The attached map shows the second phase as proposed by the Developer. Biscayne Pointe is located immediately adjacent to the railroad tracks and east of Biscayne Avenue and received preliminary plat approval in June, 1997. The 2nd Addition will include the construction of street and utilities along an extension of Belfast Street West adjacent to the railroad tracks. Since the petition is signed by 100% of the property owners benefitting from the proposed improvements, the City will not have to hold a public hearing to consider the improvements. The schedule is dependent upon the Developer completing the grading and is tentatively set as follows: Order Feasibility Report April 20, 1999 Receive Feasibility Report/Order Plans & Spec's June 1 , 1999 Approve Plans & Spec's/Order Ad for Bid July 6, 1999 Receive Bids July 30, 1999 Award Contract August 3, 1999 Begin Construction August 16, 1999 Substantial Completion November 1 , 1999 Final Lift June, 2000 Assessment Hearing September, 2000 Staff recommends that the City Council pass the resolution as stated below. RECOMMENDED ACTION: MOTION TO ADOPT A RESOLUTION RECEIVING PETITION AND ORDERING FEASIBILITY REPORT FOR BISCAYNE POINTE 2ND ADDITION STREET AND UTILITY IMPROVEMENTS, CITY PROJECT #309. COUNCIL ACTION: 4 CITY OF ROSEMOUNT DAKOTA COUNTY, MINNESOTA RESOLUTION 1999 - A RESOLUTION RECEIVING PETITION AND ORDERING FEASIBILITY REPORT FOR BISCAYNE POINTE 2ND ADDITION STREET AND UTILITY IMPROVEMENTS CITY PROJECT #309 WHEREAS, the City Council of the City of Rosemount has received a petition from a property owner who will benefit from the proposed Biscayne Pointe 2nd Addition Street & Utility Improvements, City Project #309. NOW THEREFORE BE IT RESOLVED, by the City Council of the City of Rosemount as follows: (1) A certain petition requesting street & utility improvementsto their property, filed with the Council on April 20, 1999, is hereby declared to be signed by the required percentage of owners of property affected thereby. This declaration is made in conformity to Minnesota Statutes, Section 429.035. (2) The petition is hereby referred to the City Engineer and that person is instructed to report to the Council with all convenient speed advising the Council in a preliminary way as to whether the proposed improvement is necessary, cost- effective, and feasible and as to whether it should best be made as proposed or in connection with some other improvement, and the estimated cost of the improvement as recommended.
