SUMMARY
Safety-Kleen has requested an amendment to the Interim Use Permit to allow the transfer of used oil from
trucks to rail tank cars for shipping to an oil recycling company in East Chicago.
Currently, Safety-Kleen leases a rail transfer site from the Burlington Northern/Santa Fe Railroad (BNSF) in
Minneapolis. The IUP amendment would allow Safety-Kleen to utilize an existing rail spur located on the
Rosemount Site with minimal improvements required. Because of the specificity of the IUP for the industrial
containment facility, an amendment is required to specifically allow the oil transfer process.
There is really no direct connection with the containment facility. The used oil transfer is another function of
Safety-Kleen and utilization of the rail spur at the Rosemount site is more cost-efficient than the current
arrangement with BNSF. The rail spur is currently under utilized and minimal improvements are required for
the transfer procedure. The spur is long enough, with paved access to and along side. �leeded improvements
include: additional paving (with fill) along the entire length of the spur; "drip pans" in the tracks for catching
spilled oil; and curb & gutter and other such containment features to contain potential spills and for channeling
of traffic. Attached diagrams illustrate the specific improvements.
The anticipated volume of oil shipped from the site is 150,000 gallons of oil each month. This will result from
deliveries of 6-8 tnicks a day, five days a week. This amounts to a 14% increase from the current traffic
volumes of an average of 55 trucks per day.
PLANNING COMMISSION PUBLIC HEARING
One resident attended the public hearing, although he was not an affected adjacent property owner. He asked
questions regarding the paved surface materials and maintenanc � The Planning Coinmissioners were
concerned about contingency plans and safety. Two Commissi.� �:•rs suggested that two persons should be
in����lved in the transfer process for safety reasons. Safety-Kleeir officials explained in detail the nature of the
eqE:. :rLent and training of the driver/operators, which satisfied the concerns of the Commissioners.
RECOMMENDED ACTION:
Motion to adopt a resolution approving the Interim Use Permit Amendment for Safety-Kleen to include the
oil transfer and authorize staff to prepare the amended IUP for execution.

A RESOLUTION APPROVING
THE AMENDMENT TO THE INTERIM USE PERMIT
FOR SAFETY-KLEEN
WHEREAS, the Planning Department of the City of Rosemotmt received an application for
approval of an amendment to the Interim Use Permit for Safety-Kleen to allow oil transfer use;
and
WHEREAS, the Planning Commission of the City of Rosemount conducted a public hearing on
October 26, 1999, as required by the subdivision ordinance for the purpose of receiving
testimony regarding the requested amendment; and
WHEREAS, the Planning Commission adopted a motion to recommend approval of the
amendment to the Interim Use Pernlit for Safety-Kleen with conditions; and,
WH�REAS, on November 2, 1999, the City Council of the City of Rosemount reviewed the
recommendation forwarded by the Planning Commission;
NOW, THEREFORE, BE IT RESOLVED, the City Council of the City of Rosemount hereby
approves the amendment to the Interim Use Permit for Safety-Kleen to allow the oil transfer use,
subject to:
1) Compliance with all applicable recommendations standards required by the Minnesota
Pollution Control Agency and the Dakota County Office of Environmental Heath;
2) Provision of curb & gutter and conformance with all recommendations relative to erosion
control, grading and paving by the Engineering/Pubic Works Department;
3) Conformance with all applicable fire code requirements; and
4) Safety-Kleen s11a11 be required to notify the City in the event of a significant spill of recycled
oil at the facility.

Regular Meeting �Vlinutes October 26, 1999
Pursuant to due call and notice thereof,the Regular Meeting of the Plaruung Commission
was duly held on Tuesday, October 26, 1999. Chairperson Bill Droste called the meeting
to order at 6:35 p.m.with members Jay Tentinger,Jeff i RWk Pear o and Kim Shoe-
Conrigan present. Also in attendance was Crty Plann
There were no additions or corrections to the agenda.
MOTION by Droste to approve the October 12, 1999 Regular Planning Commission
Meeting Minutes. 5econded by Weisensel. Ayes: Tentinger,Droste, Shoe-Corrigan and
Weisensel. Nays: 0. Motion carried.
Department Announcements
Commissioners noted the actions taken by the City Counci ea��he Met Councl for

