Spectro Alloy Corp., 13220 Doyle Path East, is requesting the City Council consideration under
Ordinance XVIII.11 relating to fire suppression systems. This ordinance allows industrial
properties to be exempt from installing an on-site water supply system when a water supply
system is available within one year of the date of the request.
The building will be constructed with the appropriate fire suppression system (i.e. Sprinkler
heads, etc.), and when water is available next year,the building will be connected at that time.
The applicant at the time of receiving their building permit will be required to give the City a
letter of credit equal to the amount of installing an onsite supply system in the event the City
does not install the water system.
Spectro Alloy has met the seven conditions of the ordinance and staff recommends approval.
RECOMMENDED ACTION:
Motion to approve the fire suppression exemption for Spectro Alloys.

Dear Mr.Burt,
Thank you for your help in clarifying the issues remaining for approval of
Spectro's building permit. The following paragraphs address how Spectro will meet the
requirements of the amendment to Rosemount City Code Section 9-1-1 C. Each
paragraph number corresponds to the paragraph number in the Ordinance.
1. Assuming we have a building permit within the next 30 days,we expect the
construction of the proposed building and corresponding systems to be
completed on or about March 15,2000 with a certificate of occupancy sometime
thereafter. It is up to the Council to determine if water to our facility is likely
within one year of this date.
2. We have plans and drawings for our plant wide sprinkler system as discussed
with the Fire Marshall. Upon approval by the City,we will install the sprinkler
system simultaneously with the construction of the warehouse. We expect to
have the system complete and ready for connection to the municipal water
supply before receiving a certificate of occupancy for the warehouse. We have
completed and returned to the City a petition for local improvements specific to
municipal water.
3. Spectro will provide the City with preliminary plans and the Engineer's cost
estimate for construction of an on-site water supply system for the sprinkler
system. Spectro will provide the City with a letter of credit in an amount
agreeable to the city to satisfy the construction costs of the on-site water supply
system if the need arises.
4. Spectro Alloys Corp.hereby agrees to hold the City of Rosemount harmless from
any actions that relate to fire protection at its facility prior to connection to the
municipal water supply system or an approved on-site water supply system.
5. A petition for the municipal water supply system and a waiver of assessment
appeal for costs associated with the system has been completed and filed with the
City Building Official.
6. Site plans for the warehouse have been submitted and approved by the City.
Final construction drawings for the building are due by 12/21/99 and will be
forwarded to the Building Official for approval. It remains for the Council to
determine that a delay in connecting the sprinkler system does not pose an
unreasonable hazard. It is Spectro's position that a delay in connecting the
sprinkler system does not pose an unreasonable hazard since the building and
its contents will be comprised of noncombustible materials.
7. The new building under consideration at Spectro is a warehouse for aluminum
and does not qualify as an M occupancy as defined in the Uniform Building Code.

ORDINANCE NO. XVIII.11
AN ORDINANCE RELATING TO FIRE
SUPPRESSION SYSTEMS; AMENDING
ROSEMOUNT CITY CODE SECTION 9-1-1 C
The City Council of the City of Rosemount,Minnesota ordains as follows:
Section l. Rosemount City Code Section 9-1-1 C. is amended to read as follows:
C. Special Fire Protection Systems: As authorized by Minnesota Rule part 1306.0100
subpart 2,the sprinkler system requirements of Minnesota Rule part 1306.0100 subpart 3,
with the selection of option Item"8a", are hereby adopted without change and
incorporated as part of the Building Code for the City.
In the case of commercial or industrial properties, the Council may,upon application by
the owner, allow occupancy without completed automatic sprinkler systems subject to all
of the following conditions.
1. The municipal water supply system is not currently available,but the Council has
determined that it is expected to be made available within one year of the date of
building occupancy.
2. A building sprinkler system shall be constructed prior to issuance of a certificate
of occupancy which is prepared for connection to the municipal water supply
system and the owner has executed an agreement in a form satisfactory to the City
Council that the building's sprinkler system will promptly be connected to the
municipal water supply system upon availability.
3. The owner has demonstrated to the satisfaction of the building official that an
onsite water supply system for the building's sprinkler system is feasible, and the
owner executes an agreement in a form satisfactory to the City Council that if the
municipal water supply system is not made available within one year of
occupancy, the on site water supply system will be constructed and connected to
the building's sprinkler system. Construction of an on site water supply system
may be waived by the City Council if it determines that availability of the
municipal water supply system is imminent and that construction of the on site
water system would be unreasonable given the needs of the public, the expense of
the system and the expected date of completion of the municipal water supply
system.

4. The property owner agrees to hold the City of Rosemount harmless from any
actions that relate to fire protection at its facility prior to connection to the
� municipal water supply system or an approved on site water supply system.
5. The property owner executes a petition for the municipal water supply system and
a waiver of assessment appeal for costs associated with the system.
� 6. The building and site plans associated with the proposed new building,building
addition, or occupancy reclassification change have been approved by the City of
Rosemount and the Council has determined that delay in connecting the sprinkler
system does not pose an unreasonable hazard.
7. Occupancy prior to connection of the building sprinkler system to a water supply
system will not be permitted in M occupancies as defined in the Uniform Building
Code.
Section 2. This ordinance shall become effective after adoption and the day following its
legal publication.
ADOPTED this 7th day of September, 1999,by the City Council of the City of Rosemount.
