Requested Zoning: General Industrial Planning Com.Action: Recommendarion of approval(unanimous) SUMMARY There have been several relatively minor changes to the PUD which are reflected in the preliminary plat. 1. Solberg will not acquire the parcel between their site and Conley Avenue. An easement for access will be appropriate to enable access to the Frontage road as an alternative to CSAH 42. This area should be platted as an outlot. 2. The ponding area south of the Fleet Development site will shift to Rich Valley Golf Course. The golf course will not be part of the PUD. The Fleet Development site will be required to conform to minimum green space requirements(maximum of 75% impervious surface). 3. The Fleet Development site will not absorb the former pond area. This should also be platted as an outlot. The landscaping plan for the Wayne Transport site parking lot includes a 600 ft. x 12 ft. green strip added to the western edge of the parking lot azea instead of several indentations. The strip actually serves as additional setback along the north half of the paved area. This creates space for the 12 additional evergreen trees shown on the plan in four clusters. PLANNING COMMISSION PUBLIC HEARING On April 13, 1999, the Planning Commission conducted a public hearing as required. The former property owner asked questions about the drainage system and intersection alignments. The Utility Plan was explained as was the intersection location for Conley Avenue. The Planning Commission discussed the Landscaping Plan and complimented the developer on their treatment of the western edge of the Wayne Transport parking lot. The Planning Commission further suggested that tree plantings be concentrated on the north west corner of the Wayne Transport site for the purpose of screening the view of the trailer parking area for south-bound motorists. RECOMMENDED ACTION: Motion to adopt a resolution approving the Final Planned Unit Development &Preliminary Plat for Construction 70, Inc. CITY COUNCIL ACTION: CITY OF ROSEMOUNT DAKOTA COUNTY,MINNESOTA RESOLUTION 1999- A RESOLUTION APPROVING THE FINAL PLANNED UNIT DEVELOPMENT & PRELIMINARY PLAT . FOR CONSTRUCTION 70,INC. WHEREAS,the Community Development Department of the City of Rosemount received an application from Construction 70, Inc. for approval of a planned unit development and preliminary plat located at 3550 E. 140"' St. in Rosemount, Minnesota; and WHEREAS, on April 13, 1999, the Planning Commission of the City of Rosemount reviewed the Planned Unit Development and Preliminary Plat for Construction 70, Inc. and adopted a motion to recommend approval, subject to conditions, to the City Council. WHEREAS, on Apri120, 1999,the City Council of the City of Rosemount reviewed the Planned Unit Development and Preliminary Plat for Construction 70, Inc. NOW,THEREFORE,BE IT RESOLVED,the City Council of the City of Rosemount hereby approves the Planned Unit Development and Preliminary Plat for Construction 70, Inc., subject to the following conditions: A. Wayne Transports' Parcel: , 1. The office and maintenance buildings shall be constructed of 100%masonry exterior materials with some architectural design features (e.g., color and bands). 2. Screening on the north side of the parking lot will be accomplished by an 5-10 foot high berm with grouped trees on the northerly slope; existing significant trees shall be protected and preserved. 3. Variances to allow a 15-foot setback on the east side and a 20-to-35-foot setback on the west side of the parking/storage area will be permitted with additional landscaping as follows: (a) Overstory trees shall be planted along the west side of the parking/storage area spaced 50-feet apart with varied clusters of evergreen/overstory trees. (b) Overstory trees shall be planted along Conley Avenue spaced a minimum of 100 feet apart on private property. (c) Overstory and evergreen trees shall be planted in clusters on the north side of the parking/storage area, including the berm's slope. (d) Shrubs shall be planted on the east side of the office building along its perimeter; evergreen/overstory trees shall be planted directly east of the office building. Resolution 1999- B Fleet Develo�ment's Parcel: 1. Variances to allow a 15-foot setback for the parking/storage area on the west side will be pernutted with additional landscaping as follows: (a) Overstory trees shall be planted along Conley Avenue spaced a minimum of 100 feet apart on private property. (b) Evergreen and overstory trees shall be planted along the north side of the new parking area. (c) A minimum of 1600 square feet of green space shall be added to the northwest corner of this site. (' Other Conditions: 1. All lighting for parking lots, storage areas and building security shall be directed away from adjacent properties with cut-off style down-lighting design. 