Public Hearin : Safe -HIeen Interim Use Permit Amendment
Chairperson Droste opened the public hearing on the application by Safety-Kleen for an
amendment to its Interim Use Permit. The recording secretary has placed the Affida�it of
Publication,Mailing, and Posting of a Public Hearing Notice on file with the City.
Mr.Pearson summarized the request by Safety-Kleen to amend its IUP to allow the
transfer of oil from trucks to rail tank cars for shipping to an oil recycling company in
Chicago. Mr. Pearson reviewed the rail spur location on the Safety-Kleen site and
showed pictures of its current oil transfer operation in St.Paul. Improvements to the site
�vould include additional concrete paving along the entire length of the spur, curb &
gutter, and"drip pans"in the tracks for catching any spilled oil. These improvements,

Safety-Kleen representatives responded to questions conceming the drip pan capacity,the
process for rail car loading&removal, safety measures, agency oversight, inspections
and licensing,the composition of the materials transferred, and parties responsible far
spill cleanup. Site improvements and existing berming were reviewed.
Coinmissioner Tentinger requested additional language be included in the IUP
amendment that requires notification to the city of any substantial oil spill.
Chairperson Droste opened the public hearing.
Jeff Fadden, 12231 Biscayne Ave.,had questions concernin�the dimensions of the pad
and the cleaning process of the cement pavement.
MOTION by Droste to close the public hearing. Seconded by Tentinger. Ayes: Droste,
Shoe-Corrigan,Weisensel, and Tentinger. Nays: 0. Motion carried.
Commissioner Shoe-Corrigan confirmed the city has received no complaints about non-
compliance by Safety-Kleen under its existing permit.
Commissioner Weisensel indicated he has had experience working with Safety-Kleen on j
other projects and expressed his confidence in the company and its safety measures. '
MOTION by Droste to recommend that the City Council approve the Interim Use
Amendment for Safety-Kleen to include the oil transfer use subject to: 1) Compliance
with all applicable recommendations standards required by the Minnesota Pollution
Control Agency and the Dakota County Office of Environmental Heath; 2)Provision of

S��fet��-I�leen(Rosemount),Inc. (SKR)is requesting modif'ication to the Cit}�of Rosemount Interim Use
Permit to allo�v the facility to use the current rail sicling for loading rail cars«ith used oil destined to
Safety-I�leen recycling facilities. The Safety-T.'�leen Oil ancl Vacuum Ser�zces program collects used oil,
oily�r�ater and non-hazardous liquid wastes for rec}�cling. Currently these wastes collected in the Twin
Cities area are loaded into rail cars in I��inneapolis and shipped to Safety-Kleen's processing facilities.
Safety-Kleen�vould like to move the oil loading operation to the SI�R facility.
7- 'afety-Kleen Oil and Vacuum Sen7ces programs«ill ship 150,000 gallons per month from
T mount. This���ill be collected by 6 to 8 truck loads per clay, � days a�veek. The average rail car���ill
1 ,n site for 6 da}�s. 'ICR currently liandles about 5�trucks per day on a��erage. The additional 8 tnicks
��; not be a significant traffic increase in the area of the facility, and�vill not effect current operations at
SKR.
The rail car loading�vill take place at the end of the etisting SKR rail sptir. Modifications to the SKR
facility will involve an addition to the parking lot to allo�v trucks to pull up ne��t to the track for
unloading. Also, drip pans�`�ill be installed on the tracks for spill prevention. T�vo moveable transfer
pipe carts«�ill be usecl to connect the tnick to the tanlc car. The facility��-ill be able to load two rail cars
from t«�o trucks at one time. Drawings of the parking lot addition, and the transfer pipe carts are
attaclied.
I have included a copy of a letter sent to Terry Muller of Dalcota County on August 9, 1999 explaining the
operation. Also included is the contingency action and spill pre��ention plan for this operation. If you

