Action: Unanimous Recommendation of Approval SUMMARY The former Tom Thumb site on the south east corner of Canada Avenue and CSAH 42 is being redeveloped as a tavern with a sit-down restaurant and a lounge area serving liquor. The current zoning of C-1, Convenience Commercial only permits convenience stores and self-service gasoline sales and accessory uses. The proposed use of the site requires rezoning to C-4, General Commercial,which permits"Eating and drinking establishments including drive-ups and tavems." The property is guided for Commercial Land Use and Rezoning to C-4, General Commercial would be consistent with the Comprehensive Guide Plan. The three surrounding properties to the east, south and west are also zoned C-4, General Commercial (Carlson Tractor, ISD 196, and McDonald's). The property north of CSAH 42 is R-1 A, Low Density Residential (single family). Most residential properties backing up the CSAH 42 have fences and extensive landscape buffering. No major exterior improvements to the building are anticipated. There will be modifications to the former canopy and pazking.area to enhance parking. The property has landscaping from the previous use. PLANNING COMMISSION PUBLIC HEARING On December 22, 1998, the Planning Commission conducted a public hearing for the rezoning. The applicant and several family members attended. Mr. Don Fluegel(Father-in-law) explained the nature of the tavern, and indicated a similar establishment in Hastings. No other adjacent property owners appeared to speak at the public hearing. After discussion regarding parking issues, the Planning Commission adopted a motion to recommend that the City Council rezone the property to C-4, General Commercial. RECOMMENDED ACTION: Motion to adopt an ordinance amending Ordinance B City of Rosmount Zoning Ordinance rezoning the property at 15040 Canada Avenue to C-4, General Commercial. PUBLIC HEARING• TAVERN ON 42 REZOIVING Chairperson Droste opened the public hearing for Tavern on 42 Rezoning. The recording secretary has placed the Affidavit of Publication and Affidavit of Mailing and Posting of a Public Hearing Notice on file with the City. Mr. Pearson presented the application of Tavern on 42 to rezone the former Tom Thumb property to C-4, allowing a restaurandtavern facility. This rezoning would be consistent with the Comprehensive Guide Plan and surrounding properties. Chairperson Droste opened the floor to the applicant. John Ursino and Don Fluegel were present to answer questions. Mr. Fluegel provided a brief description of the plans for the restaurant/tavem. Chairperson Droste opened the floor to the public. There were no comments. MOTION by Droste to close the public hearing. Second by DeBettignies. Ayes: DeBetti;nies, Tentinger, Droste, Shoe-Corrigan, and Weisensel. Nays: 0. Motion carried. � Planning Commission Regular Meeting Minutes _ December 22, 1998 ����� Page 2 _ Commissioners discussed issues related to overflow parkin� and recommended that parking along Canada Avenue from the business driveway to CSAH 42 not be allowed. Mr. Pearson explained the parking requirements and indicated the site plan will go through an administrative - revie�v for a building permit. A public hearing will be held for the liquor license. MOTION by DeBettignies to recommend that the City Council rezone the property at 15040 Canada Avenue to C-4, General Commercial. Second by Tentinger. Ayes: Tentinger, Droste, Shoe-Corrigan, Weisensel, and DeBettignies. Nays: 0. Motion carried. Mr. Rogness explained this project w ld take t city past 2005 in meeting the projections for high density housing needs.