2. All landscaping shall include the following minimum sizes: 2.0-2.5 inch caliper for overstory trees, 6 feet in height for evergreen trees, and 1/3 of mature size for shrubs. 3. The PUD shall conform with the city's Subdivision Ordinance, and all applicable building, zoning and fire codes. 4. The PUD shall incorporate recommendations of the Public Works Department concerning grading, streets and public utilities. 5. All platting fees, including storm water trunk, GIS, and park dedication shall be paid as established by the current fee resolution. 6. The preliminary plat shall be approved by the Dakota County Plat Commission. 7. All future building projects that are proposed on existing outlots or vacant lots shall be reviewed by the City as an amendment to this PUD. 8. All parking/loading/storage areas shall be paved with a concrete or bituminous surface, including curb and gutter. ADOPTED this 20th day of April, 1999,by the City Council of the City of Rosemount. WHEREAS,the Community Development Department of the City of Rosemount received an application from Construction 70, Inc. for approval of a concept planned unit development located at 3550 E. 140`� St. in Rosemount,Minnesota; and WHEREAS,on February 23, 1999, the Planning Commission of the City of Rosemount reviewed the Concept Planned Unit Development for Construction 70, Inc. and adopted a motion to recommend approval, subject to conditions,to the City Council. WHEREAS, on April 6, 1999, the City Council of the City of Rosemount reviewed the Concept Planned Unit Developrrient for Construction 70, Inc. NOW, THEREFORE,BE IT RESOLVED,the City Council of the City of Rosemount hereby approves the Concept Planned Unit Development for Construction 70, Inc., subj ect to the following conditions: A Wayne Transnorts' Parcel: l. Resolution 1999- B Fleet Develonment's Parcel: 1. Variances to allow a 15-foot setback for the parking/storage area on the west side will be permitted with additional landscaping as follows: (a) Overstory trees shall be planted along Conley Avenue spaced a minimum of 100 feet apart on private property. (b) Evergreen and overstory trees shall be planted along the north side of the new parking area. (c) The new auto parking area at the northwest corner of this site shall be evaluated for a design change that would include one-way parking for automobiles, resulting in an increased setback(greenspace) along Conley Avenue. (d) If the ponding area south of Fleet's parking area is removed and added to Fleet's property,then the landscape plan shall include additional tree plantings in that area. (' Other Conditions: 1. All lighting for parking lots, storage areas and building security shall be directed away from adjacent properties with cut-off style down-lighting design. 2. Public Hearing: Construction 70 Preliminarv Plat and Final PUD Chairperson Droste opened the public hearing on Construction 70 Preliminary Plat and Final PUD. The recording secretary has placed the Affidavit of Publication and Affidavit of Mailing and Posting of a Public Hearing Notice on file with the City. Mr. Pearson explained changes to the Construction-70 PUD. Solberg will no longer acquire the adjoining parcel, and the parcel will be described as an outlot. The ponding area south of Fleet Development has been shifted to Rich Valley Golf Course, leaving the remnant as an outlot. Fleet Development is required to add 1600 sq.ft. greenspace in the northern portion of its site to meet the 25%required greenspace. Mr. Peazson reviewed the landscaping plan. Chairperson Droste opened the floor to the Applicant. Joe Eschenbacher of Wayne Transports responded to questions concerning greenspace, landscaping and screening. Chairperson Droste opened the floor to the public. Marlin Rechtzi�el, 14727 Clayton Ave., asked about plans for the waterway crossing the property and inquired further about the Conley Avenue alignment. MOTION by Droste to close the public hearing. MOTION by Tentinger to recommend that the City Council approve the Preliminary Plat and Final PUD