Dear Mr. Muller:
Safety-Kleen (Rosemount), Inc. requests approval to use the facility rail siding to store
and load rail cars as part of Safety-Kleen Oil and Vacuum Services programs. These
programs collect used oil, oily water, and non-hazardous liquid waste streams for
recycling. Safety-Kleen is not collecting or transporting hazardous waste through these
programs. Used oil and oily water is collected and shipped to Safety-Kleen's internal
processi��g facilities. At these locations oil is recycled (energy recovery or re-refining),
water is treated and discharged and non-hazardous solids are landfilled.
Services provided in these programs include:
• Collection of used oil
• Clean-out of oiUwater separators, sumps, and trench drains
• Collection of approved non-hazardous materials. ��������

Waste must be pre-approved for these programs. The waste is also screened at the time
of collection to prevent contamination by halogenated solvents or PCB's. Waste will not
be collected if it has been m'viced with regulated levels of PCB's, if it has been mixed with
hazardous waste, and/or if it exhibits chemical or physical characteristics that are
inconsistent with the pre-qualification sample.

1. WAZARD COMMUNICATION
A. Safety-Kleen(Rosemount), Inc, "S-K Rosemount", has a detailed hazard communication
program written into their employee safety manual. Hazards of the loading operation
and chemical hazards of used oil are part of S-K Rosemount's employee training
program. S-K Rosemount will have a Material Safety Data Sheet for the used oil
located at the site and will also furnish the MSDS to the Union Pac�c Railroad
Company, "UPRR," and the Roseport Yard Superintendent.
B. A briefing conducted by S-K Rosemount personnel will be held prior to commencing the
initial loading operations to familiarize all 5afety-Kleen, Inc and railroad personnel with
safety concerns, loading procedures, equipment operation, used oil hazard information,
etc. Similarly at the same time, S-K Rosemount personnel shall inform Safery-Kleen,
Inc and UPRR personnel of their faciliry hazards, emergency procedures, notifications,
etc.
2. PERSONNEL PROTECTIVE EQUIPMENT
A. Responsibility: Safety-Kleen, Inc shall furnish appropriate and required personnel
protective equipment for their respective employees. Equipment as given shall be worn
by the employees at the rail site. Employees not complying with this requirement(as
reported by the employee supervisor, and/or railway personnel), shall be subject to
disciplinary measures.
B. Required Equipment:
1) Safetv Glasses: All Safety-Kleen, Inc. personnel shall wear OSHA approved
safery eyewear pursuant to ANSI Standard Z87.1 including side shield.
2) Faceshield: All Safety-Kleen, Inc. personnel shall wear a faceshield with their
safety glasses while connecting or disconnecting all hoses at the truck, pump,
and/or rail car connection at the railway facility. Such faceshields do not have to
, be personally issued, but must be kept clean and in usable condition at all times.
3) Hard Hat: All Safety-Kleen, Inc. personnel must wear a hard hat/cap meeting
OSHA standards pursuant to ANSI Standard Z89.1-1986 for Classes A or B.
4) Footwear: All Safety-Kleen, Inc. personnel must wear leather shoes/boots of at
least six inch lace-up shoe height. No canvas or athletic type shoes will be allowed
even though they may be steel or composite toe.
5) Clothin�: All Safety-Kleen, Inc. personnel must wear long sleeved shirts,
buttoned, and long pants during loading operations at the railway facility.
Coveralls are also acceptable.
6) Apron: All Safety-Kleen, Inc. personnel shall wear a vinyl chest apmn of at least
3/ length during the connection or disconnection of hoses to tnick, pump, andlor
rail car while at the railway facility. Such aprons do not have to be personally
issued, but must be kept clean and in usable condition at all tunes.
"� Gloves: All Safety-Kleen, Inc. personnel shall wear PVC/Neoprene gloves while
making hose connections or disconnections to pumps, truck, andlor rail cars.
3. FIRE SAFETY
A. The used oil expected has a flash point of 170-270°F. Accordingly,
the used oil may be a combustible liquid under DOT and OSHA standards (less than
200°� or non-combustible. In either case, the used oil will have to be heated to reach
the flash point.
B. Fire extinguishers shall be located on at least two of the four loading rack units with no
more than one tank car loading rack without one being between the two with
extinguishers. Extinguishers shall be of at least a 201b ABC Dry Chemical extinguisher
type.
C. Fire Fi hting: In case of fire, personnel may use extinguishers available for that
purpose where the fire is small and within the extinguishing potential of the extinguisher.
Large fires or fires that are unable to be controlled by two extinguishers, shall be
immediately reported through S-K Rosemount's emergency phone system to the
Rosemount Fire Department. All fires of any size shall be reported to the management
as soon as appropriate.
D. No smoking shall be allowed at the loading area nor in the cab of the truck while at
the facility. Smoking in other areas of the S-K Rosemount facility will be as designated
in the facility safety plan.
OIL SPILL
PREVENTION AND RESPONSE
i. INTRODUCTION
This Oil Spill Prevention and Response Plan is developed pursuant to S-K Rosemount's desire
to comply with all federal, state a.nd local environmental laws and�regulations. It is also
