City Engineer/Public Works Director �� ATTACHMENTS: Resolution, Drawin , Public Notice APPROVED BY: This item is on the agenda as more or less a housekeeping item which should have been done over twenty years ago. The existing concrete block building, formerly known as Von Hansons, is being purchased by another business. In the title work being completed for the transaction it was discovered that the building is actually built over a portion of an old City public alley. The attached drawing shows the alley-way in dashed lines on the western twenty feet of the property and the block building overlaps the alley-way by approximately ten feet. This alley-way was utilized by the City prior to the construction of this building but no longer provides a public purpose. This vacation should have taken place prior to the construction of this building which was approximately in 1977. Staff will provide a brief overview for the public and recommend the action be taken as described below. RECOMMENDED ACTION: MOTION TO ADOPT A RESOLUTION CAUSING A PUBLIC ALLEY VACATION ON LOT 61 , AUDITOR'S SUBDIVISION NO. 1 . COUNCIL ACTION: 3 � CITY OF ROSEMOUNT DAKOTA COUNTY,MINNESOTA RESOLUTION 1999- A RESOLUTION CAUSING A PUBLIC ALLEY VACATION ON LOT 61,AUDITOR'S SUBDIVISION NO. 1 WHEREAS, a public hearing was scheduled and held on the 19th of January, 1999 after due publication as required by law,and all interestedpersons were given an opportunity to be heard; and WHEREAS, it appears that it will be for the best interest of the City of Rosemount to vacate said right-of-way as it does not serve a public purpose. NOW THEREFORE BE IT RESOLVED,that the following right-of-way is hereby vacated, to- wit: The west 20 feet of the southerly 286 feet of the northerly 356 feet of Lot 61, Auditor's Subdivision No. l, City of Rosemount, County of Dakota, Minnesota. BE IT FURTHER RESOLVED,that the City Attorney shall prepare a notice of completion of the proceedings and necessary Quit Claim Deeds which shall contain the name of the City,identification of the vacation and a statement of the time of completion thereof, and shall present the same to the County Auditor and then file a copy with the Register of Deeds.