for Construction 70 (Wayne Transports &Fleet Development) subject to: 1) Conformance with the requirements of the concept resolution; 2) Payment of Park Dedication fees as determined by the City Council; 3)Payment of Storm Water Trunk Area Charges as established by the current fee resolution; 4)Payment of GIS Fees as established by the current fee resolution; 5) Remnant pazcels shall be platted as outlots; 6)Approval by the Dakota County Plat Commission; 7)A minimum of 1600 square feet of green space added to the northwest corner of the Fleet Development site. February 23, 1999 Regular Planning Commission Reviews BACKGROUND The approximately 52 acres on the northeast corner of US 52/56 and CSAH 42 west of the Rich Valley Golf Course is occupied by Solberg Aggregate (10 acres) and Fleet Development (14.5 acres). The remaining 28.3 acres in between was purchased from JoAnn and Marlin Rechtzigel by Koch Refining Company. Koch is interested in cooperating with Wayne Transport to relocate their facility currently in Inver Grove Heights to this site in Rosemount. The move is necessary because Wayne Transports' cunent site has very limited expansion opportunities. Wayne Transport will occupy slightly less than 20 acres on the northwest corner of the site along side of US 52. A new frontage road will separate Wayne from Fleet Development, and provide access for both sites. This frontage road is needed because of the eventual closure of access to US 52 from 140th Street East. The remnants of the property not utilized by Wayne will be combined with Fleet Development and Solberg Aggregate. The General Industrial district standards require Planned Unit Development for projects involving multiple buildings, parcels and/or uses. An obvious benefit of the PUD process is to grant setback variances for both parking lots along Conley Avenue in return for landscaping concessions. Trucking terminals are permitted uses in the General Industrial District. WAYNE TRANSPORTS SITE PLAN REVIEW The Wayne Transports Trucking Terminal involves two buildings and extensive outdoor trailer parking. Access occurs via two driveways connecting with the proposed Conley Avenue, which will be constructed in the summer of this year. The two buildings consist of a 9,600 sq. ft. office building and a 26,500 sq. ft. Maintenance building. The two story office building will be constructed of colored/textured CMLJ(concrete block). The maintenance building will consist to architectural precast concrete panels. The buildings exceed the materials requirements of the General Industrial District by a substantial February 23, 1999 Planning Commission Reviews- General Industrial Concept PUD Page 2. margin. The farm buildings located on the northern edge of the site (along 140th Street East) should be demolished, especially since the space in needed for green space and ponding requirements. Landscaping requirements for the site comes to 117 foundation plantings and the Planning Commission's recommendation. Staff recommends that additional landscaping in the form of boulevard and evergreen trees be planted on the edges of the parking lot and along the various right-of-ways to screen the extensive trailer parking and as a trade-off for the setback variances. FLEET DEVELOPMENT Fleet development is expanding their parking capabilities with a new lot west of their current site for both trailers and cars/semi tractors. The geometry of the site (purchased for the Rechtzigels) allows for only a 15 foot setback along the proposed Conley Avenue. This is a result of the maneuvering space required for the semis. The site dimensions were fixed along with the original transaction, and there is no stated ability to further compress the site. SOLBERG AGGREGATE The Solberg Aggregate site will expand by more than four acres. The proposed Conley Avenue Right-of-Way (ROW)will be located approximately 255 feet east of their current ten acre site. No development plans are available at this time. Conley Avenue gives Solberg the ability to relocate their driveway from CSAH 42 to the new frontage road. SETBACK VARIANCES Standards for parking setbacks in the General Industrial District. The PUD process will allow the granting of variances if the Planning Commission is willing to accept extraordinary landscaping in return. Staff recommends that the 25 foot variances, while substantial, could be granted if the applicants are willing to provide screening via extensive