mandated by economical considerations where the discharge of oil or other material represents a
financial loss to the company, both as a marketable or usable product, as well as the cost of
cleanup and maintenance.
This document is intended to meet the requirements of 49 CFR 171.5 (Response Plans for
Shipments of Oil in Bulk Packaging) and 40 CFR110 (Discharge of Oil). The plan is also
designed to comply with applicable environmental laws of the State of Minnesota.
Descriptions of Facility: Safety-Kleen., Inc., 13425 Courthouse Bi.�, Rosemount, MN
55068. Rail cars are leased by Safety-Kleen, Inc. and are 23,500 gallon capaciry tank cars.
The rail spur is capable of serving four such rail cars at a time.
Safety-Kleen, Inc. will deliver the used oil to the site by tank truck. Safety-Kleen, Inc. drivers
will off-load their trucks using pump-loading racks and overhead fill the iail cars. Safety-
Kleen, Inc.'s drivers/employees will be responsible for operating the pumping unit and loading
the rail tank cars.
Tank cars will then be secured for transportation and subsequently pulled into the rail system for
transport to Safety-Kleen, Inc.'s refinery at East Chicago, IN.
2. SPILL PREVENTION
A. Inspection procetiures at the facility include inspection of rail cars prior to loading for
condition of valves and connections, valve position(closed) and locki.ng device, tank and
rail car condition, etc. During loading, the transporter shall observe for leaks, drips,
poor connections, and be ever observant as to liquid level in the rail car. After loading,
valves and dome lids shall be closed, inspected for closing, and secured by the locking
mechanism.
B. The transportation personnel must not leave the immediate vicinity of the truck and rail
car during loading of the used oil.
C. Drip pans shall be placed on the rail system under the connections to catch any
and all drippages, leaks, or spills. Absorbent pads and booms, as well as a supply of "oil-
dry" absorbent shall be available at the site for the exclusive use of Safety-Kleen, Inc.
personnel, should a spill or release occur.
3. MANNER OF RESPONSE
A. Reporting Procedures
1) In the event of an oil spill or release at the loading site, it shall be the responsibility
of the operator to:
a) Take appropriate action to halt the spill incident by shutting off all pumps,
closing valves, etc.
b) Take any appropriate acrion to contain the spill by berming, absorbing,
ditching, damming, etc.
c) Notify his/her supervisor immediately.
. d) Notify S-K Rosemount Incident Coordi.nator.
2) In the event of an oil spill or release at a point in the rail transportation system, it
shall be the responsibility of UPRR to:
a) Take appropriate action if possible to halt the spill incident by closing valves,
plugging, etc. to the ea�tent possible.
b) Take any appropriate action if possible to contain the spill by berming,
absorbing, ditching, damming, etc. and to prevent any spillage from entering
any waterway.
c) Notify Safety-Kleen, Inc. Emergency Coordinator at 1-800-468-1760.
3) Notification to the Safety-Kleen, Inc. Emergency Coordinator shall:
a) Be made as soon as possible, even though not all details are known at the
time.
b) Include information regarding:
i. time of spill
ii. exact location of spill
ui. telephone contact and number at spill location
iv. containment efforts currently underway
v. any previous not�cations made
vi. any regulatory or public safery agencies responding
vii. any injuries
viu. possible entry into any waterway
4) The Safety-Kleen, Inc Emergency Coordinator shall:
a) Make all appropriate notifications to regulatory and public safety agencies,
immediately as required.
b) Make appropriate inter-company notifications:
• S-K Rosemount
• East Chicago, IN Refinery
c) Assure that appropriate corrective actions have been taken.
d) Arrange for further clean up as necessary with facility personnel, remediation
contractors, etc.
e) Invoke all other company provisions related to environmental controls as required.
� Assure that appropriate clean up actions have occurred and terminated to the
satisfaction of the company, the property owner, and the regulatory agencies.
g) Prepare a written report covering the incident, detailing the spill, the clean up,
and recommendations for future spill or release prevention
B. Maximum Discharge Quandties
1) Rail Car: The maximum discharge quantity from a single rail car tank would be
the capacity of the tank: 23,500 gallons.
2) Truck Tanker: The maximum quantity that should be expected from a single truck
tanker would be the capaciry of the tnick tank: 7,500 gallons.
C. Spill Remediation
Depending on the size of the spill, the Emergency Coordinator for Safety-HIeen, Inc at
Rosemount shall arrange for appropriate clean up and remediation of the site.
Where local facility personnel are able to effectually perform clean up function for a
small release, the Incident Coordinator is authorized to arrange for such a clean up. For
large spills, spills entering waterways or where no local personnel are available, an
Environmental Remediation Contractor shall be contacted by the Emergency
Coordinator. Safety-Kleen, Inc. has arrange�i for an Environmental Remediation
Contractor that has extensive experience in oil and chemical spill clean up and
remediation. CURA is the designated Remediation Contractor for this facility and the
rail transportation of the used oil for Safety-Kleen, Inc. Their address is noted in Item
4.

