Marotzke; Earl and Florence Bester Location: Approximately 140 acres (combined) between Biscayne and Bacardi Avenues and north of White Lake Acres (126th Street area). Cunent Zoning: Agricultural Preserve (AGP) Comp. Guide Plan: Agriculture Proposed Comp. Guide Plan: Rural Residential SUMMARY This action is necessary to re-enroll these properties in the Agricultural Preserve program. These two farms participate in the Agricultural Preserves program which provides incentives to maintain agricultural use of land, supported by State Statutes. To qualify, a forty acre (minimum)property must be involved in agricultural production, and density is limited to one dwelling unit per forty acres. Enrollment involves an eight-year contractual commitment to comply with the requirements. Both properties have been checked, and comply with the requirements. The Council will recall that The Marotzke farm was the subject of a Agricultural Lot Split early in June of 1997. The five acre parcel created for Hank Marotzke (son) is too small for the program and has been excluded. The remaining Marotzke farm still qualifies. The attached resolutions certify the various Bester and Marotzke properties as eligible for the Agricultural Preserve designation. RECOMMENDED ACTION: Motion to adopt a resolution certifying lands eligible for Agricultural Preserves. Bester Properry WHEREAS, the Metropolitan Agricultural Preserves Act(Minnesota Statutes 473H:01 et seq.) provides for establishing Agricultural Preserves; and WHEREAS, the Act requires that to be eligible land must be planned for the long-term agricultural use according to the local comprehensive plan adopted pursuant to Minnesota Statutes 473.851 (et seq.); and WHEREAS, the Act further requires such property to be zoned for long-term agricultural use with a maximum residential density not to exceed one unit per 40 acres; and WHEREAS, the City of Rosemount has planned and zoned certain areas as required by the Act. NOW, THEREFORE, BE IT RESOLVED, the City Council of the City of Rosemount hereby certifies that all of the areas so marked on the map appended are eligible for designation as agricultural preserves. BE IT FURTHER RESOLVED, the Clerk shall file a copy of this resolution with the Metropolitan Council. ADOPTED this 19`h day of January, 1999,by the City Council of the City of Rosemount.
