' � ATTACHMENTS: Letter from Roger Knutson and Joint APPROVED BY: ��% Powers A reement Amendment Attached is a letter from Roger Knutson, the attorney for the Vermillion River WMO, explaining the proposed amendment to the VRWMO Joint Powers Agreement. The Joint Powers Agreement in effect now expires on 12/31/99. The proposed amendment would extend the existing Joint Powers Agreement until August 1 , 2000. This will allow more time for the twenty-one member communities to review the new 509 Management Plan for the Watershed Organization and a new Joint Powers Agreement. The Townships expressed an interest in bringing this to their annual meeting in March for review which has triggered the need for this extension. Staff recommends the motion as described below. RECOMMENDED ACTION: MOTION TO APPROVE THE THIRD AMENDMENT TO THE JOINT POWERS AGREEMENT ESTABLISHING A WATERSHED MANAGEMENT COMMISSION FOR THE VERMILLION RIVER WATERSHED AND TO AUTHORIZE NECESSARY SIGNATURES. Knutson Vermiilion River WMO Attomey SUBJECT: Extension of Vermillion Joint Powers Agreement Enclosed is a proposed amendment to the Vermillion River WMO Joint Powers Agreement. The amendment extends the duration of the organization from January 1, 2000 to August 1, 2000. This agreement was discussed at the September 30, 1999 meeting with the WMO Board, community representatives, and concerned citizens. The purpose of the shorf extension is to give all member communities an opporfunity to fully review the joint powers arrangement and determine the direction they want to go in. Township Supervisors indicated they wanted to discuss the WMO and the March Annual Meetings. If the amendment meets with the approval of your governing bodies, please have it signed and returned to me as promptly as possible. If you have any questions, please call me. This amendment is made pursuant to the authority conferred upon the parties by Minn. Stat. Sections 471.59 and 473.875, et se.�c . 1. EXISTING AGREEMENT. The existing Joint Powers Agreement for the Vermillion River Water Management Commission, including the First and Second Amendments thereto, are incorporated herein and shall remain in full force and effect, except as specifically amended by this Agreement. 2. PARAGRAPH li, SUBDIVISION i of the Joint Powers Agreement is amended to provide: Each member agrees to be bound by the terms of this Agreement until August 1, 2000, and it may be continued thereafter upon the agreement of all the parties. 3. EFFECTIVE DATE. This Agreement shall be in full force and effect when all twenty-one (21) existing members approve and sign this Agreement. All members need not sign the same copy. IN WITNESS WHEREOF, the undersigned governmental units, by action of their governina bodies, have caused this Agreement to be executed in accordance with the authority of Minn. Stat. § 471.59.