F. Written Not�cation Requirements
In addition to the verbal reporting mechanism, written reports are required in the event
of a spill. Written reports are required under federal and state regulations.
1) Federal Reporting Requirements
In the event that more than 1,000 U.S. gallons of oil are discharged in a single
spill event, or two spill events occur which are reportable under 40 CFR 110.3
withi.n one twelve month period, a written report will be submitted to the
Regional Administrator of the USEPA, MPCA and Dakota County , as required
under 40 CFR 112.4 within sixty (60) days of such occurrence.
2) State Reporting Requirements
Written reports are to be submitted to the MPCA and Dakota Counry within
seven calendar days after the verbal notification, unless otherwise provided for in
a valid permit or other valid regulations. Written not�cation reports are to be
submitted to the admi.nistrator of the appropriate division. In the case of S-K

� 5. WASTE DISPOSAL PLAN
A. All wastes contaminated with oil (gloves, suits, oil-dry, booms, absorbent materials,
etc.) shall be placed in an appropriate drum with closed lid located out of the weather.
B. Waste materials shall be appropriately disposed of in accordance with local, state and
federal environmental regulations giving consideration to good environmental business
practices to inimi7e waste to be disposed. Disposal arrangements as needed shall be
the responsibility of S-K Rosemount designated Facility Coordi.nator/Manager.
C. All liquid used oil spillages, collected drips, etc. shall be diummed separately and
arrangements made by S-K Rosemount to have such used oil reenter the system for
transport to the refinery and be processed as much as possible.
6. LOCATION AND DISTRIBUTION OF THIS PLAN
Pursuant to 49 CFR 171.5 (b) (5) a copy of this plan must be retained on file at the principal
place of business and at the dispatcher's o�ce.
S-K Rosemount, (13425 Courthouse Blvd, Rosemount, MN 55068) is the pri.nciple place of
business. The copy shall be on file with S-K Rosemount Emergency Coordinator and
Facility Manager, and with Regional Safety Director.
The Safety-Kleen, Inc. Rail Service Coordinator is the dispatcher office and a copy shall be
retained at that office.
An additional copy shall be retained at the UPRR Safety Office.
7. PLAN IMPLEMENTATION
This Oil Spill Prevenrion Plan is hereby approved and in effect for Safery-Kleen (Rosemount)
Inc. Our designated Emergency Coordinator, Mike Fullerton is empowered by Safety-Kleen,
Inc. to act on the Company's behalf including the commitment of funds for the prompt and
. effective remediation of any spill, discharge or release of oil from this facility or rail
transportation system.
