the City of Rosemount,
Minnesota, to-wit:
Lot 1 and the North 150 feet of the West 50 feet of Lot 2, Block 4, South Rose Park
Addition Replat, Dakota County, Minnesota.
ection 2. The Zoning Map of the City of Rosemount, referred to and described in said
Ordinance No. B as that certain map entitled "Zoning Map of the City of Rosemount" shall not
be republished to show the aforesaid rezoning,but the Clerk shall appropriately mark the said
zoning map on file in the Clerk's office for the purpose of indicating the rezoning hereinabove
provided for in this Ordinance and all of the notation references and other information shown
thereon are hereby incorporated by reference and made a part of this Ordinance.

development. irperson Bill Droste called the meeti order at 7:08 p.m. with members
Mark DeBettignies, entinger, Kim Shoe-Co ' and Jeffery Weisensel present. Also in
attendance were Commuru evelopment D� ctor Dan Rogness, City Planner Rick Pearson,
and Civil Engineer pouj Litterer.
Mr. Pearson requested tha nda item 6.A. ount Commons Final Plat be pulled from the
agenda. There were other additions or correction the agenda.
Due to ate start, Chairperson Droste moved agenda items 3 ugh 6 to follow the public
h ngs.
PUBLIC HEARING• TAVERN ON 42 REZONING
Chairperson Droste opened the public hearing for Tavern on 42 Rezoning. The recording
secretary has placed the Affidavit of Publication and Affidavit of Mailing and Posting of a Public
Hearing Notice on file with the City.
Mr. Pearson presented the application of Tavern on 42 to rezone the former Tom Thumb
property to C-4, allowing a restaurandtavern facility. This rezoning would be consistent with the
Comprehensive Guide Plan and surrounding properties.
Chairperson Droste opened the floor to the applicant. John Ursino and Don Fluegel were present
to answer questions. Mr. Fluegel provided a brief description of the plans for the
restaurant/tavern.
Chairperson Droste opened the floor to the public. There were no comments.
MOTION by Droste to close the public hearing. Second by DeBettignies. Ayes: DeBettignies,
Tentinger, Droste, Shoe-Corrigan, and Weisensel. Nays: 0. Motion camed.

Commissioners discussed issues related to overflow parking and recommended that parking
along Canada Avenue from the business driveway to CSAH 42 not be allowed. Mr. Pearson
explained the pazking requirements and indicated the site plan will go through an administrative
review for a building permit. A public hearing will be held for the liquor license.
MOTION by DeBettignies to recommend that the City Council rezone the property at 15040
Canada Avenue to C-4, General Commercial. Second by Tentinger. Ayes: Tentinger, Droste,
Shoe-Com;an, Weisensel, and DeBettignies. Nays: 0. Motion carried.

Mr. Pearson explained e applications submitted by the Dakota Coun concerning a
housing proposal on prop y located north of the National Guard O site, west of Biscayne
Avenue and %z mile north o 45`h St. W. The HRA proposes 60 tal townhome units in the
southern ponion of the prope , with a density of 8 du/ac. T ' omes are proposed for the
northern portion, with an approx' ate density of 3 du/ac, i uding the ponding area. The
Comprehensive Guide Plan design es the property for lic/Institutional use. The proposed
amendment changes the land use des ation to Hig ensity Residential in the southern half
and Urban Residential for the remainde of the pr erty. Also requested is rezoning from
Agriculture to R-3, Medium Density Resi ent' for the proposed 60 rental townhouses and R-2,
Moderate Density Residential for the twinh es.
Mr. Rogness explained this project w ld take t city past 2005 in meeting the projections for
high density housing needs. The ject maintains reasonable mix of housing and deals with
the issue of affordability.

explained the nature the Family Housing Partnership Pro , indicating it was created to
develop affordabl ousing. Ms. Gill displayed pictures of exis ' g HRA developments.

visibility and relatively lazge volumes of traff c and are therefore found along
major streets.

6.10: C-1 CONVEI�tIENCE COI�IlVIERCIAI�DISTRICT:
A. Purpose and Intent:The purpose of the Convenience Commercial District is to
provide convenience shopping and self-service gasoline services to a sub-area
. of the community.
B. Uses Permitted by Right:
1. Self-service gasoline and fuel stations,convenience store,motor fuel station
including accessory car washes subject to the following restrictions:
a. Except for gas pumps, all operations shall be conducted within the
principal building.

� b. Where abutting an"R"District,a screen wall or fence five feet(5') in
height and having ninety percent (90%) opacity shall be required along the �
common property line between the uses. Said fence shall be properly
maintained by the owner or lessee.
c. Pazking and maneuvering areas shall be paved_and curbs six inches
(6")above grade shall be provided no less than five feet(5') from all property
lines which adjoin a public street.
d.The site shall be planned so as not to permit water from a car wash to
run into a public street or accesses thereto.A draina?e system shall be installed
subject to the approval of the City.
e. Pump islands and canopies shall conform to yard requirements or a
min;mum of twelve feet(12')from a street right of way whichever is greater.
f. Parking for employees, customers and stacking shall be provided in � _
accordance with Section 8. � -

A. Purpose and Intent: This District correlates only wi owntown Rosemount
which is intended to serve the entire City.The do town azea is intended to be
a diversified commercial center which off the full range of comparison
goods,sales and services,cultural and ci ' ,entertainment,financial and offices
and public uses.Because the downto �s an area of relatively higher intensity
. development and consists of b ' din�s and uses which pre-date zoning
regulations, the City is intend o play a role in the provision of parking and
related public improvemen us,normal yard,parking and lot requirements
do not apply within this istrict.

Dear Mayor Busho,
I am writing concerning the proposed "Tavern on 42". When we
moved to Rosemount ten years ago from Mankato, my husband and 1
were impressed with the clean, quiet, small town atmosphere we
found in Rosemount. This greatly influenced our decision to locate
here. We are concerned about some of the changes we've seen in �
the community.
I read several articles about the proposed "Tavern on 42" and I am
concerned about the statement that for a restaurant to "make it" in
Rosemount, they need to sell liquor. We already have McDivots,
Shenanigans and City Limits. Why do we need another duplicate of
what we already have?
I am concerned about the kids who go through the DARE program
and then see our community set a negative example by allowing all
kinds of bars to operate here. We need something different coming
in — a nice, clean family restaurant that is alcohol free and preferably
smoke free. I think it would get lots of business.
