Minutes of the February 13, 2017 Work Session ProceedingsROSEMOUNT CITY COUNCIL WORK SESSION PROCEEDINGS FEBRUARY 13, 2017 CALL TO ORDER Pursuant to due call and notice thereof a work session of the Rosemount City Council was held on Monday, February 13, 2017, at 6:30 pm in the Conference Room at City Hall, 2875 145th Street West, Rosemount. Mayor Droste called the meeting to order, with Council Members Nelson, Freske, DeBettignies and Weisensel in attendance. Staff present included City Administrator Martin, City Clerk Hadler, Chief of Police Scott, Interim Director of Public Works / City Engineer Morast, Public Works Coordinator Watson, Public Works Supervisor Koslowski, Community Development Director Lindquist, and Senior Planner Klatt. DISCUSSION 2.a. 2017 Proposed Public Works Equipment Purchases Interim City Engineer Morast began the discussion of the Public Works equipment purchases. Council members inquired about whether staff obtained bids from multiple vendors. Mr. Morast explained that the equipment is being purchased on the state purchasing contract, which he has found repeatedly to be lower than other bids. Council members and staff discussed equipment needs and the equipment evaluation tool. Council members discussed the opportunity to lease versus purchase, or not purchasing the minivan for City Hall. City Administrator Martin stated he will be having a meeting this week to explore purchases from a car rental company. Ms. Watson asked for clarification on whether staff could move forward with some of the purchases that take a long time to be delivered. Council was supportive of moving forward with some of the larger purchases including; the Kubota, tractor, grader, and the sweeper. Staff will look at options for pick-ups and smaller vehicles. 2.b. Annexation / Detachment Petition for 1.94 Acres at Dood Road and 120th Street W City Planner Klatt introduced a request for a detachment of a property adjacent to Eagan, so the property could be annexed by Eagan. The reason is so that a development could be built in Eagan and avoid having a small portion of the development in the City of Rosemount. Mr. Klatt explained the process if the City chose to support it; concurrent resolutions in support of the annexation/ detachment in both Rosemount and Eagan, the petition would be heard by a state judge, who would review it based on a set of criteria. Staff finds a number of issues that should be discussed; whether Dodd Road should be connected through to 120th Street, if there are any areas that could be served by Eagan utilities, and that the VFW building should remain in the City of Rosemount. Council members and staff discussed potential road paving opportunities, road maintenance, and utilities. The developer was on hand and stated that they were not pushing the annexation/ detachment, just that they were seeking input and thought it may be a little “cleaner”. 6.a. ROSEMOUNT CITY COUNCIL WORK SESSION PROCEEDINGS FEBRUARY 13, 2017 Council members and staff discussed other potential development based on land holdings of the developer. Council would like a memorandum of understanding with the City of Eagan. Staff will take the input to the City of Eagan to try to come to an understanding. 2.c. MUSA Expansion and Utility Extension Community Development Director Lindquist discussed the City’s MUSA boundaries. SKB has inquired about developing a portion of their property. However, the utilities are a significant distance away from the City’s utilities and would cost approximately $5 million to extend the utilities. She asked whether the City should consider development on properties where there are not currently utilities available. Mayor Droste inquired about how the City charges area charges for sewer and water. Ms. Lindquist explained how area charges were determined. She explained the City Attorney has advised that the City could potentially allow SKB to install a septic, but then also charge the area charges, so that they would eventually connect when City water and sewer extended that far. Council member DeBettignies stated he felt there were some details that the Council has not heard, such as the amount of water the facility will use, that makes it difficult to recommend a policy. Ms. Lindquist summarized her understanding of the discussion; that Council would support some development with temporary septic and wells, while also charging the SAC charges for future utility connections. 2.d. Predatory Offender Ordinance Chief of Police Scott explained that a number of neighboring cities are implementing Predatory Offender Ordinances, including; S. St. Paul, W. St. Paul, Hastings, Inver Grove Heights, and potentially Apple Valley. Chief Scott explained how the ordinances work. He stated the City of Rosemount currently has 19 registered sex offenders in residence. Council members and staff discussed the potential ordinance. Council members DeBettignies and Weisensel would like to see a visualization of the various distances from the City’s schools, parks, and child care centers, and comparable ordinances, before making a decision. Chief Scott stated the League of Minnesota Cities and City Attorney Tietjen have weighed in and stated that it would be better to control the loitering of offenders rather than where they live. Mayor Droste cautioned against over-regulation as the state may decide to usurp local control, like they did with group homes. 2.e. Body Worn Camera Policy Chief of Police Scott asked if Council has any input on the Body Worn Camera Policy provided. He stated the basis of the policy came from the League, and the City Attorney has reviewed it. ROSEMOUNT CITY COUNCIL WORK SESSION PROCEEDINGS FEBRUARY 13, 2017 Mayor Droste discussed the importance of looking forward and considering adding fiber to add hot spots around the city for officers to connect to. Chief Scott stated there needs to be a public meeting, and the City Attorney has recommended having that meeting at a regular city council meeting. He stated he would make sure the cameras are operating before the meeting. Council members discussed data storage and privacy and other cities’ practices. UPDATES 3. a. Updates from Council and Staff City Administrator Martin confirmed a date for a meeting with the Brigadier General and another with the County Commissioner Atkins. Chief Scott stated that HealthEast has had some recent issues with response times and staffing. Council member Freske inquired about Goal Setting. Mr. Martin stated the facilitator would be available on the evening of the 21st. Council member DeBettignies stated concerns about Frontier. Mayor Droste stated they should be communicating better with the residents where work is getting done. Council member Nelson expressed interest in participating in more meetings with staff and others earlier in the process when there are projects or issues coming up. Mayor Droste stated that if all of the Council comes then the meeting will be public, and the other party may not be interested in that. Council members discussed opportunities to get involved and connect in the community. Mayor Droste discussed a development conference he attended, as well as some upcoming events. Council member DeBettignies discussed his presentation to Cub Scouts Pack 270. Council member Weisensel discussed the LMC meeting he attended last month, and noted the topic of institutional bias. He noted a few upcoming meetings including the Business Luncheon and GreaterMSP. He stated a number of residents are upset about the poor timing of buses coming back from Minneapolis.
